RESOLUTION NO. 82-66
A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, ESTABLISHING A MORATORIUM ON THE
PROCESSING, REVIEW, APPROVAL OF DEVELOPMENT
ENTITLEMENTS FOR PROPERTIES LOCATED WITHIN THE
SOUTHWEST FRESNO GENERAL NEIGHBORHOOD RENEWAL
AREA PROJECT
WHEREAS, in furtherance of the United Sates Housing Act
of 1949, as amended, and the California Community Redevelopment
Act, the Redevelopment Agency of the City of Fresno ("Agency")
has undertaken a program for the clearance and reconstruction
or rehabilitation of slum and blighted areas in the City;
and
WHEREAS, the Council of the City of Fresno recognizes
the existence within the City of blighted areas which con-
stitute physical, social, or economic liabilities, and
require redevelopment and rehabilitation in the interest of
the health, safety, and general welfare of the citizens of
the City of Fresno; and
WHEREAS, the Planning Commission and Council of the
City of Fresno have found that the Southwest Fresno General
Neighborhood Renewal Area (GNRA), hereinafter referred to as
the "Project Area", is severely blighted, underutilized, and
stagnant in terms of investment, and the area contains a
predominance of properties which suffer from economic dis-
location, deterioration, and disuse resulting from faulty
planning; and
WHEREAS, the condition of the Project Area will tend to
further obsolescence, deterioration, and disuse because of a
lack of incentive to individual landowners and the inability
of such persons to improve, modernize, and rehabilitate
their property while the condition of neighboring properties
remains unchanged; and

WHEREAS, in order to remedy such condition, the Agency
and City of Fresno are carrying out an urban renewal project
and community redevelopment plan, known as the "Southwest
Fresno GNRA Project Urban Renewal Plan" and hereinafter
referred to as "the Plan", which was adopted in January
1969, and amended thereafter in August 1972; and
WHEREAS, on February 16, 1982, the Council of the City
of Fresno initiated amendments to the Plan in order to bring
it into conformance with changes in the City's general
planning policies, as reflected by the Edison Community
Plan, adopted in May 1977; and
WHEREAS, the proposed amendments include revisions to
the land use and zoning patterns as currently planned
throughout large portions of the Project Area, and such
amendments will be circulated for public comment and hear-
ings before affected public agencies pursuant to the Com-
munity Redevelopment Law; and
WHEREAS, a brief moratorium on construction or develop-
ment is necessary in order to insure that the purposes of
the Community Redevelopment Law are not impaired during the
period in which the proposed amendments to the Plan are in
the process of public review and hearing, and that any
development within the Project Area will be consistent with
the objectives of the Community Redevelopment Law and the
Plan, and that properties within the Project Area are not
economically or irreversibly committed to uses which would
be inconsistent with the amendments ultimately adopted by
the Council and the Agency.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the
City of Fresno as follows:
1. Except as otherwise provided in this Resolution, a
90-day moratorium is hereby established within the

area of the Southwest Fresno GNRA Project Urban
Renewal Plan, wherein no applications for any
development entitlements, including but not limited
to subdivisions, rezonings, special permits,
building permits for new uses, or expanded exist-
ing uses and structures beyond the limitations
presently permitted by Section 12-317 of the
Fresno Municipal Code, shall be accepted, processed,
or approved by the City of Fresno for properties
within the Project Area designated as "Properties
Subject to Moratorium" on the attached Exhibit
"A"
2. The provisions of this Resolution shall not apply
to those development entitlement applications
which, upon the joint determination of the De-
partments of Housing and Community Development and
Planning and Inspection, are in conformance with
the proposed amendments.
3. This Resolution is effective upon adoption and
shall expire and be of no further force and effect
at 12:01 on the 91st day following its adoption,
unless sooner rescinded.
