HomeMy WebLinkAboutResolution - City Council - 79-361 - 1979-08-21City Attorney RESOLUTION NO %9- A RESOLUTION OF THE COUNCIL CITY OF FRESN0 REQUESTING THE LEAGUE OF CALIFORNIA CITIES TO PURSUE AMENDMENTS TO CHAPTER 4.7 OF DIVISION 1 OF TITLE 7 OF THE GOVERNMENT CODE RELATING TO DEVELOPMENT IN OVERCROWDED SCHOOL AREAS. WHEREAS, the City of Fresno has adopted and implemented a number of ordinances and resolutions which guide and control the expansion: of municipal and governmental service delivery systems in: the City's fringe area. and WHEREAS, the City of Fresno finds that proposed residential development in the City's fringe area may have a deleterious effect on the ability of school districts to provide school and classroom facilities for the residents of such proposed development; and WHEREAS, the City of Fresno finds that certain recent amendments to the Government Code have and will hinder the ability of the City of Fresno to respond to and alleviate the deleterious effects resulting from overcrowded school facilities. NOW., THEREFORE, the Council of the City of Fresno hereby resolves and formallyrequests the League of California Cities to vigorously pursue with the State Legislature the following amendments to the Government Code: 1. Section 65974 (d) of the Government Code should be amended in order; to delete all references to a ceiling on the maximum amount of fees which can be levied against a developer for construction and maintenance of temporary school facilities 2. Section 65981 of the Government Code, which requires the recommendation of fees by a school district must be submitted to the City with a certain time limit following the issuance of the initial permit for the development, should be repealed.
