n Z RESOLUTION NO A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO ESTABLISHING RULES FOR THE -APPLICATION OF CITY EMPLOYEE COMPENSATION RATES AND SCHEDULES AND RELATED REQUIREMENTS r AND ESTABLISHING COM- PENSATION RATES AND SCHEDULES. RESOLVED;. by the Council of the City of Fresno, as follows SECTION 1. The rules set forth in this resolution constitute special provisions applicable to all classes of employment in the City service except those classes the Compensation of which is fixed pursuant to the second paragraph of Section 809 of the Fresno City Charter; provided, however, that if any provision`of a Memorandum of Understanding consummated: and approved by the Council. under Article 19 , Chapter 2 of the Fresno Municipal Code and, currently in effect is clearlya.nd specifically in conflict with any rule contained in this resolution, the provision in such Memorandum of Understanding shall prevail. SECTION 2. SALARY STEP PLAN The step plan of each salary ranee shall be applied and interpreted as flows for permanent' and probationary employees; a. The first Step shall be the minimum rate -and shall normally be the hiring rate: for the class. In a case where it is difficult to secure a qualified person or if a person of unusual qualifications is engaged, the Chief Administrative officer, after receiving the recommendation. of the Director of Personnel, may approve appointment above the first step. b. The second step shall be paid upon the completion of six months of paid status at the first step. c . The third step shall be paid upon completion of one year of paid status at the second step d. The fourth step shall be paid upon completion of one year of paid status at the third step. e . The fifth step shall be paid upon completion Of one year of paid status at.the fourth step, f . Raises to the second), third, fourth', and fifth steps shall be automatic unless an unsatisfActo y service rating report is made by the appointing authority. Fol- lowing an unsatisfactory service rating report, - a raise maybe delayed by the appointing authority for not mode than six months and more than six months only with ap- proval of the Chief Admini-strative Officer. A raise to any step may made at any time by the Chief Administrative officer on' recommendation of the appointing authority and PASSED Cq EFFECTIVE ! the Director of Personnel whenever an employee exhibits unusual merit. In the case of permanent``part-time em- ployees, 1,040 hours of service shall equal six `months of service and 2,08E hours of service shall equal one year of service g. An employee who is selected to fill a reclassi- fied position pursuant. to FMC Section 2µ ,607 (b)or who is promoted from one class to another having a higher salary range shall be adjusted to the lowest step in the salary range of the new class which is at least 3-1/°2%' higher than the rate received in the e.mployee's'former class, except when such increase would require a payment greater than Step E in which event Step E shall be paid An employee who is paid an hourly rate determined under the second paragraph of Section 009 of the Charter and who is promoted to a class having a salary range shall be adjusted in accordance with the foregoing provisions to the nearest step in the new class range after adding five percent to the employee's average monthly earnings'. Average monthly earnings are to be computed by multiply- ing the hourly rate, including the vacation fund,if any, by 161-1/3 hours, for employees in classes. listed in Group A below; and by 162 hours for employees in Group B below. When a class is assigned a new salary range, the salary of an employee in such class shall be adjusted to the same relative step in the new salary range, and: such adjustment shall not alter the employee's anniversary date i. A permanent employee, filling a position in a higher class on a temporary basis and who is entitled to the rate of pay for such higher class, shall be' paid in the same manner as provided for promotion in subsection "g" above - 2 .. AWOL j. If an employee is receiving compensation above the fifth step of the range for his class,- his present rate shall be continued as an approved additional step rate for the class but no other employee may be adjusted to this rate and it shall no longer be in effect after the termination of the employment in that class of the incumbent in whose behalf it is authorized. k,. Step increases shall become effective on the first day of the pay period following the date of completion of required service, provided that, if such date,is the first' day of the pay period, the adjustment shall be effective on such first day. For purposes of this section, ,any em- ployee who is absent without pay for the number of hours specified below while on .any single step in a range shall not be considered to have been on paid: status for the number of pay periods shown and advancement to the next step; shall be delayed by such number of pay periods more than 0 hours, but less,than 43-1/3 hours, no delay- 43--1/ hours or more, but less than 10 hoursr 1 pay period; 130 hours or more, but less than 216--2/3 hours, 2 pay periods; 216--2,/3 hours or more, but less than 3.03-1/3 hours, 3 pay periods; 