HomeMy WebLinkAboutResolution - City Council - 79-357 - 1979-08-21Public Worfks RESOLUTION NO 79-357 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNOr CALIFORNIA,RELATING.TO THE CERTIFI- CATION OF CLEAR RIGHT OF WAY FOR NORTH EMERSON AVENUEMEDIAN ISLAND CONSTRUCTION AND STREET WIDENING BETWEEN NORTH HUGHES AVENUE AND NORTH WEST AVENUE AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE THE CERTIFICATE. WHEREAS, the Public Works Director is submitting to this Council. a Certificate reporting that sufficient right -of --way, exists for North Emerson Avenue Medan Island Construction and Street Widening Between North Hughes; Avenue and North West Avenue, which is required by the State Department of Transportation; and, WHEREAS, it i_s.recommended that the Public Works Director be authorized and directed to execute the Certificate for and on behalf of the City of Fresno; NOW, THEREFORE, THE "- OUNCIL OF THE CITY OF FRESNO RESOLVES that the Public Works Director of the City of Fresno, .Fresno County, California, be, and he is hereby authorized and directed L f to sign for and on behalf of the City of Fresno, the Certificate relating to right-of-way in connection with North Emerson Avenue' Median Island Construction and Street Widening Between North Hughes Avenue and North West .Avenue., CLERK'S, CERTIFICATION STATE OF CALIFORNIA COUNTY OF FRESNO } ss CITY OF FRESNO I, JACQUELINE L. COMPLIANCE WITH RELOCATION ADVISORY ASSISTANCE AND PAYMENTS PROVISIONS OF FEDERAL AND STATE LAW Compliance with the provisions of PB14-81-1 was not required for this project. The City of Fresno agrees to hold the State of California harmless for any liability which may result in the event the right-of-way is not clear as certified.
