S DISTRICT REORGANI- ZATION ORDERING A REORGANIZATION OF THE CITE'` 01' FRESNO, THE FRESNO METROPOLITAN FLOOD CONTROL DISTRICT AND 7 E NORTH CEN- TRAL FIRE PROTECTIO14 DISTRICT. WHEREAS, the Council of the City of Fresno, pursuant Jo Resolution No. 78-481 applying for and requesting the Fresno Local Agency Formation Commission to tale appropriate proceedings for the annexation of land more particularly described below to the City of ` Fresno, the Fresno Metropolitan Flood Control Distr-!.ct and the detachment of the same territory from the North Central Fire Protection Dis- trict; and WHEREAS, such reorganization proposal was assigned the short form designa- tion of Ashlan-Valentine No. 3; and WHEREAS, the Fresno Local Agency Formation Commission can the 25th day of .April, 1979, at a duly noticed public hearing, considered all matters relevant to the proposed reorganization and heard all persons interested, and adopted Resolution No. RO-78-44, "Making Determination and Approving the Proposed A -.plan. Valentine No 3 Reorganization", all at a time and in the farm and manner as pre- scribed by law; and WHEREAS, subsequent to the adoption of Resolution No. RO-78-44 on. May 25, 197S the Commission adopted Resolution No. RO-�78-44-A related to the condition for the acquisition or transfer of the Worth Central Fire Station located at ShaTAT and Brawley Avenues; and WHEREAS,, said Fresno Local. Agency Formation Commission` Resolution No. RO-78-44 authorized the Council to conduct the proceedings for the reorganization in the manner provided by law; and WHEREAS, the Council pursuant to Resolution. Na,. 79-362 initiated proceedings for said proposed reorganization and set a hearing on the proposed reorganization for the 2nd dale of October at 2:20 p.m. in the Council Chamber, City .Hall, 2326 Fresno Street, Fresno, California, 93721; and WHEREAS, the Council finds that the required notice of the passage of said rescluton initiating proceedings for the proposed reorganization and of the time and; place for hearing protests or objections to said reorganization has been pub- lished, posted, and mailed in the time, form, and manner required by law; and WHEREAS, said hearing duly held by the Council at said time and place for the hearing of all objections to said proposed reorganization; and WHEREAS, protests or objections in writing to said reorganization delivered to the Clerk of the City of Fresno up to the hour,' set for hearing thereof were considered and said protests or objections in writing ,acre on file and of record " Facie l of 4 m�Aft in the office of the Clerk of the City of Fresno, County of Fresno, State of California, and all persons who desired to be heard were heard; and WHEREAS, at said hearing and prior to consideration of protests, Fresno Local Agency Formation Commission's resolution making determinations was pre- sented and summarized to the Council and WHEREAS, the Council considered all factors required by law for a proposed reorganization and considered all testimony, protests and all evidence presented ,with respect thereto: and WHEREAS, the Council determines the proposed reorganization constitutes' uninhabited territory as defined. by law and: written 'pretests filed and not withdrawn represented less than fifty percent (50%) of the assessed value of land therein and WHEREAS, pursuant to Fresno Local Municipal Code Section 2-208 the subject territory is allocated to the Bullard Council District too. 2. 110W, THEREFORE, the Council of the City of Fresno resolves and orders: 1. The territory within those boundaries described in Exhibit "A", consist- ing of 342 acres, attached hereto and incorporated herein and more particularly depicted upon the map marked Exhibit "Bfe a.ttach:ed hereto and incorporated herein:, is hereby annexed to the 'City of Fresno and the same territory is hereby detached from. the North Central Fire Protection District of Fresno County.` 2 The 155 acres of the subject territory to be annexed to the Fresno Metropolitan Flood Control. District are described in Exhibit "C" attached hereto and more particularly depicted upon the map marked Exhibit "W' attached hereto and incorporated herein. S. it will be to the best interest of said territory to annex the same or detach the same, as the case may be and that Lands have not been improperly omitted from or included within said proposed annexation: and detachment: 4 The reasons for this proposed reorganization areas follows a. The subject territory is within the City of Fresno's Sphere :of Influence b. Several property owners within the area have expressed a desire to ,annex to the City. c . The consolidation of the subject area into one °detachment- annexation project is beneficial to the affected governmental processes and the resultant City and District boundaries d. That the proposed reorganization requires the annexation of Page 2 of 4 4 A certain territory to the City of Fresno, the Fresno Metro- politan Flood Control District;, and the: detachment of the same territory from the North Central Fare Protection District, 4. The conditions .imposed by the Fresno Local Agency Formation Commission for the subject territory have been met, such conditions being: The City of Fresno shall make provision acceptable to the Fresno Local Agency Formation Commission for acquisition or transfer of property, structure', facilities, and equipment of the North Central Fire Protection District station at .Shaw and Brawley .Avenues and: for transfer of District employees employed at this station to the city of Fresno Fire Department; the City of Fresno shall agree to the provision of the means" to alleviateany school district overcrowding from future development in the area, and the City and school district staff shall also meet to discuss an agreement to provide City and, school district recreation programs in the subject areaF and: a revised map and description, shall be submitted to the Executive officer for approval which shall include the following properties: APN 311- 10-7g,- 8,,--12,--16,-1.4,-15, 17,-181 433-040-8,-9,�-1,r-5,-ll,-l2,-l3 and adjacent read right-of-way. 5. That as stated in LAPCO Resolution' No. RQ-78--44-A the City has complied with the specified condition in LAFCO Resolution No. R4-�78-44, such condition being `The City of Fresno shall make provision acceptable to the Fresno Local. Agency Formation Commission