303-1/3 hours or more, but less than 390 hours, 4 pay periods; 390 hours or more, but less than 47.6-2/3 hours, 5 pay periods; 476-2/3 hours or more, the number of pay periods by which advancement�to the next step shall be delayed to be calculated in same manner as those specified. herein. Such delay shall `cause a change: in the employee's anniversary date, for purposes of future step increases in the class, to the first day of the pay period upon which such employee becomes eligible for a step increase. SECTION 3. Rates of compensation provided for by a reso� lution establishing or approving such compensation are fixed on the basis of dollars per month for -dull-time service in full- time positions unless otherwise 'clearly indicated. SECTIONA. ASTERISK JOB CLASSES Employees in classes listed in :any salary resolution or approved Memorandum of Under - standing which are marked with asterisks (*) shall not,� be en- titled to payment or equivalent compensatory time off for over time under the provisions of Section 2-1514 of the Fresno Municipal Code, regardless of the number of hours worked, except as provided. in subsections "a" and "b" of this section. a. Members of the Fire Department below the rank of Deputy Chief, whose classes bear an asterisk and who are required by the appointing authority to work extra full shifts during emergency conditions or when necessary to maintain thelevel of manpower upto minimum: manning standards, shall: be entitled to equivalent time off, or may be compensated by cashpaymentin lieu of such time off, for such overtime work. _3� b. Employees in positions in classes in the Non - Supervisory -White Collar Unit who are exempt from cash payment for overtime worked as a result of employment in classes marked with asterisks, as provided above,shall, be entitled to compensating time off, on an hour -for --hour basis, for overtime' worked, provided that the working of such overtime was approved in advance by the employee's department head, or his designated representative, and provided that no such employee shall receive any credit for such overtime worked if the crediting thereof would result in such employee's having a balance of , such ,deave in excess of forty hours. SECTION 5. ANTI -COMPACTION PAY Every employee who holds a permanent appointment to a position in a class with a salary range and who is in direct line of supervision above one or more employees holding permanent or provisional appointments, com- pensation for which is fixed pursuant to the second paragraph of Section 80.9 of the Charter; shall be paid the greater of (1) salary to which the employee is ordinarily entitled, or (2) a salary five percent above the average monthly earnings of the highest paid employee immediately beneath him in said direct line of supervision. "Average monthly earnings," as used in this section, shall mean the salary payable pursuant to this section or, as to any employee paid on an hourly basis, the employee's basic hourly rate of pay, including vacation fund, multiplied by the factor calculated by using the formula >pecified in subsection 'Ig"" of Section 2 above.A "direct line of supervision" exists where a class, as a wart of the established duties thereof, directs and is responsible to higher authority for the wore activities of a lower class. Each employee. action form establishing an employee's salary pursuant to (2) above; shall be accompanied by a written determination by the appointing authority, approved by the Chief Administrative Officer, of the facts render-- ng such employee eligible for such salary under this section. SECTION 6. PHYSICAL STANDARD Employees holding positions in classes ; listed .in any salary resolution or approved Memorandum of Understanding that are marked with a plus mark (+) as a part of the physical, standard designation shall., in addition to meet- ing all the requirements for the designated physical standard, meet any Group "A" heart and vascular standards. SECTION 7, MATRIX TABLE Whenever a salary is based on the matrix table, the pay range shall be determined as follows. the, first two numbers of the range number are in the left-hand col turn of the matrix and the last number is in the horizontal row of numbers above the line. The first step of a salary range is at the intersection of the respective row and column, attached to said numbers and each of the next succeeding steps appears in order immediately below the preceding step. -4- SECTION 8. Temporary and part-time employees shall be paid on the basis of the hourly equivalent of the monthly salary for Step .A of the class and, subject to the provi,s.ons of Section 4 above, shall be paid for the hours actually worked. SECTION 9. FLEXIBLE STAFFING An employee holding a per- manent appointment in a position in any class in a group of classes designated as flexibly staffed may be appointed to a higher class in that group providing the employee meets the minimum requirements and: upon the recommendation of the department head and successful. completion of a non --competitive qualifying examination 'without regard to the number of positions listed for that class in the position schedule of the current budget.