RESOLUTION NO - 4 2 0
RESOLUTION INITIATING PROCEEDINGS FOR. THE REORG,WIZATSON
OF THE CITY OF FRESNO AND THE MID VALLEY FIRE PROTECTION
DISTRICT, INVOLVING UNINHABITED TERRITORY" DESCR ABED HERE-
IN AND DESIGNATED AS THE PROPOSED ALLUVIAL-MILid3ROOK NO,
2-AA DISTRICT REORGANIZATION, SETTING THE TIME, DATE, AND
PLACE FOR HEARING PROTESTS THEREFORE, AND GIVING NOTICE
THEREOF
WHEREAS, proceedings fora proposed reorganization were commenced by the
City of Fresno pursuant to its Resolution of Application !Resolution No 79-198
adopted on May 15, 19 79 ; and -
WHEREAS, the Fresno Local Agency Formation Commission, on the 25th day of
July, 1979 met at the noticed time and place and considered all matters rele-
vant to the proposed reorganization and heard all persons interested therein,
and adopted, at the time and in the form and manner prescribed by law, its
Resolution No. RO-79-25, Making Determinations and Approving the Proposed
Alluvial-Millbrook No, 2-AA Distjict Reorganization, a copy of which is attached
hereto and identified: as _Exhibit "A"; and
WHEREAS, the Fresno County Assessor's Roll still be used for the purpose of,
levying any assessments or taxes on the subject property; and
WHEREAS, the subject territory proposed to be annexed totheCity of Fresno
shall be exempt from taxation for the payment of principal or interest, or any
other amounts whichshall become due on account of any outstanding 'bonded in-
debtedness incurred by the City prior to the effective date of such. annexation.
Upon completion of the reorganization proceedings for this proposal the subject

territory will be included in Municipal Bond Area "D" and will not be taxed for
any existing bonded indebtedness or contractual obligation.
NOW, THEREFORE, BE IT PESOLVED, DETERMINED, AND ORDERED by the Council of
the City of Fresno, as follows p
1.. Proceedings are hereby initiated for the proposed Alluvial-Mil.lbrook
No. 2--AA District Reorganization, as described in atta::fted Exhibit "B",
and graphically depicted upon the map marked. Exhibit "C", wherein. the
City of Fresno and the Mid. Valley Fire Protection District are each sub-
ject to a change of organization..
2e All of the subject territory affected is within the County of Fresno,
Ss For the purpose of the proposed reorganization, the subject territory
is found to be uninhabited
4 The reasons for this proposed reorganization are as follows

a.. Annexation of the subject territory to the City of Fresno
will result in improved land use planning. All private develop-
` ment controls of the City will apply following annexation.
b. The subject. territory is within the City of Fresno's Sphere
I

of Influence.
c A property owner within the area has expressed a desire to
annex to the City.
f d. The consolidation of the subject area into one detachment-
i
annexation project is beneficial to the affected` governmental
process and the resultant City and District boundaries.
5. The proposed reorganization requires the annexation of certain terri-
tory to the City of Fresno and the detachment of same territory from the
Mid. valley Fire Protection District
6 %hat such reorganization was made subject to conditions imposed by
the Fresno Local Agency Formation Commission; namely.
a. Prior to aly further proceedings by the conducting agency, a
revised map and description shall be ,submitted to the Executive
Officer for approval. The 'approved revised map and description
shall incorporate the revisions and corrections noted in the County
Assessor's letter of June 21 1979.
7 That the Conditions of Approval imposed by the Fresno ' Local Agency
Formation CommissLon, as indicated in Item No, 6 above,, has been complied
with by the City of Fresno.
8. November 6.1 19 79 , at the hour of 2 :00 p.m., in the Council. Chamber,
City :Hall., 2326 Fresno Street, Fresno.. California, a date not less than
fifteen days nor more than sixty days after the date of adoption of this
resolution, is hereby established as the time, date, and place of hearing
on the proposed reorganization. At this time and pl.a;ce any interested
person desiring, to protest said reorganization shall do so by written
communication filed with the Clerk of the City of Fresno no Later than
the hour set .for hearing. A written protest by a landowner shall contain
a description sufficient to identify the land owned by him.
9. The Clerk. of the City of Fresno shall give noticeof such hearing
once a week for two successive weeks in a newspaper of general, ciroulation
within the affected. District, City, and County; said publication to be com-
menced at least fifteen days prior to the date specified herein for hearing

