RESOLUTION NO. 82-16
RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO APPLYING TO THE FRESNO LOCAL AGENCY
FORMATION COMMISSION IN THE MATTER OF THE
PROPOSED BULLARD-FORKNER NO. 3 DISTRICT
REORGANIZATION, INCLUDING THE DETACHMENT
OF CERTAIN TERRITORY CONSISTING OF 28
ACRES FROM THE NORTH CENTRAL FIRE PROTECT-
ION DISTRICT AND THE KINGS RIVER CONSERVA-
TION DISTRICT, AND ANNEXATION OF SAID TER-
RITORY TO THE CITY OF FRESNO.
WHEREAS, this proposal is made pursuant to the District
Reorganization Act of 1965 contained in Division 1 of Title
6 (commencing with Section 56000) of the California Govern-
ment Code; and
WHEREAS, the nature of the proposed change is a reorgan-
ization consisting of the detachment of certain territory
consisting of 28 acres and hereinafter called the "subject
territory" from the North Central Fire Protection District
and the Kings River Conservation District, and annexation of
the same territory to the City of Fresno; and
WHEREAS, no other counties, cities, or districts are
affected; and
WHEREAS, the proposed reorganization is uninhabited,
is described in Exhibit "A" and graphically depicted in
Exhibit "B"; and
WHEREAS, the Master Service Delivery Plan, adopted by
the Council on November 13, 1979, prepared in accordance
with Government Code Section 35102, provides information
for the City of Fresno's plans and policies for the pro-
vision of services in the metropolitan area; and
WHEREAS, pursuant to Resolution No. 80-172, the Council
has approved the implementation of the Master Service Delivery
Plan; and
WHEREAS, the Master Service Delivery Plan specifies City
plans and policies for the provisions of services to the sub-
ject territory; and

WHEREAS, review and analysis of Environmental Assess-
ment No. 3174, relating to the Master Service Delivery
Plan has resulted in the filing of a Negative Declaration
by the Director of Planning and Inspection; and
WHEREAS, no new districts are proposed to be formed
by this reorganization; and
WHEREAS, the Fresno County Assessor's poll will be
used for the purpose of levying any assessments or taxes on
the subject territory; and
WHEREAS, the subject territory proposed to be annexed
to the City of Fresno will be exempted from taxation for
payment of principal or interest, or any other amounts which
shall become due on account of any outstanding bonded indebt-
edness incurred by the City prior to the effective date of
such annexation, and upon completion of this reorganization
proposal, the subject territory will be included in Municipal
Bonded Area "D" and will not be taxed for any existing bonded
indebtedness or contractual obligations; and
WHEREAS, the reasons for this proposal are stated as
follows:
1. Annexation of the subject territory to the
City of Fresno will result in improved land
use planning. All private development con-
trols of the City will apply, following re-
organization.
2. The subject territory is within the City of
Fresno's Sphere of Influence.
3, A property owner within the project area
has consented to annexation to the City.
4, It is advantageous for the subject territory
to be a part of the City.

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Fresno hereby requests that proceedings be taken by
the Fresno Local Agency Formation Commission for the herein
proposed Bullard-Forkner No. 3 District Reorganization,
including the detachment of the subject territory, consist-
ing of 28 acres from the North Central Fire Protection
District and the Kings River Conservation District, and
annexation of the same territory to the City of Fresno; and
BE IT FURTHER RESOLVED the Council of the City of
Fresno finds Environmental Assessment No. 3174 is the con-
trolling environmental document for this annexation pro-
posal, such environmental assessment has been completed
in compliance with the California Environmental Quality
Act and the State Guidelines, and the Council has reviewed
and considered the information contained in such environ-
mental assessment prior to the approval of the initiation
of this annexation proposal and finds there is no poss-
ibility such proposal may have a significant effect on
the environment.

DISTRICT REORGANIZATION
Area to be Detached from the North Central Fire Protection District, the Kings
River Conservation District, and Annexed to the City of Fresno.
Consisting of Lots 31, 33, 34 and 35 of Bullard Lands Irrigated Subdivision No.
2, lying in Section 7, 13/20, M.D.B.bM.; portions of Lots 23 and 24 of Bullard
Lands Irrigated Subdivision No. 2, lying in Section 6, 13/20, M.D.B.6M.
BEGINNING at the Southwest corner of Lot 2 of Bullard Lands Irrigated Subdivision
No. 2, Lying in Section 7, Township 13 South, Range 20 East, Mount Diablo Base
and Meridian, as said Section is shown on the United States Government Township
Plats, as said Subdivision is shown on the Map thereof, filed in the Office of
the County Recorder March 7, 1913 and recorded in Book 9 of Record of Surveys
at page 15, Fresno County Recotds, being also, a point on the existing City Limits
of the City of Fresno; thence Northerly, along the West line of said Lot 2, being
also, along the existing City Limits of said City, to the Northwest corner of said
Lot 2; thence Westerly, along the South line of Lot 32, of said Bullard Lands Irri-
gated Subdivision No. 2, lying in said Section 7, and along the Westerly produc-
tion of the South line of said Lot 32, being also, along the existing City Limits
of said City, to a point which is 50.00 feet West of the Southwest corner of said
Lot 32; thence Northerly, along a line which is parallel with and 50.00 feet West
of the West line of said Lot 32, and along a line which is parallel with and 50.00
feet West of the West lines of Lots 9 and 10, of said Bullard Lands Irrigated Sub -
Division No. 2, lying in Section 6, Township 13 South, Range 20 East, Mount Diablo
Base and Meridian, being also, along the existing City Limits of said City, to the
intersection with the Easterly production of the North line of the South Half of
Lot 23, of said Bullard Lands Irrigated Subdivision No. 2, Lying in said Section
6; thence Westerly, along the Easterly production of the North line of the South
