All of the subject territory affected.is within the County of Fresno. 3. For the purpose of the proposed reorganization, the subject territory is found to be uninhabited. 4. That the reasons for this proposed reorganization are as follows: a. Annexation of the subject.territory to the City of Fresno will result in improved Land use planning. All private development controls of the City will apply following annexation, including the,UGM process. b. The subject territory is within the City of Fresno's Sphere of Influence c. Four property owners within the area have expressed a desire to annex to the City. d. The consolidation of the subject area into one detachment -annexation project is beneficial to the affected governmental processes and the resultant City and District boundaries. e. That the proposed reorganization requires the annexation of certain territory to the City of Fresno and the detachment of same territory from the Mid Valley Fire Protection District, 5-. That such reorganization shall be subject to the condition imposed by the Fresno Local Agency Formation Commission namely, that prior to any further proceed-- ings by the conducting agency a revised map and description shall be submitted to the Executive Officer for approval and shall be the boundaries approved by the Commission: for the subject proposal and any further proceedings. The approved, revised map and description shall incorporate the revisions and corrections noted in the County Assessor's letter of June 19, 1979 6. That the condition of approval imposed by the Fresno Local Agency Formation Commission, as indicated in Item No.5 above, has been complied with by the City of Fresno. 7. That October 16, 1979, at the hour of 2:05 p.m., in the Council Chamber, City Hall, 2326 Fresno Street, Fresno, California., which date is not less than fifteen days nor more than sixty days after the date of adoption of this Resolu- tion, be, and is hereby, established as the time, dater and place of hearing on the proposed reorganization, at which time and place any interested person desiring to protest said reorganization shall do so by written communication filed with. the Clerk of the City of Fresno not later than the hour set for hearing. RO-79-23 _ MAXING DETERMINATION P,,��DEM RESOLUTION OF THE � PROPOSED "ALLUVIAL-�1"' FR,ESNO LOCAL AGENCY CITY OF FREE 0 2 REORGANIZATION FORMATION COMMISSION 3' _ 4 WHEREAS, preliminary proceedings -were initiated by the City of 5 Fresno to annex territory located generally north and east of 6 Alluvial and Millbrook .Avenues extending eastward to Maple Avenue 7 to the City of Fresno and detach from Mid -Walley Fire Protection District in the County of Fresno; and 9 WHEREAS, an application for said proposal was accepted for 10 filing by the ,Executive Officer of this Local .Agency Formation 11 Commissionpursuant to Title & Division 1, Part 2 of the i 12 Government Code of the State of California; and 13 WHEREAS, said application was set for hearing by the Executive 14 Officer on the 25th day of July 1979, at the hour of 2 40 P.M. of 15 said day; and 16 WHEREAS, notice of the hearing of said application was duly 17 given by mail, posting, and newspaper publication as required by 18 law; and 19 WHEREAS, the Executive Officer reviewed said application and 20 prepared a report, including his recommendations thereon, said 2Z application and report having been presented to and considered by 22 this Commission; and - 23 WHEREAS, this Commission considered all relevant factors and 24 heard all interested parties wishing to speak on said application; 25 and j� ! 25 WHEREAS, the Commission has reviewed. and considered the 5 t 27 information in the Negative Declaration as provided in the Executive 28 Officer's Report and duly prepared and filed by the City of Fresno 29 F Local Agency Formation NOW., THER,E., ORE, BE IT RESOLVED that the �. Said proposal is approved subject to the terms and 2 conditions hereinafter specified. Any resolution of the conducting 3 agency ordering this reorganization shall provide that such reorganization shall be subject to the following terms and 5 conditions: 6 1. Prior to any further proceedings by the conducting agency, 7 a revised map and description shall be submitted to the Executive 8 Officer for approval and shall be the boundaries approved by the 9 Commission for the subject proposal and any further proceedings. 10 The approved revised map and description shall incorporate the 11 revisions and corrections noted in the County ,Assessor's letter of 12 June 19, 1979 13 Section 2 Said territory is found to be uninhabited and is 14 assigned the following distinctive short form designation. 15 Alluvial --Cedar #�.. 16 Section ° 3. The City of Fresno is designated as the conducting 17 agency and the governing body of said agency is hereby directed 18 to initiate reorganization proceedings in compliance with this 19 resolution. 20 Section 4. Further proceedings shall be initiated, conducted 21 and completed pursuant to required law. Proceedings and any 22 resolution of approval. shall. comply with the Commission's resolution 23 of approval. 24 Section 5. The Executive Officer is hereby authorized and 25 directed to mail certified copies of this resolution as provided 25 in Section 5,6272 of the GovernmentCode. 27 Section. 6. Further proceedings shall be initiated by the 28 conducting agency not later than thirty five days after the date 29 of adoption of the Commission resolution, and shad be conducted 30 and completed pursuant to required law.