with at least five days intervening between the respective publi-
cation dates not counting such publication dates:
10 . The Clerk shall further cause a, copy of this resolution to be
postedon or near the door of the meeting place of the Council; said
posting to be commenced at least fifteen days prior tc: the date spe-
cified herein for hearing and continue to the time of said hearing.
11 The Clerk shall further cause notice to be mailed to each person
awning land within, the subject territory as shown on the last equa-
lized assessment roll, at the address shown upon such assessment roll,
and to all persons and affected cities or districts, if any, which have
filed a written 'request for such notice. This mailing shall be by first
clans mail* postage prepaid, at least fifteen days prior to the day spe-
cified herein for the hearing.
12.. The Clerk shall be hereby instructed' to fomard a copy of this reso-
lution to the Executive Officer of the Fresno Local Agency Formation Com-
mission..

2, REORGANIZATION FORMATION COMMISSION
4 WHEREAS, preliminary proceedings were initiated by the City of
5 Fresno to annex territory generally .located southeast of Alluvial
5 and. M.111brook Avenues to the City of Fresno and detach from Mid-
7 Valley Fire Protection District in the Colan-ty of Fresno; and
WHEREAS, an application for said propo.aal was accepted for
9 filing by the Executive Officer of this Local Agency Formation
10 Commission pursuant to Title 6, -Division-If, Part 2 of the
11 Government Code of the State of California- - and
12 WHEREAS, said application. was ,set for hearing by the Executive
13 officer on the 25th day of July 1979, at the hour of Z 2n P.M.
14 of said day; and
15 WHEREAS, notice of the hearing of said application was duly
16 given by mail, posting, and newspaper publication as required by
17 law; and
1.8 WHEREAS, the Executive Officer reviewed said application and
19 prepared a report, including his recommendations thereon, said
20 application and report having been presentee, to and considered by
'1 this Commission, and
22 WHEREAS, this Commission considered all relevant factors and
23 heard all interested 'parties wishing to speak on said application:
24 and
25 WHEREAS, the Commission has reviewed and considered the
26 information in the negative declaration as provided in the Executive
27 officer's Report and duly prepared and filed by the City of Fresno.

31 Section. 1.. Said proposal is approved subject to the term

agency and the governing body of said agency is hereby directed

to initiate reorganization proceedings in compliance with this

resolution,

Section 4 Further proceedings shall be initiated, conducted,

and completed pursuant to required law. Proceedings and any
16
resolution of approval shall comply with the Commission's resolution
19
of approval.
20
Section 5 The Executive Officer is hereby authorized and
21
directed to mail certified copies of this resolution as provided
22
in Section 56272 of the Government Code.
23
Section 6. Further _proceedings shall be initiated by the
24
conducting agency not later than thirty five days after the date of
25
adoption of the Commission resolution, and shall be conducted and
6
completed pursuant to required law. Proceedings and any resolution
27
of approval shall comply with the Commission's resolution of
28
approval.

Consisting of Let 70 and portion of Lots 49, 50 and 69 of Amended Perrin Colony
No.2, and portion of Section 35, T.12-S.: R.20E., MUBsM.
BEGINNING at the intersection of the Westerly production of the Sleuth line of
Lot 69 of Amended Perrin Colony No.2, filed in the Office of they County Recorder
April 1 1891 and recorded in Volume 4 of Plats at Page 68, Fresno County Records,
with the East line of Section 34 Township 12 South, Range ' 20 East, Mount Diable