- provided that the number of employees assigned to all classes in the group_ shall not exceed' the total number of positions for that ` group as authorized in the position schedule of the budget, and provided that, funds are avai,labl.e therefor in the department's salary 'budget. SECTION .its. �ADMINISTRATIVE LEAVE Employees permanently or provisionally appointed to positions in classes which are included in: the Management and Confidential. Group, who are not entitled to payment for or equivalent compensatory time off for overtime work, except; as they may be so entitled pursuant to sub- section "a" of Section 4 above, shall be granted administrative leave, which shall not exceed forty -.eight hours per year, . balance of forty-eight hours shall be credited to each such employee as of the first day of the first full pay period in July of each fiscal year. Upon their employment by the City, new employees or employees provisionally appointed in such positions shall be credited with four hours of administrative leave for each fell calendar month remaining in ,such appointment in the fiscal year. Leave not taken during the fiscal year in which it is credited shall not be added to the leave credited: in the next f i�cal year; nor shall any employee receive parient at any tive for any administrative leave not taken. Department heads are responsible for the granting of such leave 'within their departments, and such leave shall be scheduled, at the convenience of the department. Approval by the Chief Admin- i.strative Officer must be obtained before a department head may take such leave. Administrative leave as provided herein shall be .in lieu of any other system of administrative leave existing prior hereto. SECTION ll. COMPENSATION FOR UNUSED SICK LEAVE. Employees holding a permanent appointment in a class included in the Manage- meet and. Confidential group shall., at service retirement, be compensated for their unused sick leave balance in the following manner: the number of hours of accumulated sick leave in excess of 1,200 (2,000 for employees working a 24- hour shift) shall be multiplied by the ratio of the number of hours of sick leave accum.ul.ated in the 24-month period prior to retirement divided by the total number of hours of sick leave credited i:n that same period, which resulting number of hours shall be compensated at $2.00 for each hour. t i SECTION 12. RATES OF COMPENSATION The various classes of employement in the City service listed` in the following designated exhibits (each of which is hereby incorporated herein and made a parr hereof as if fully set forth herein) shall be compensated at the rates set forth therein apposite each class title. - EXHIBIT I -- designated Unit 1,, Nan -Supervisory Blue Collar EXHIBIT 2 - designated Group 2, Management and. SECTION 13. COMPENSATION FOR BOARD AND COMMISSION MEMBERS Members of boards and commissions shall be compensated for their services as follows: E05 Civil Service Board Member - $ 75.00 a month E02 Planning Commission Member - $150.00 a month E03 Housing & Community Development Commission. Member -- $150.00 a month EG4 Redevelopment Board. Member �- Not to exceed ;1 $150.00 a month B05 Fresno Citizen's Participation Commission Member $ 75.00 a month SECTION 14. OVERTIME FOR EMPLOYEES IN CLASS OF WASTE COL- LECTOR II AND WASTE COLLECTOR III Employees in. the classes of Waste Collector Il and. Waste. Collector III, except those employees on light duty status, shall be entitled' to compensation for over- time as provided in Section 2-1514 of the Fresno Municipal Code except that work performed on a holiday falling on a regular work day shall be compensated for at one and one --half times, and on a holiday falling on a regular dad off shall be compensated for at two and one-half tames the applicable hourly rate. -6.. * x SECTION 15. DEGREE AND CERTIFICATE PAY The fallowing rules prescribe the payment of additional.`pay"because of the acquisition of a degree, certificate, or similar qualification. a. Each employee who holds a permanent appointment, to a position in the class of Planner `IT' Planner 111, Assistant City Traffic Engineer, or Traffic Engineering Assistant who has received registration as a civil engineer, structural engineer, electrical_ engineer, traffic engineer, or architect by the State of California shall be paid at his sane step in the tenth range above the range prescribed fo- his class (or an additional 5 of base pay where the salary for the class is not on the matrix table. b. Each employee who holds a permanent appointment to a position in the class of Property Management Agent, or Assistant Property Management Agent who has been desig- nated as a member of the American Institute of Real Property Appraisers (M.A.I.) shall' be paid at h.i's same step in the tent: range above the range prescribed for his class (or an additional 5 of rase pay where the salary for the class is ' not on the matrix table) . c . Each', employee who holds a permanent appointment in the professional accounting series who has been licensed as a Certified Public Accountant by the State of California shall be paid at his sate step in the tenth range above the range prescribed: for his class (or an additional 5 Q of base pay where