RESOLUTION NO. 82-49
A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO, CALIFORNIA, ESTABLISHING A
CONDOMINIUM CONVERSION PROTECTION AREA
IN THE VICINITY OF FRESNO STATE UNIVERSITY.
WHEREAS, on November 17, 1981, by Ordinance No. 81-158,
the Council amended the Fresno Municipal Code relating to
condominium conversions; and
WHEREAS, Section 12-901 of the Fresno Municipal Code
relating to the purpose of the condominium conversion ordinance
includes the following finding by the Council:
The Council finds that there are institutions
and facilities located within the community,
near which it is desirable to protect the
supply of existing multiple dwelling rental
units.
and
WHEREAS, the Council finds that multiple family residential
areas within one half mile of the campus of California State
University at Fresno supply much of the present off -campus
housing for students of the university, and are within walking
distance of the university; and
WHEREAS, approximately half of the apartment units avail-
able for student rental in the Fresno Metropolitan Area are
located within one half mile of the university campus; and
WHEREAS, a significant number of condominium conversions
heretofore approved by the Council are located within one half
mile of the university; and
WHEREAS, the Council finds that it is desirable and
necessary to protect the supply of multiple dwelling rental
units near the university campus.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno finds that the approval of condominium conversion
applications within the area bounded by Bullard Avenue on
the north, the Millbrook Avenue alignment on the west, Gettysburg
Avenue on the south, and the Clovis city limits on the east,

as shown on the attached Exhibit "A," is likely to cause
displacement of university students, and sufficient comparable
replacement housing is not likely to be available for such
students within such area. The above described area is
hereby established as a condominium conversion protection
area.
BE IT FURTHER RESOLVED that no application for a
condominium conversion project shall be approved within such
area except upon a two-thirds vote of the Council.
