O 9 - 41 RESOLUTION OF THE COUNCIL OF THE CITY OF FRE8NO APPLYING TO THE FRESNO COUNTY LOCAL AGENCY FORS MATION COMMISSION IN THE MATTER OF THE PROPOSED GETTYSBURG-TEILMAN NO. 2 ANNEXATION r INCLUDING THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 30.47 ACRES TO THE CITY OF FRESNO WHEREAS, pursuant to the Municipal organization Act. of 1977,, beginning with Section 35000 of the Government Code, the Council desires to annex the hereinafter described; ,territory to the City of Fresno in order to promote the logical formation and determination of City boundaries and to encourage orderly growth and development which are essential to the social, fiscal, and economic well --being of the City; and WHEREAS, the territory herein proposed: to be annexed % designated the Gettysburg--Teilman No. 2 Annexation and consists of that real property situated in the Coyxnty of Fresno,, State of California, -the boundaries of which are de- scribed in the attached .Exhibit "A'" and graphically depicted upon the map marked Exhibit "B", and by these references made a part of this resolution; and WHEREAS, by notice of Exemption No. 2498 said annexation project was deter- mined to be categorically exempt from the preparation of environmental documents; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has-been prepared and said service plan is attached hereto as Exhibit "C",. and by this reference made part of this resolution; and WHEREAS, the: Council finds that the territory contaiyied in the proposal 1 Does not exceed 100 acres in area and such territory con- stitutes the entire unincorporated territory substa.ntia.11y surrounded by the City 2. Was substantially surrounded by ,the City of Fresno, which is proposing the annexation, as of ' January 1, 198 3. Is substantially developed; 4. DATEt Ar,r�u Z SCAIEs� • rpo' - GETTYSBUEG--TEILMAN NO. 2 ANNEXATION SERVICE PLAN October 30, 1970 This service plan is prepared in accordance with the requirements of Government j� Code Section 35102. Each major service subject is discussed based on existing k conditions and adopted City plans and policies. The purpose of this document I is to provide information regarding the availability of municipal services and how they will be provided to the subject territory should annexation to the E City occur. Any required modification, expansion, or extension to existing facilities in order to serve the subject territory will be discussed based on applicable City ordinances. Where appropriate the financing and placement of j services and facilities will also be discussed. I� Summary, y I I t The proposed Gettysburg-Teilman No. 2 Annexation consists of the annexation of 30.47 acres to the City of Fresno and subsequent detachment of the same area: E from the. North Central Fire ProtectionDistrict.. This County unincorporated substantially surrounded island is located southeast of the intersection of West Gettysburg and North Teilman Avenues. The subject territory may be con- sidered entirely developed. The predominant land use consists of single family residences with the exception of four interior block vacant parcels that possess no road frontage. The area is zoned R 1-B. ApproximatelLy 10.13 acres of the territory is within the boundaries of County Waterworks District No. 7with the remainder of the territory receiving City water service. Sewer The subject territory is served by the City of Fresno sanitary sewer system. No modifications _will be required to continue' to provide the present level of service. upon annexation themonthly residential sewer service rate of $2.40 will apply with a savings of $1.20 per month per residence} Water County Waterworks District No. 7 provides service to that portion of the project area (10.13 acres) bounded by West Gettysburg, North Del.mo, West Indianapolis and North Teilman Avenues. The remainder of the territory is served by the City of Fresno Water System. The costs of water service: provided by County Waterworks District No. 7 will not be affected by annexation. However,; it does not meet the City of Fresno minimum fire flow water characteristics standards. Eight City Water System steamer type fire hydrants are situated on the north and west perimeter roads surrounding the proposed annexation area, and two steamer hydrants are located on Swift 'Avenue in close proximity to the southern boundary of the subject territory. To the east of the subject area, three County Water- works District No. 2 wharf type fire hydrants exist on Test Indianapolis$ West Holland, and West Swift Avenues midway between forth Fruit Avenue and North Arthur Avenue (see water service map within the.LAFCo Application). Upon annexation the City will have no fire hydrant or fire flow water characteristics responsibilities for 'that portion of the subject territory situated within the County Waterworks District No. 7 area of responsibility. Fire Protection The subject territory is presently receiving fire protection services from the North Central Fire Protection District. First due response is from North Central Station No. 7 located on West Bullard Avenue between Fruit and West. Avenues. This station is located