HomeMy WebLinkAboutResolution - City Council - 82-081 - 1982-02-23• Ed Bielicki • RESOLUTION NO. 82-81 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL AGENCY FORMATION COMMISSION IN THE MATTER OF THE PROPOSED CHURCH -WEST NO. 2 DISTRICT REORGAN- IZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORIES FROM THE MID VALLEY FIRE PROTECTION DISTRICT, THE NORTH CENTRAL FIRE PROTECTION DIS- TRICT AND FROM THE KINGS RIVER CONSERVATION DIS- TRICT AND ANNEXATION OF THE ENTIRE TERRITORY TO THE CITY OF FRESNO. WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Govern- ment Code; and WHEREAS, the nature of the proposed change is a reorgan- ization consisting of the detachment of certain territory consisting of Part I containing 260 acres from the Mid Valley Fire Protection District, Part II containing 140 acres from the North Central Fire Protection District and 400 acres from the Kings River Conservation District, and annexation of the entire project area of 400 acres to the City of Fresno; and WHEREAS, said reorganization consisting of 400 acres is hereinafter called the "subject territory"; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the proposed reorganization is uninhabited, is described in Exhibit "A", and graphically depicted in Exhibit "B"; and WHEREAS, no new districts are proposed to be formed by this reorganization; and WHEREAS, the Fresno county Assessor's roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the subject territory proposed to be annexed to the City of Fresno will be exempted from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebtedness incurred by the City prior to the effective date of such annexation and upon completion of this reorganization / Page 1 of 3 proposal the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual obligations; and WHEREAS, the reasons for this proposal are stated as follows: 1. Annexation of the subject territory to the City of Fresno will result in improved land use planning. All private development con- trols of the City will apply, which include the City's UGM process, following reorganization. 2. Property owners of four parcels within the pro- ject area petitioned the City for annexation. 3. The subject territory is within the City of Fresno's Sphere of Influence. 4. It is advantageous for the Church -West No. 2 District Reorganization to be a part of the City. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedings be taken by the Fresno Local Agency Formation Commission for the herein proposed Church -West No. 2 District Reorganization, includ- ing the detachment of portions of the subject territory, con- sisting of Part I containing 140 acres from the North Central Fire Protection District, Part II containing 260 acres, and all of the 400 acres from the Kings River Conservation District, and annexation of the entire project area of 400 acres to the City of Fresno. BE IT FURTHER RESOLVED: 1• Staff prepare and process an environmental assessment pursuant to the provisions of the California Environmental Quality Act and Article 5 of Chapter 12 of the Fresno Municipal Code, re- lating to this reorganization proposal. 2• Staff prepare and process a service plan, pur- suant to Government Code Section 35102 and the rules of the Fresno County Local Agency Form- ation Commission, for the subject territory. Staff submit and file the completed environmental assessment, service plan, this resolution, and all related or necessary documents, with the Fresno Local Agency Formation Commission. 4. Staff mail an informational letter to all property owners within the subject territory explaining the ramifications of annexation prior to the submission and filing of this re- solution with the Fresno Local Agency Formation Commission.
