RESOLUTION NO. 79- 387
RESOLUTION ORDERING CHANGES AND MODIFICATIONS
TO WORK AND ORDERING CORRESPONDING CREDITS
AGAINST INDIVIDUAL ASSESSMENTS ON PARCELS
AFFECTED BY DELETION OF WORK
ASSESSMENT DISTRICT NO 79
RESOLVED, ` by the Council of the City of Fresno, that
WHEREAS, the Council of the City of Fresno,. State. of
California, did on March 20, 1979,.adopt its Resolution of Intention
No. 79-116 relating to certain proposed work, acquisitions and im-
provements to be done and made in an Assessment District designated
"City of Fresno Assessment District No. 79" described in said Resolution
of Intention., under and pursuant to the provisions of Article 20,
Chapter 15, of the Municipal. Code of the City of Fresno, which said
Resolution of Intention providedthat serial bonds would be issued
in the manner provided by Bond Plan B, Article 24, of Chapter 15 of
said Municipal Code, reference to said Resolution of intention being
hereby expressly made for all further particulars relating thereof;
and
WHEREAS, an assessment and diagram were duly made and filed
with said Council and after hearing, duly noticed and held, said
assessment as modified and said diagram were confirmed and approved
by Resolution NO. 79-256, passed and adopted by Council on June 26,
1979; and
WHEREAS, said modified assessment and diagram were duly
recorded on June 26, 1979, in the office of the Director of Public
Works of said City and the assessment diagram and Notice of said
assessment were duly filed and recorded in the office of the Fresno
County Recorded on July 16, 1979; and
WHEREAS, said assessment as modified in the total amount
of $l, 091, 739. 68 was apportioned among the several subdivisions of
land in said District in proportion to the estimated benefits to be
received by such subdivisions, respectively, from said work and
improvements as shown in.`;said assessment to which reference is
hereby expressly made for further particulars, and
WHEREAS, charges for certain work and improvements as
heretofore ordered affecting hereinafter specified parcels of land
in said Assessment District were -changes in the improvements, thereby
reducing the total assessments in the sum of 1$681.21; and
WHEREAS, charges for certain work and improvements as
heretofore ordered affecting hereinafter specified parcels of land
in said Assessment District were increased at the written request
of property owners for improvements in the -sum of $2311. 06 thereby
resulting in an increase in the total assessments in said amount; and
WHEREAS, the assessment as hereby modified in the total amount
of $1,093,369.53 reflects all changes and all said changes are attached
as Exhibit "A" of this resolution; and
WHEREAS, credit upon the individual assessment theretofore
imposed upon any such such subdivisions of land should be granted
in the manner provided in. Section 10356'and 10427.1 of the Streets
and Highways Code of the State of California; and
WHEREAS, these changes and; modifications resu�t in reducing
certain individual assessments and increasing certain individual
assessments; and
WHEREAS, the Engineer of Work has reported on: all of said
,changes and modifications being
, g proposed credits or increases; and
WHEREAS, such changes and modifications provided for herein
are reductions or increases to individual, assessments, and as to said
reductions the Engineer of Work has recommended that, as to the work,
if any, to be done which.is the responsibility of the City under
current City policy and procedure and was erroneously charges to said
individual assessments, no increase in contribution is required from
the City as there is.a sufficient amount in: the contingency fund portion
of City's contribution to meet the cost of such: work.

WHEREAS, in the opinion of this Council, _the public interest,
convenience and necessity requires such changes and modifications.
NOW, THEREFORE, BE IT ORDERED AS FOLLOWS
1 That a reduction in assessment with respect to those
parcels or subdivisions of hand as hereinafter referred to be made
by credit upon individual assessments as set forth in Exhibit "A"
attached hereto to the following assessments:

2. That an increase in assessment be done with respect to
those parcels or subdivisions of land as hereinafter referred to be
made by charges upon individual assessments as set forth in Exhibit "A"
attached hereto to the following assessments:

3. That a certain assessment be divided according to a
parcel split as recorded in :Parcel Map 78-88 as shown in Exhibit
"A" attached hereto to the following assessment,

4. That the Engineer's Report shall be modified as provided
herein, and such modifications be, and they are hereby, approved.
5. That the City Treasurer is hereby directed to record
on the assessment roll the credits and charges as hereinabove determined
to be given to the individual assessments on each parcel as herein
specified and to apply said credits and charges in the manner provided
in Section 10427.1 of the Streets and Highways Code of the State of
California
