RESOLUTION NO. 82-38
A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO, CALIFORNIA, AMENDING THE
FRESNO HIGH-ROEDING COMMUNITY PLAN
AND ESTABLISHING A MORATORIUM ON
DEVELOPMENT ENTITLEMENT APPROVALS
WITHIN THIS PLAN AMENDMENT AREA.
WHEREAS, on December 1, 1977, by Resolution No. 77-521,
the Council adopted the Fresno High-Roeding Community Plan; and
WHEREAS, on February 17, 1981, by Resolution No. 81-65,
the Council initiated procedures to amend the Fresno High-
Roeding Community Plan as shown on the attached Exhibit "A",
as requested by the applicant; and
WHEREAS, Final Environmental Impact Report No. 10080
for the proposed amendment was completed pursuant to the
Environmental Quality Ordinance, and the California Environmental
Quality Act and the State EIR Guidelines; and
WHEREAS, the Planning Commission, on December 16, 1981
conducted a public hearing on said amendment, and after
consideration of the environmental documents, testimony, and
evidence, determined that the modified amendment, as shown
on the attached map, labeled Exhibit "B", is in the best
interest of the City; and recommended to the Council by
Resolution No. 7661, that the Land Use Element of the Fresno
High-Roeding Community Plan be amended as shown on the
attached map labeled Exhibit "B"; and
WHEREAS, the Council, on January 19, 1982, considered
and certified Environmental Impact Report No. 10080 and
adopted measures to mitigate the negative environmental
effects identified in the environmental imparct report; and
WHEREAS, the Council of the City of Fresno did, on the
19th of January, 1982, conduct a public hearing on the
proposed amendment and considered environmental documents,
testimony and evidence; and
WHEREAS, the Council desires to promote the spirit of
cooperation between the City and the County Of Fresno regarding
coordinated planning for the future physical development of

the area located west of Freeway 99; and
WHEREAS, the revised General Plan for the City of
Fresno will be considered for adoption by the Council during
the first half of 1982.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby amends the Fresno High-Roeding Community
PLan by adopting the land use and circulation designation
changes as shown on Exhibit "B", subject to the condition
that development of the property within the amendment area
shall be in accordance with the mitigation measures adopted
in Council Resolution No. 82-33 certifying Environmental
Impact Report No. 10080.
BE IT FURTHER RESOLVED that the Council of the City of
Fresno hereby declares a moratorium upon the acceptance and
approval of all applications for development entitlements,
including but not limited to subdivision maps, parcel maps,
rezonings, special permits, building permits, and UGM permits,
within the area of this amendment to the Fresno High-
Roeding Community Plan, provided that applications for
development entitlements related to not more than 150 gross
acres of land immediately annexable to the City of Fresno
may be accepted, processed, and approved.
BE IT FURTHER RESOLVED that said moratorium shall
expire on June 26, 1982, or upon adoption of the revised
General Plan by the City of Fresno, whichever occurs earlier.
