RESOLUTION NO. 82-79
RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO APPLYING TO THE FRESNO LOCAL AGENCY
FORMATION COMMISSION IN THE MATTER OF THE
PROPOSED WHITE -GARDEN NO. 4 DISTRICT RE-
ORGANIZATION, INCLUDING THE DETACHMENT OF
CERTAIN TERRITORY CONSISTING OF 4.15 ACRES
FROM THE MID VALLEY FIRE PROTECTION DISTRICT
AND THE KINGS RIVER CONSERVATION DISTRICT,
AND ANNEXATION OF SAID TERRITORY TO THE CITY
OF FRESNO.
WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 4.15 acres and hereinafter called the "subject
territory" from the Mid Valley Fire Protection District
and the Kings River Conservation District, and annexation of
the same territory to the City of Fresno; and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is uninhabited,
is described in Exhibit "A" and graphically depicted in
Exhibit "B", and
WHEREAS, the Master Service Delivery Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Master Service Delivery
Plan; and
WHEREAS, the Master Service Delivery Plan specifies City
plans and policies for the provisions of services to the sub-
ject territory; and

WHEREAS, review and analysis of Environmental Assess-
ment No. 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of Planning and Inspection; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assessor's roll will be
used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or interest, or any other amounts which
shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bonded Area "D" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1. Annexation of the subject territory to the
City of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, following re-
organization.
2. The subject territory is within the City of
Fresno's Sphere of Influence.
3. The annexation is being initiated by the City
of Fresno in accordance with the Council's policy
to unify the metropolitan area. The project area
includes parcels of owners who have consented to
annexation in exchange in water services from the
City of Fresno.
4. It is advantageous for the subject territory to
be a part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City Of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed White -Garden No. 4 District Reorganization,
including the detachment of the subject territory, consist-
ing of 4.15 acres from the Mid Valley Fire Protection
District and the Kings River Conservation District, and
annexation of the same territory to the City of Fresno; and
BE IT FURTHER RESOLVED the Council of the City of
Fresno finds Environmental Assessment No. 3174 is the con-
trolling environmental document for this annexation pro-
posal, such environmental assessment has been completed
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contained in such environ-
mental assessment prior to the approval of the initiation
Of this annexation proposal and finds there is no poss-
ibility such proposal may have a significant effect on
the environment.

Area to be Detached from the Mid Valley Fire Protection District and the Kings
River Conservation District and Annexed to the City of Fresno.
Consisting of Lots 6 and 7, in Block 4, and Lots 4 and 5, in Block 1, all of
Belmont Gardens, lying in Section 31, 13/21 M.D.B. s M.
Beginning at the northwest corner of Lot 7, in Block 4 of Belmont Gardens,
as said lot is shown on the Map thereof, filed in the Office of the County
Recorder June 4, 1936 and recorded in Volume 11 of Plats of Page 39, Fresno
County Records, being also, a point as the existing City Limits of the City
of Fresno; thence Southerly, along the West line of said Lot 7, in Block 4,
and along the Southerly production of the West line of said Lot 7, in Block
4, being also, along the existing City Limits of said City, to the intersection
With a line which is parallel with and 30.00 feet South of the South line of
said Lot 7, in Block 4; thence continuing, Southerly, along the northerly pro-
duction of the East line of Lot 4, in Block 1, of said Belmont Gardens, and
along the West line of said Lot 4, in Block 1, to the southwest corner of
said Lot 4, in Block 1, being also, the southeast corner of Lot 3, of said
Belmont Gardens, being also, a point of the existing City limits of said City;
thence Easterly, along the south lines of Lot 4 and 5, in Block 1, and along the
Easterly production of the south line of Lot 5, in Block 1, of said Belmont Gardens,
being also, along the existing City Limits of said City, to the intersection with
a line which is parallel with and 30.00 feet East of the East line of said Lot 5
in Block 1; thence Northerly, along a line which is parallel with and 30.00 feet
East of the East lines of Lots 5, in Block 1 and 6, in Block 4, of said Belmont
Gardens, to the intersection with the Easterly production of the North line of
said Lot 6, in Block 4, being also, a point on the existing City Limits of said
