RESOLUTION NO. 82-65
RESOLUTION REGARDING HERNDON AVENUE GRADE
SEPARATION AT THE SANTA FE RAILROAD:
ACCEPTANCE OF STREETS INTO THE COUNTY
HIGHWAY SYSTEM
WHEREAS, Section 1700 of the California Streets and
Highways Code provides that the Board of Supervisors may, by
a Resolution adopted by 4/5 vote, declare any highway in the
County lying within a city to be a County highway for the
purpose Of acquisition of right -Of -way, construction,
maintenance, improvement, or repair, and
WHEREAS, Section 1701 of the California Streets and
Highways Code provides that the affected city may consent to
the establishment of such included portion as a part of the
County highway, and
WHEREAS, for the reasons stated in the memorandum
attached hereto, and incorporated 'herein by reference, it is
necessary to declare that portion of Herndon Avenue and con-
necting roadways lying in the City Of Fresno and within the
construction limits of the grade separation project at the
Santa Fe Railroad crossing a County highway, and
WHEREAS, a description of the included portion of
highways is included in Exhibit "A" attached hereto and
incorporated by reference.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Fresno that it consents to the portion of Herndon
Avenue and connecting roadways described in Exhibit "A"
being declared to be County highways for the purposes of
acquisition of right-of-way, construction, maintenance,
improvement, or repair.
