HomeMy WebLinkAboutResolution - City Council - 82-043 - 1982-01-26Public Works RESOLUTION NO. 82-43 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, DETERMINING THAT PAYMENT OF THE COST OF REPAIR OF SIDEWALKS MAY BE IN ANNUAL INSTALLMENTS. WHEREAS, on January 26, 1982, the Council received the report of the Public Works Director previously filed with the City Clerk, of the work done and the cost thereof to repair concrete improvements, in front of the parcels of real property situated on various streets and described in said report, together with the cost to be assessed against said parcels of property, in accordance with the Fresno Municipal Code and Division 7, Part 3, Chapter 22 of the California Streets and Highways Code (Improvement Act of 1911); and WHEREAS, certain owners of the property described in the report of the Public Works Director have requested of the Council of the City of Fresno that the assessments for the repair of sidewalks on their property be payable in annual installments, and WHEREAS, Section 5628.1 of the Streets and Highways Code of the State of California provides for the payment of any such assessments in excess of one hundred dollars in equal annual installments, not to exceed five. NOW, THEREFORE, IT IS RESOLVED BY THE COUNCIL OF THE CITY OF FRESNO, AS FOLLOWS: 1. Payments of assessments, upon confirmation, for repair of sidewalks on various streets in the City of Fresno, said assessments being in excess of one hundred dollars, upon written request by the property owner ten days fol- lowing confirmation, may be made in five equal annual in- stallments. The first installment shall be due March 1, 1982, and thereafter, installments shall be due on March 1 of each year until paid. Each such installment shall be delinquent if not paid by the thirty-first day following its due date. 2. Payment of the assessments so deferred shall bear interest on the unpaid balance at a rate of six percent per REVI E'NED CA r� — N\z Qa - (43 Page Two annum. Said interest shall begin to run on the thirty-first day after confirmation of the assessments by the Council. 3. Payment of such assessments shall be made to the Controller of the City of Fresno. 4. When any installment allowed by this Resolution is not paid when delinquent, the Controller may declare the unpaid amount of principal and interest due and payable, and may submit the total balance thereof to the Fresno County Auditor -Controller for collection, and such amount shall be collected at the same time and in the same manner as regular City taxes are collected.
