HomeMy WebLinkAboutResolution - City Council - 82-090 - 1982-02-230 • Ed Bielicki RESOLUTION NO. 82-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, IN THE MATTER OF THE HARVEY-GARDEN NO. 2 DISTRICT REORGANIZATION ORDERING A REORGANIZATION OF THE CITY OF FRESNO, THE MID VALLEY FIRE PROTECTION DIS- TRICT AND THE KINGS RIVER CONSERVATION DIS- TRICT. WHEREAS, the Council of the City of Fresno, pursuant to its Resolution of Application No. 81-280 adopted on July 28, 1981, requested the Fresno Local Agency Formation Commission to take appropriate proceedings for the annexation of the subject terri- tory to the City of Fresno; and WHEREAS, the proposed reorganization known as Harvey -Garden No. 2 District Reorganization is described in Exhibit "A" and graphically depicted in Exhibit "B"; and WHEREAS, with notice given according to law, LAFCO met on November 25, 1981 to hear interested persons, consider the pro- posed reorganization, and adopted Resolution RO-81-53 "Making Determination and Approving Proposed Harvey -Garden No. 2, Dis- trict Reorganization" of the City of Fresno, the Kid Valley Fire Protection District and the Kings River Conservation District; and WHEREAS, Resolution No. RO-81-53 authorized the Council to conduct the proceedings for the reorganization in the manner pro- vided by law; and WHEREAS, on January 19, 1982, the Council initiated proceed- ings for said proposed reorganization by adopting Resolution No. 82-2.9, "Resolution initiating proceedings for the reorganization of the City of Fresno, the Mid Valley Fire Protection District and the Kings River Conservation District" and setting a hearing on the proposed reorganization for February 23, 1982 at 3;00 in the Council Chamber, City Hall, 2326 Fresno Street, Fresno, Cali- fornia, 93721; and WHEREAS, the Council gave the required notice of the time and place for hearing objections to the proposed reorganiza- tion; and Pa ge 1 of 3 ?A-ga referred to as Harvey -Garden No. 2 District Reorganization and described in Exhibits "A" and "B", attached hereto, be annexed to the City of Fresno and the same territory be detached from the Kings River Conservation District and the Mid Valley Fire Protection District of Fresno County. 2. The proposed reorganization is in the best interest of the territory of Harvey -Garden No. 2 District Reorganization and lands have not been improperly omitted from or included within this reorganization. 3. The reasons for this proposed reorganization are: a. The subject territory is within the City of Fresno's Sphere of Influence. b. The annexation is being initiated by the City of Fresno in accordance with the Council's policy to unify the metropolitan area. C. It is advantageous for the territory within Harvey -Garden No. 2 District Reorganization to be a part of the City of Fresno. IT IS FURTHER RESOLVED by the Council of the City of Fresno that the Harvey -Garden No. 2 District Reorganization be and is hereby allocated to Council. District No. 4. MAKING DETERMINATION AND APPROVING) PROPOSED 'HARVEY-GARDEN #2" RESOLUTION OF THE 2 REORGANIZATION ) FRESNO LOCAL AGENCY FORMATION COMMISSION -------------------- 4 WHEREAS, Preliminary proceedings were initiated by the City of 5 Fresno to annex territory generally located south of Harvey Avenue 6 between Garden and Winery Avenues to the City of Fresno and detach 7 from the Mid -Valley Fire Protection District and Kings River 3 Conservation District in the County of Fresno; and ? WHEREAS, an application for said proposal was accepted for > filing by the Executive Officer of this Local Agency Formation Commission; and WHEREAS, said application was set for hearing by'the Executive Officer on the 25th day of November, 1981, at the hour of 2:30 p.m, Of said day; and WHEREAS, notice of the hearing of said application was duly given by mail, posting, and newspaper publication as required by law; and WHEREAS, the Executive Officer reviewed said application and prepared a report, including his recommendations thereon, said application and report having been presented to and considered by this Commission; and WHEREAS, this Commission considered all relevant factors and heard all interested parties wishing to speak on said application; and WHEREAS, the Commission has reviewed and considered the nformation in the Negative Declaration as provided in the Executive fficer's Report duly prepared and filed by the City of Fresno.