the salary for the class is not onthe matrix table) . d. Each employee who holds a permanent appointment to a position in the crass of waste Watery Treatment Plant Operator 11 who has received a state -issued Grade II or higher certificate shall be paid an additional twenty-six dollars per month. SECTION 16. EDUCATIONAL INCENTIVE PAY FOR POLICE LIEU- TENANTS AND CAPTAINS The following rules prescribe the payment of additional pay because of the acquisition of, or courses taken towards a degree by Police Lieutenants and Police Captains. a. Each Police Lieutenant and Police Captain who has been awarded a Bachelors degree in a field approved by the Chief of Police and the Chief Administrative Officer from an accredited institution of higher learning shall be paid 3% above his base salary.' R b. Each Police Lieutenant and Police Captain who has been awarded a Masters degree in a field approved by the Chief of Police and the Chief Administrative Officer from an accredited institution of higher Darning shall be paid 5% above his base salary. -7- c . Bach Police Lieutenant and Police Captain who shall enroll in an accredited college or university in a'fi.eld ap- proved by the Chief of Police and Chief Administrative Officer and who satisfactorily completed six semester units of graduate oN upper division courses per fiscal year, shall be paid an additional 2% above his base pay and Pay awarded for degrees held, ' provided that he receives at least a " °" grade for each unit completed prior to receipt of a Bachelors degree and at least a. "B" grade for each unit completedafter receipt of 'a Bachelors degree. Courses to which the City of Fresno ;sends the individual employee (on. City time and at City expense) shall not qualify towards the minimum of six units nor do classes taken on "pass -fail" or other non -alphabetic grading system,, unless expressly approved as to such,grading s item before course work begins. d. For pay awarded for degrees held to be paid, enroll- went'n such approved courses at an accredited institution must continue for two consecutive school years with a; minimum of six units satisfactorily completed each schoolyear. If such en- rollment is not satisfact©rily' maintained at any time during the two-year pier .odr all' educational pay shall be discontinued and the individual employee's base pay only shall be paid. At the end of the taro --year period., an individual can continue to qualify for the 2% plus the degree pay percentage incentive by continuing to complete six units per year of approved subjects. Should the individual not continue enrollment in an'`` institution of higher learning after the two-year qualifying period, he shall receive his base salary plus the educational incentive pay for any degree held. e. `upon promotion to a higher rank within this unit, an individual employee must enroll in an accredited institution of higher learning at the beginning of the ,next semester and re-enter the two --yeas qualifying cycle as described above to receive the above specified incentive pay; the degree pay shall continue. If the individual does not re --enroll in an accredited institution or does not complete a minimum of six units per school year with the above -specified grade average, his pay shall re-rert to the base salary with no pay awarded for any degree the individual may hold. SECTION 17. ASSIGNMENT PAY The following rules prescribe payment of additional pay for assignment to and performance of certain duties. The pay shall be.pro rata for time so assigned and worked a.. Each Zoo Attendant I and 11 assigned to duty` as an Animal Trainer shall be paid twenty dollars a month in addition'to his regular salary. b. Each .Light Equipment Operator assigned to operate the following pieces of equipment shall be paid at his same step in the twentieth range above the range prescribed for his class (or an additional 10% of base,pay where the salary for the class is not on the matrix table)'. Truck with booms. Heavy-duty, hydraulically operated in- dustrial tractor with 5/8 cubic yard front-end loader. Two --thousand gallon water truck while being used for tree watering along City streets. P. B. or 'similar type self -loading truck. Truck towing tandem wheeled trailer loaded with 540-gallon tree sprayer. c. Each sight Equipment Operator assigned to operate a combination backhoe and loader shall be paid at his same step in the thirtieth range above the range prescribed for his class (or an additional 15% of base pay where the salary for the class is not on the matrix table). d . Each: Waste Collector III who ' is required to drive a one-man truck or a 3-axle front and leader truck shall be paid an additional $2. bb for each shift in which, he operates such trucks. e. Each employee assigned to supervise a prison detail or utllityman (grant funded) detail shall be paid at his same step in the tenth range above the range prescribed for his class (or an additional 5% of base pay where the salary for the class is not on the matrix table) for each shift so as- signed and worked, subject to the following limitations and conditions; 1) "Detail .as used hereinabove means the performance of a specifically designated task in which two or more prisoners or two or more utilitymen constitute not less than fifty per- cent of those assigned to the detail, excluding the assigned supervisor. 