RESOLUTION NO. 82-37
RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA, AUTHORIZING EXECUTION
OF THE CONSENT TO COMMON USE AGREEMENT
BY AND BETWEEN THE PACIFIC GAS AND ELECTRIC
COMPANY AND THE CITY OF FRESNO
WHEREAS, on May 27, 1981, the Council of the City of
Fresno adopted Resolution No. 81-194 approving the Final
Subdivision Map of Tract No. 3248, and approving and auth-
orizing execution of the Subdivision Agreement; and
WHEREAS, the Subdivider of Tract No. 3248 entered into
an Agreement with the City of Fresno dated May 27, 1981, to
provide for the construction of certain improvements within
Tract No. 3248; and
WHEREAS, the Subdivider requested an Amendment to said
Agreement for Tract No. 3248 to allow the installation of a
public water main to serve Tract No. 3248 across private
property and through an existing Pacific Gas and Electric
Company easement; and
WHEREAS, on December 8, 1981, the Council of the City
of Fresno approved said Amendment to the Agreement for Tract
No. 3248; and
WHEREAS, said Amendment to the Agreement for Tract No.
3248 required the Subdivider to apply for a Consent to
Common Use Agreement with the Pacific Gas and Electric
Company, to provide for the installation, operation and
maintenance of the water main within the existing Pacific
Gas and Electric Company easement; and
WHEREAS, the Pacific Gas and Electric Company has
provided the City of Fresno with a Consent to Common Use
Agreement and has requested the City of Fresno to execute
said Agreement; and
WHEREAS, the City Attorney has reviewed and approved
said Agreement.

NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Fresno as follows:
1. THAT the Public Works Director of the City of
Fresno is hereby authorized to execute for and on behalf of
the City of Fresno, the Consent to Common Use Agreement by
and between the City of Fresno and the Pacific Gas and
Electric Company, for Tract No. 3248.
