RESOLUTION NO. 82-76
A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO
ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. FRE-35
WHEREAS, on December 22, 1981, the Council adopted
Resolution No. 81-517, which called for a public hearing for
February 16, 1982, at the hour of 11:00 a.m., in the Council
Chambers in City Hall, Fresno, California, to ascertain
whether the public necessity, health, safety, or welfare,
require the removal of poles, overhead wires and associated
overhead structures and the underground installation of
wires and facilities for supplying electrical, communication
or similar or associated service within the general boun-
daries of Clinton Avenue, between First Street and Winery
Avenue, as shown on the map entitled "Underground Utility
District No. FRE-35", which is on file in the Office of the
City Clerk of the City of Fresno, at Fresno City Hall, 2326
Fresno Street, Fresno, California. The area shall also
include all properties abutting the streets in the District;
and
WHEREAS, a finding of no possibility of significant
adverse effects was made for this project (Environmental
Assessment No. 4373) pursuant to Section 15060 of the State
EIR Guidelines; and
WHEREAS, a notice of hearing has been given to all
affected property owners as shown on the last equalized
utilities concerned in the manner an
assessment roll and
for the time required by law; and
WHEREAS, such hearing has been duly and regularly held,
and all persons interested have been given an opportunity to
be heard.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby finds and determines that public
necessity, health, safety, and welfare, require the removal
of poles, overhead wires and associated structures, and the
underground installation of wires and facilities for supply-
ing electrical, communication, or similar or associated
service on all that certain area lying within the District
boundary, plus yards on abutting properties as shown on the
map entitled "Underground Utility District No. FRE-35",
(which is hereby referred to and incorporated herein as
though set forth in full), for the reason that such removal
and installation will avoid or eliminate an unusually heavy
concentration of overhead facilities, that the streets
involved are extensively used and carry a heavy volume of
traffic, and such described area is hereby established as
Underground Utility District No. FRE-35.
BE IT FURTHER RESOLVED that the following exceptions in
said Underground Utility District No. FRE-35 be made and
they are hereby authorized:
a. Equipment appurtenant to underground facilities
such as surface -mounted transformers, pedestal -
mounted terminal boxes and meter cabinets, and
concealed ducts.
b. Any municipal facilities or equipment installed
under the supervision and to the satisfaction of
the Director.
BE IT FURTHER RESOLVED that all underground installa-
tion shall be made in said underground utility district by
the affected utility companies no later than January 15,
1983.

BE IT FURTHER RESOLVED that property owners or resi-
dents desiring to continue to receive electric communication
or similar service from the lines of the affected utilities
shall make the necessary facility changes on their premises
in order to receive such service no later than January 15,
1983.
BE IT FURTHER RESOLVED that the City Clerk, within
thirty (30) days after the adoption of this resolution,
shall give notice as required by Section 11-808 of the
Fresno Municipal Code.
