HomeMy WebLinkAboutResolution - City Council - 79-399 - 1979-09-11Ruth Pouf ter ._ d Bielicki RESOLUTION NO. 79-399 RESOLUTION INITIATING PROCEEDINGS FOR THE REORGANIZATION OF THE CITY OF FRESNO AND THE MID VALLEY FIRE PROTECTION DISTRICT., INVOLVING UNINHABITXD TERRITORY DESCRIBED HEREIN AND DESIGNATED AS THE PROPOSED MC KENZIE--WTL'LOW NtJ+ 2 DIS- TRICT REORGANIZATION, SETTING THE TIME, DATE, AND PLACE FOR HEARING PROTESTSTHERETO, AND GIVING NOTICE THEREOF WHEREAS, proceedings for a proposed reorganization were commenced by the City of Fresno pursuant to its Resolution of Application Resolution No. 78-416, adopted on October la, 1978 and WHEREAS, the Fresno Local Agency Formation Commission did on, the 24th day of January, 1979, meet at the noticed time and place to, consider all matters relevant to the proposed reorganization and to hear all persons interested therein, and WHEREAS, at the time and place fixed for hearing before said Fresno Local Agency Formation Commission, said Commission adopted its Resolution No. RO-78-32-A a copy of which is attached hereto and identified as Exhibit "A", making deter- mination and approving the proposed McKenzie -Willow No. 2 District Reorganization of the City of Fresno and the Mid Valley Fire Protection District on January 24, 1979, all at the time and in the form and manner as prescribed by law; and WHEREAS, such reorganization proposal was assigned the short term form designation of "McKenzie -Willow No 2", the boundaries of which are hereinafter more particularly described; and WHEREAS, the Fresno Local Agency Formation Commission on the 2nd day of f March, 1979, adopted its Resolution. No. RO--78-32-:B a copy of which is attached r hereto and identified as Exhibit "B", revised resolution: for McKenzie -Willow No. 2 District Reorganization of the City of ?rresno and the Mid Malley Fire Protection District', and WHEREAS, the Fresno county Assessores roll will be used for the purpose of levying any assessments or taxes on the subject property; and WHEREAS, the subject territory proposed to be annexed to the City of Fresno shall be exempt from taxation for the payment of principal or interest, or any other amounts which become due on account of any outstanding bonded indebtedness incurred by the City' prior to the effective date of such annexation upon comple- tion of the reorganization proceedings for this proposal the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual obligation. NOW, THEREFORE, BE IT RESOLVED, DBTERMINED AND ORDERED by the Council :of the ATPage I of 3 City of Fresno, as follows, 1. That proceedings be, and they are hereby, initiated for the proposed McKenzie -Willow No. 2 District Reorganization as described in attached Exhibit 'IC" and graphically depicted upon the map marked Exhibit "D", and incorp«rated herein as set forth in full by these references, wherein the City of Fresno and the Mid` Malley Fire Protection District are each subject to a change of organization 2. All of the subject territory affected is within the County of Fresno, 3. For the purpose of the proposed reorganization,the subject territory is found to be uninhabited, 4. That the reasons for this proposed reorganization are as follows; a. Annexation of the subject: territory to the City of Fresno will result in improved land use planning. All private development con- trols of the City, will apply following annexation. f' { b. The subject territory is within the City of Fresno's Sphere. of Influence. c. Signed water agreements consenting to annexation .have been recorded for eight of the eleven parcels. d.. The consolidation of the subject area into one detachment - annexation project is beneficial to the affected governmental processes and the resultant City and District boundaries, i e.. That the proposed reorganization requires the annexation.of certain territory to the City of Fresno and the detachment of same territory from the Mid Valley Fire Protection district. 5. That such reorganization shall. be subject to the conditions imposed by the Fresno Local Agency Formation Commission, namely, that the City of i Fresno and Mid: Valley Fire Protection District shall enter into a .fire protection agreement as shown in Exhibit B of the LAFCO Resolution herein designated Exhibit 11F311, and prior to any further proceedings by the conducting agency, a revised map and description shall be submitted to the Executive Officer for approval and shall be the houndaries approved by the Commission for the subject proposal and any further proceedings. The approved revised map and description shall incorporate the revisions and corrections noted, in the County Assessor's letter. 6. That the conditions of approval imposed by the Fresno Local Agency Formation Commission, as indicated in Item No. 5 abed, e, have been complied with by the City of Fresno. 7. That October 30; 1979, at the hour of 2s70 p_ry, in the Council Chamber, Page 2 of 3 4 • AML s City Nall, 2326 Fresno Street, Fresno, California, which date is not less than fifteen days nor more than sixty days after the date of adoption of this Reso- lution, be, and is hereby, established as the time date, and place of hearing on the proposed reorganization, at which time and place any interested person desiring to protest said reorganization shalldo so by written communication filed with the Clerk of the City of Fresno not Latex than the hour set for hearing. A written protest by a landowner shah. contain a description sufficient to identify the land owned by him. 8. That the Clerk of the City of Fresno shall give notice of .suer hearing once a week for two successive weeks in a newspaper of general. osculation within the affected District, City and County, said; publication to be commenced at least fifteen days prior to the date specified herein for hearing, with, at Least five days intervening between the respective publication dates not contang such publication dates. 