approximately 1.9 miles from the nearest paint of the subject territory and 2 1/'4 miles from the farthest point. Upon annexation the area will receive City fire protection services. First due response will be ;provided by Fire Station No. 9 located on North West Avenue near Shields Avenue. This station, is situated approximately 1 1/2 miles from the nearest point of the ,subject territory and 1..8 miles from the farthest point. Paramedic The North Central Fire Protection District provides paramedic services from its Station No. 7= Upon annexation the City vir].1 provide the services from City Station No. 5 Police Protection f The subject territory is presently being served by the Fresno County Sheriff's Department and the California Highway Patrol: Upon annexation City police pro- F tection will be g :provided at the same level as the service now ben provided within. the City's incorporated area. j Street Swe2Rng l Monthly street sweeping services will be provided to the subject territory upon j annexation conditioned upon the installation of permanent pavement, concrete curbs and gutters. Ultimately, City standards will require the installation of thirteen 7.4 Pratt high pressure sodium (HPS) street lights for interior street lighting.. The.City will assume all energy and maintenance costs for street lighting. There are no traffic signals within the project area and .none are planned.. The long term effects of Proposition 13 on the provision of these services are unknown at this time, Traffic Engineering/Street .Improvements No modifications to the existing conditions are planned. The subject territory is completely developed with all streets at their planned widths. Installation of concrete curbs, gutters and sidewalks.is not required. Transit Fresno Transit Route No. 24 presently serves the subject territory. This north/ sonth route, provides .service at 30-minute intervals between Thorne and Dyer Avenues in North Fresno and the Doatantown Mall via Fruit Avenue. Handy Ride services will continue to be provided to qualified residents and will not be -affected by the annexation. Solid Waste Disposal The residents/property owners within the subject area are receiving private solid waste disposal services. Upon annexation City waste disposal services will become available to the residents/ property owners within the subject area. State law provides that private solid waste disposal services may continue for a period of up to five years from the date an area is annexed to the City pro- viding these services meet conditions 1 through S below, otherwise, services must be obtained from the City's Waste Disposal Division. In any event, conver- sion to the City Waste Disposal Services must occur within.f ve years of the date of annexation.. 1. The company must bane been licensed by the County of Fresno for a minimum of three years. This includes. Cannon Disposal Service= Browning -Ferris Industries of California, Fresno Roll -Off Service, and Thrifty Best Rubbish Service. 2., A customer cannot change from "one disposal company to another,only to the City's Waste Disposal Service 3. The quality and frequency of services of the private company must meet the standards required by the City of Fresno. S ps. -+•s:. . w • y -4- Parks and Recreation The Parks and Recreation needs of the proposed area of annexation are adequately met with existing facilities. Day -to --day playf,eld needs and neighborhood park needs of the area are met through the use of Quigley Park facilities The regional pare needs of the area are met through the use of Woodward Park or Roedng Park facilities, while the community recreation center needs of the area will be met when the Department's standard of one center per neighborhood park area is meta The Department plans to address the community ;recreation center needs through the City's Capital improvement Program. Flood Control Flood control facilities, when constructed, will be provided by the Fresno Metro- politan Flood Control District which is responsible for all storm drainage facili- ties within the Fresno -Clovis Metropolitan Area. The subject territory fails within the District's °'DD" drainage zone which contains two ponding basins. One is located at North Thorne and East Holland Avenues while the other is located in the vicinity of North Thorne Avenue between the Santa Fe Railroad and Herndon Canal. however, no improvement district has been formed by the subject territory property owners to fund the transmission system necessary to transport storm runoff to these ponding basins. Animal Control There are no differences in the level of animal control services proved by the Society for the Prevention of Cruelty to Animals throughout the Fresno Metropolitan Area. - Utility Tax The City's 4.6 percent utility tax will be applicable to all natural gas, electricity, and telephone bills. The actual cost of such tax can be estimated by relating this tax rate to the current utility bills Property Tax With the passage of Proposition 13, City and County property taxes are identical. Thus, annexation to the City of Fresno will cause no property tax increase to the property owners.
