RESOLUTION NO. 82-81
RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO APPLYING TO THE FRESNO LOCAL AGENCY
FORMATION COMMISSION IN THE MATTER OF THE
PROPOSED CHURCH -WEST NO. 2 DISTRICT REORGAN-
IZATION, INCLUDING THE DETACHMENT OF CERTAIN
TERRITORIES FROM THE MID VALLEY FIRE PROTECTION
DISTRICT, THE NORTH CENTRAL FIRE PROTECTION DIS-
TRICT AND FROM THE KINGS RIVER CONSERVATION DIS-
TRICT AND ANNEXATION OF THE ENTIRE TERRITORY
TO THE CITY OF FRESNO.
WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of Part I containing 260 acres from the Mid Valley
Fire Protection District, Part II containing 140 acres from
the North Central Fire Protection District and 400 acres from
the Kings River Conservation District, and annexation of the
entire project area of 400 acres to the City of Fresno; and
WHEREAS, said reorganization consisting of 400 acres
is hereinafter called the "subject territory"; and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is uninhabited,
is described in Exhibit "A", and graphically depicted in
Exhibit "B"; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno county Assessor's roll will be
used for the purpose of levying any assessments or taxes
on the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for the
payment of principal or interest, or any other amounts
which shall become due on account of any outstanding bonded
indebtedness incurred by the City prior to the effective date
of such annexation and upon completion of this reorganization

proposal the subject territory will be included in Municipal
Bond Area "D" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1. Annexation of the subject territory to the
City of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, which include
the City's UGM process, following reorganization.
2. Property owners of four parcels within the pro-
ject area petitioned the City for annexation.
3. The subject territory is within the City of
Fresno's Sphere of Influence.
4. It is advantageous for the Church -West No. 2
District Reorganization to be a part of the City.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed Church -West No. 2 District Reorganization, includ-
ing the detachment of portions of the subject territory, con-
sisting of Part I containing 140 acres from the North Central
Fire Protection District, Part II containing 260 acres, and all
of the 400 acres from the Kings River Conservation District, and
annexation of the entire project area of 400 acres to the City
of Fresno.
BE IT FURTHER RESOLVED:
1• Staff prepare and process an environmental
assessment pursuant to the provisions of the
California Environmental Quality Act and Article
5 of Chapter 12 of the Fresno Municipal Code, re-
lating to this reorganization proposal.
2• Staff prepare and process a service plan, pur-
suant to Government Code Section 35102 and the
rules of the Fresno County Local Agency Form-
ation Commission, for the subject territory.

3. Staff submit and file the completed environmental
assessment, service plan, this resolution, and
all related or necessary documents, with the
Fresno Local Agency Formation Commission.
4. Staff mail an informational letter to all
property owners within the subject territory
explaining the ramifications of annexation
prior to the submission and filing of this re-
solution with the Fresno Local Agency Formation
Commission.

Part I
Area to be Detached from the Mid Valley Fire Protection District, the Kings
River Conservation District, and Annexed to the City of Fresno.
Consisting of Lots 44, 45, 81, 82, 83 and 84 of Fresno Colony, lying in Sections
17 and 20, 14/20; portions of Sections 17 and 18, 14/20, M.D.B.6M.
BEGINNING at the Southeast corner of Section 17, Township 14 South, Range 20
East, Mount Diablo Base and Meridian, as said Section is shown on the United
States Government Township Plats, being also, a point on the existing City
Limits of the City of Fresno; thence Westerly, along the South line of said
Section 17, being also, along the existing City Limits of said City, a distance
of 1992.25 feet, to the intersection with the Southerly production of the West
line of Walnut Gardens No. 4, according to the Map thereof, filed in the Office
of the County Recorder December 23, 1952 and recorded in Volume 16 of Plats at
page 11, Fresno County Records; thence Northerly, along the Southerly produc-
tion of the West line of said Walnut Gardens No. 4, and along the West line of
said Walnut Gardens No. 4, and along the West line of Lot 43 of Fresno Colony,
according to the Map thereof, filed in the Office of the County Recorder August
1, 1881 and recorded in Volume 2 of Plats at page 8, Fresno County Records, and
along the Northerly production of the West line of said Lot 43, being also, along
the existing City Limits of said City, to the intersection with the South line
of the Northeast Quarter of said Section 17, and along the South line of the
Northwest Quarter of said Section 17,-being also, along the existing City Limits
of said City, to the West Quarter corner of said Section 17; thence continuing
Westerly, along the North line of the Southeast Quarter of Section 18, of said
Township and Range, a distance of 30.00 feet; thence Southerly, along a line
which is parallel with and 30.00 feet West of the East line of said Section 18,
a distance of 30.00 feet; thence Easterly, along a line which is parallel with