for acquisition or transfer of property, structures facilities, and equipment of the North Cen- tral Fire Protection District station at Shaw and Brawley ,Avenues and for transfer of District employees employed at this station to the City of Fresno Fire Department with full employment contracts, civil service seniority, retirement rights and other employee bene- fits and. rights. Representatives of the City of Fresno and North Central Fire Protection District shall meet and report back to the Local Agrency Formation. Commission at their meeting on May 25, 1979, on the alcove matters, This report shall be submitted in, written form to the office of the Commission with sufficient time to be reviewed by the Executive Officer and shall be reviewed and approved by the Commission prior to any further proceedings for the subject reorganizations' Such findings regarding the Commission's condition revealed that the City made a report to the Commission, on May 25, 1979, and on that same day the Commission dial receive testimony from the official of the North Central, Fire Protection Page 3 of 4 .. a District indicating his satisfaction with the negotiations thus far and that further meetings and negotiations would be necessary. The City of Fresno did indicate that the City would continue to meet with the district in order to achieve an agreement of employee transfer from the district Shaw, -Frawley station. The Local Agency Formation Commission accepted the report of the City of Fresno and determined that the above condition of Ashlan--Valentine No, 3 was substan- tially complied with and indicated their strong support of continued meetings and negotiations between the City of Fresno and North Central Fire Protection District in regard to this matter. 7. The Council adopted Ordinance No. 79-143 relating to the regulation of development in overcrowded school areas on August 21, 1979,:which provides interim relief for school districts where new dwelling construction has adversely affected the capability of providing school and classroom facilities, and promotes the general welfare of the public through the provision of a program to assist school districts in reducing the impact of new development, and such ordinance substantially complied with sections l and 2 of the condition contained in LAFCO Resolution No, R4-78-44-.A. 8, Written protests filed and not withdrawn represented less than fifty percent (50 d) of the assessed value of land therein., 9. The Clerk of the City of Fresno shall-imme&Lately cause to be trans- mitted to the Executive Officer of the Fresno Local Agency Formation Commission a certified copy of this resolution. Upon the filing of the appropriate docu- ments. by the said Executive officer in the manner prescribe: by law, the reor- ganization shall be completed. IT IS FURTHER RESOLVED, by the Council of the City of Fresno, that the subject territory designated as the Ashlan-Valentine No. 3 District Reorganization, described in said Exhibit "A." and depicted can said Exhibit "B", be and is hereby allocated to the. Griffith alignment, Motel Drive, and 7 Ashlan Avenues to the City of Fresno and Fresno Metropolitan S Flood Control District and detach ,from North Central Fire 3 Protection District in the County of Fresno; an 10 WHEREAS, an application for said proposalwas accepted for 11 tiling by the Executive Officer of this Local` Agency Formation 12 Commission pursuant to Title 6, Division 1, Part 2 of the 13 Government Code of the State of California- and 14 WHEREAS, said application was set` for hearing by the Executive 15 Officer on.the 28th day of March 1979, at the hour of 1 30 P.M. 16 of said day; and 1.7 WHEREAS, notice of the hearing of said application eras duly 18 given by mail, posting, and newspaper publication as required.by 19 law; and 1,10 WHEREAS the Executive Officer rev4ewed said application 21 and prepared a report, including his recommendations thereon, said 22 a,ppli.cation and report having been presented 'to and considered by 23 this Commission; and 2.4 WHEREAS, on March 28, 1979, such hearing was continued to 25 April 23 in order that the issues related to school district 26 overcrowding could be further explored and that the surrounding 7 property owners would have time to review this proposal and 28 WHEREAS, the Commission considered all relevant factors and 29' heard all interested parties wishing to speak on said application; 30 and 31. WHEREAS.. there was testimony and discussion regarding the 32 affect of the annexation on the Teague` Elementary School District COUNTY OF rRZNNO FREAII+ O, CALIFORNIA 1 and their ability to provide service to any new development, and 2 a recommended condition of staff regarding school district service:; 3 1 and 4 Tn1IiEREAS, there wasalso discussionregarding the recommended, 3 condition of staff that this annexation not be completed until after C completion of Shaw-Brawley #2, it being the opinion of the majority 7 of the Commission that such condition should xaot be required; and WHEREAS, the City of Fresno duly prepared and published a 9 negative declaration of environmental impact relative to the 14 project, and this Commission, has reviewed and considered said 11 negative declaration. 12 NOW, THEREFORE, BE IT RESOLVED that the Local: Agency Formation 3 Commission of the County of Fresno ;does HEREBY" RESOLVEr DETERMINEZ 14 AND ORDER as follows: 15 Section 1. Said proposal is approved subject to the terns 16 and conditions hereinafter specified.` Any resolution of the 17 conducting agency ordering this reorganization shall provide that 18 such reorganization shall be subject to the following terms and 19 conditions: 20 1. The City of Fresno shall make provision acceptable to the 21 Fresno Local Agency Formation Commission for acquisition or transfer 22 of property, structure, facilities, and.equipment of the North 23 lCentral Fire Protection. District station at Shaw and Frawley 24 ` Avenues and for transfer of District employees employed at this 25 station to the City of Fresno Fire Department with full employment 26 contracts,' civil service seniority, retirement rights and other 27 employee benefits and rights. Representatives of the City of 28 Fresno and north Central Fire Protection District: shall meet and 29 report back to the Local Agency Formation Commission at their 30 meeting on May 25, 1979 on the above matters.
