RESOLUTION NO. 82-92
A RESOLUTION OF THE COUNCIL OF THE
CITY OF FRESNO, CALIFORNIA, CONFIRMING
THE REPORT OF THE PUBLIC WORKS DIRECTOR,
AND ASSESSING THE COST OF REPAIRING
EXISTING CONCRETE IMPROVEMENTS ON
VARIOUS STREETS IN THE CITY OF FRESNO.
WHEREAS, on February 23, 1982, the Council received the
report of the Public Works Director previously filed with
the City Clerk, of the work done and the cost thereof to
repair concrete improvements, in front of the parcels of
real property situated on various streets and described in
said report, together with the cost to be assessed against
said parcels of property, in accordance with the Fresno
Municipal Code and Division 7, Part 3, Chapter 22 of the
California Streets and Highways Code (Improvement Act of
1911); and
WHEREAS, the Council finds that the Public Works Di-
rector has caused notice to be duly given, in the manner
provided by law, to the owner or person in possession of
each of said parcels, of the cost of said repair, and the
assessment proposed to be levied against each of said
parcels to pay said cost, and of the time and place set for
hearing thereon, which time and place was stated in said
notice as February 23, 1982, at the hour of 4:30 p.m., in
the Council Chamber, City Hall, 2326 Fresno Street, Fresno,
California; and
WHEREAS, at said time and place the Council has con-
sidered said report of the Public Works Director, including
evidence oral and documentary received concerning the proper
completion of the work, and the cost thereof, and has heard
and considered any and all objections and protests of pro-
perty owners and other interested persons.

NOW, THEREFORE, BE IT RESOLVED that said report of the
Public Works Director is hereby confirmed, and the cost of
repairs, as set forth therein, of the work described there-
in, is hereby assessed against each parcel of property
fronting upon the work so performed, and particularly
described in said report, in the sum set forth in said
report as the assessment against each parcel.
BE IT FURTHER RESOLVED that if any such assessment
shall not be paid within five (5) days after the date of
adoption of this Resolution, the Public Works Director shall
execute and file, in the Office of the County Recorder of
Fresno County, a notice of lien against each parcel of
property for which the assessment has not been paid within
said time and, after said notice of lien has been so filed
of record, shall deliver the same to the Fresno County
Auditor -Controller for entry of the amount thereof on the
County assessment book opposite the description of said
parcel of property, said amount to be collected together
with regular City taxes against the property in the manner
provided by law.

WHEREAS, on February 23, 1982, the Council received the
report of the Public Works Director previously filed with
the City Clerk, of the work done and the cost thereof to
repair concrete improvements, in front of the parcels of
real property situated on various streets and described in
said report, together with the cost to be assessed against
said parcels of property, in accordance with the Fresno
Municipal Code and Division 7, Part 3, Chapter 22 of the
California Streets and Highways Code (Improvement Act of
1911); and
WHEREAS, certain owners of the property described in
the report of the Public Works Director have requested of
the Council of the City of Fresno that the assessments for
the repair of sidewalks on their property be payable in
annual installments, and
WHEREAS, Section 5628.1 of the Streets and Highways
Code of the State of California provides for the payment of
any such assessments in excess of one hundred dollars in
equal annual installments, not to exceed five.
NOW, THEREFORE, IT IS RESOLVED BY THE COUNCIL OF THE
CITY OF FRESNO, AS FOLLOWS:
1. Payments of assessments, upon confirmation, for
repair of sidewalks on various streets in the City of Fresno,
said assessments being in excess of one hundred dollars,
upon written request by the property owner ten days fol-
lowing confirmation, may be made in five equal annual in-
stallments. The first installment shall be due April 1,
1982, and thereafter, installments shall be due on April 1
of each year until paid. Each such installment shall be
delinquent if not paid by the thirty-first day following its
due date.
2. Payment of the assessments so deferred shall bear
interest on the unpaid balance at a rate of six percent per

annum. Said interest shall begin to run on the thirty-first
day after confirmation of the assessments by the Council.
3. Payment of such assessments shall be made to the
Controller of the City of Fresno.
4. When any installment allowed by this Resolution is
not paid when delinquent, the Controller may declare the
unpaid amount of principal and interest due and payable, and
may submit the total balance thereof to the Fresno County
Auditor -Controller for collection, and such amount shall be
collected at the same time and in the same manner as regular
City taxes are collected.
