RESOLUTION NO. 82-51
A RESOLUTION OF THE COUNCIL OF THE
CITY OF FRESNO, CALIFORNIA AUTHORIZING
THE PURCHASE OF A REMANUFACTURED AIR
CONDITIONING UNIT COMPRESSOR FROM SOLE
SOURCE WITHOUT ADVERTISED COMPETITIVE
BIDDING
WHEREAS, the Council has received and considered the report
and recommendation of the Chief Administrative Officer; and upon
such report and recommendation, the Council finds as follows:
1. The air conditioning unit which serves the City Hall was
manufactured by the Trane Company. The unit has been in service
for 16 years.
2. The compressor portion of the unit was scheduled for
overhaul this year, but it was found that the wear tolerances
would not justify the overhaul expense.
3. The Trane Company offers rebuilt compressors to fit the
air conditioning unit which would meet the need for the particular
compressor.
4. Since the compressor is a component of the larger unit
made by the Trane Company and the unit would be purchased directly
from the factory, there are no other suppliers of the compressor.
5. Accepting the offer of the Trane Company would necessarily
exclude all others, and any attempt at advertised, competitive
biddings would work incongruity, would not affect the final result
and would produce no advantage to the City.
IT IS THEREFORE RESOLVED by the Council of the City of Fresno,
California, that advertised competitive bidding for the purchase
of an exchange rebuilt compressor is dispensed with and the
Purchasing Agent is authorized to purchase the compressor from
the Trane Company, the total cost thereof, including taxes not
to exceed $8,300.