9. That t:he Clerk shall further cause a copy of this Resolution to be posted on or near the door of the meeting place of the council_, said posting to be commenced at least fifteen days prior to the date specified herein for hearing and continue to the time of said hearing. 1.0. That the Clerk shall further cause notice to be mailed to each person to whom land is assessed, as shown on the last equalized assessment roll of the County, at the address shown upon such assessment roll and owning land within the subject territory and to all ocher affected cities or districts, if any, which I have filed a written request for such notice, said mailing to be by first cl.Mss mail, postage prepaid, at least fifteen days prior to the clay specified herein for hearing. 11. That the Clerk be, and is hereby, instructed to forward a copy of this Resolution to the Executive Officer of the Fresno Local, Agency Formation Commission. Said proposal is approved subject to the terms and conditions hereinafter specified, Any resolution of the conducting agency ordering this reorganization shall provide that such treorganization shall be subject to the following terms and condition • 1. The City of Fresno and the Mid. -Valley Fire Protection District shall enter into an agreement which shall provide that the nearest fire station of the two fire protects on entities would be requested to respond to any fire emergency within the area described on Exhibit A. Such fire protection agreement is to be similar to the existing agreement for paramedic emergency ,services between the two agencies. The agreement shall be prepared and available for review by the Executive Officer cf the Local Agency Formation Commission in time to be considered at the regular meeting of theLocal Agency Formation Commission on Feb..ruary28,197 r 2. FIRE PROTECTION DISTRICT a political subdivision of the State of California, hereinafter; designated: as "District." RECITALS A. The City and District declare that under certain circumstances it is in the public interest for territory detached from the District and annexed to ; the City to be provided supplem.enta:yy fire protection from. the District B. The City and District a.re desir6u.s of entering into an agreement, pursuant to the authority granted under Section 55632 of the California Government Code and Section 13050 et4 sect. of the California Health and Safety Cods. for District provision of supplementary fire protection. j I AGREEMENT In consideration of the above, it is mutually agreed and understood by and between the City and District and the City and.. (b) Subject Property" means all territory detached from the District and annexed to the City of Fresno on or after January 11 1979, and which lies outside a two-mile running distance from a City fire station and within a two --mile running distaace of a District fire station. Furnishing of Supplementary Fire Protection,, The District shall furnish fire protection services for all structure fires within or upon the Subject Property pursuant to the following provisions (a) The City shall request the District to furnish fire; protection services for all structure fires within or upon the Subject Property. Such request for fire protection service shall be made by the Chief of the Fresno City Fire Department or his duly authorized representative. (b) Upon such request, District shall furnish apparatus equipment or personnel, or any combination thereof, as may be required or available, (c) The District shal.? respond District's engine company Wn" ch is closest in distance to the site cf the structure fire and shall respond no other engine company. The District r shall not be responsible or liable for failure to furnish Lire protection service in the event the engine company which is closest in distance to the site of the structure fire is not available for response. ( ,) The first apparatus, equipment, and personnel to arrive at a fire incident shall initiate appropriate action- to contain, control, and ex=�.inguish the fire. The Officer -In Charge of the first arriving apparatus, equipment, and personnel: shall be in charge of the fire until he is relieved by an Officer of the Fresno City_Fire Department. The Officer -In --Charge of the first arriving apparatus shall cause to be reported to the Fresno City Fire Department all pertinent information about the conditions encountered at the fire incident. SECTION 8. Assignment. This Agreement- shall be binding on. the successors and assigns of the parties hereto, except that the District shall not assign this A.greement.without the prior written consent of City. SECTION 9. Termination of Agreement. This Agreement shall not apply, or shall cease to apply, to Subject Property, or any porti Dn thereof, when one of the following circumstances exist and one party has given the other party thirty (30) drays written notice: f (a) The Subject Property, or portion thereof, lies 4 within a two-mile running distance of a. City fire station; or i (b) The Subject Propertyf or portion thereof, lies within a two-mile running distance of a District fire station which has reduced the availability of apparatus, equipment, or personnel from the level existing at the time Subject Property, or portion thereof, was annexed to the City. SECTION 10. '' Administration. of. Agreement. This Agreement shall be administered through the mutual: agreement of the City and the District. SECTION 11.