2) The premium pay specified herei.n.above shall be paid only if the assignment is a significant addition to the employee's normal duties. f. Each Light Equipment operator and Equipment Operator while assigned to operate equipment in connection with new con- struction shall be paid the rates for Construction Equipment Operator. New construction means the original construction or replacement (involving complete removal and restoration as opposed to repair) of any structure, the work of which will require -g_ 3 1 't more than sixteen man hours of labor of the kind regularly performed by the class of Equipment Operator or Light Equip- ment Operator, as estimated by the division head; The term "structure" includes any buil.ding,`bleacher, or other playground facility, pipeline, underground sprinkler system, masonry_ or stone wall,' concrete slab or walk, animal retention; facility or road but shall not include landscaping facilities, such as planters or excavations made for planting or other horticultural purposes. "Replacement" means the removal and restoration to its original or equivalent condition of a complete unit or section of a. structurebut shall not i.n- clUde work which involves only minor work in its surface re- pair, repainting or reinforcement. Employees injured in the course and scope of City employment shall... be , paid their full wades "or salary during the time absent from work for such injury in accordance with the provisions of Fresno Municipal Code Section 2-1515. The term full wages or salary as used in Fresno "municipal Code Section 2-1515 shall be, deemed to be the rate of pay attached to his range and step in his permanent class. g. A. Communications Supervisor,' Radio Technician or Senior Radio Technician, while working on a pole at a height of seventy-five feet or more, or on a tower (but not during the erection` of tower) at a; height of one hundred feet or more shall receive double his normal hourly rate of pay for all such time worked at such: height. Thirty minutes or more of such work shall entitle him to such premium rate for one- half clay. He shall receive for work up to sixty feet in a tree one and 'one-half times his normal hourly rate, and for work above sixty feet, double his normal -hourly rate. h. Each Engineering inspector I whose assigned duties are of more than normal complexity or scrape in connection, with a specific project may be paid at his same step in the tenth range above the range prescribed for his class (or an additional 5% of base pay where the salary for the class is not on the matrix table), i. Each Police Officer assigned to duty as a motor- cycle officer and each officer in charge of the.junior Traffic Patrol shall be paid forty-nine dollars a month in addition to his regular salary when performing the duties of such. special assignment. j . Each Police Sergeant assigned to duty as a motor- cycle sergeant shall be paid fifty-three dollars a month in addition to his regular salary when performing the duties of such special assignment. k. Additional pay as specified in subsections "i" and 'T3 of this section shall be paid during periods of vacations -_10- • o e Each employee in the Fire Non -Management Unit shall receive the sum of $ per year for uniform purchase and maintenance. Such sum shall be prorated and added in equal amounts to each paycheck. - SECTION 21. COURT TIME Each member of the Non -Supervisory White Collar Unit who, in his or her capacity as an employee of the City, is required by subpoena'or by direction of a court, superior officer, City Attorney, or prosecuting attorney, to attend and does attend., during off -duty hours, any -deposition or court proceedtag as a witness, shall be allowed a minimum of two hours overtime red t regardless of the time actually in attendance. SECTION 22 CAFEBACK Each employee in the Non --Supervisory Blue Collar Unit who is called back to work outside of his regularly scheduled work shut shall, be paid a minimum of two hours at the overtime rate. SECTION 23. CAMP FRESNO In the event an employee in the.: Non -Supervisory Blue. Collar Unit is assigned to work'at Cramp Fresno or receives some other similar assignment, and during such assignment the City provides meals for the employeep the employee, at his option, may elect to receive a cash payment in ,lieu of receiving the 'meals of $10.00 per d.a.y. SECTION 24. In .any case where, by reason of unusual,, cir- cumstances rigid adherence to the foregoing rules would cause a manifest injustice, the Chief Administrative Officer, on recom- mendation of the appropriate appointing authority and the Director of Personnel, may make such order deviating therefrom. as ' is in his judgment proper to mitigate the injustice. SECTION 25. Resolution No. 77-298 all amendments thereto, and all resolutions or parts of resolutions in conflict with this resolution except as such resolutions or parts thereof approve a Memorandum of Understanding, are hereby repealed. SECTION 26. This Resolution shall take effect and be in force the first day of the first pay period following its adoption.
