HomeMy WebLinkAboutResolution - City Council - 79-342 - 1979-08-21Ruth Poulter Ed Bielick RESOLUTION NO. , 7 -- 3 4 2 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL AGENCY FORMATION COMMISSION IN TICS MATTER OF THE PROPOSED BROWNING-MAROA NO.1 DISTRICT RE- ORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRI- TORY CONSISTING OF 32.5 ACRES PRO14 THE MID VALLEY FIRE PROTECTION DISTRICT AND THE ANNEXATION OF SAID TERRITORY TO THE CITY OF FRESNO. WHEREAS, this proposal is made pursuant to the District Reorganization' Act of 1965 contained in Division 1 of Title 6 (commencing with Section 56000) of the California Government Code; and WHEREAS, the nature of the proposed change is a reorganization consisting of the detachment of certain territory consisting of 32.5'acres and hereinafter called the "subject territory" from the Mid Valley Fire Protectioil District and the annexation of the subject territory to the City of Fresno; and WHEREAS, no other.counties, cities, or districts are affected, and WHEREAS, the subject territory proposed to be detached from the Mid. Valley Fire Protection District and annexed to the City of Fresno is uninhabited, is described in Exhibit "A" and graphically depicted upon the map marked Exhibit "B", and by'these references made ,a part of this resolution; and WHEREAS, review and analysis of Environmental Assessment No. 2881 related to said district reorganization project, has resulted in a Negative Declaration by the Director of Planning and Inspection; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and said service plan is attached hereto as Exhibit "^", and by this reference made part of this resolution; and WHEREAS,, no new districts are proposed to be formed by this reorganization, and VHEREAS,othe Fresno County Assessors roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the exemption of all the subject territory proposed to be a annexed to the City of Fresno from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any Out- standing bonded indebtedness incurred by the City prior to the effective date- of such annexation, and upon completion of this reorganization proposal, the subject territory will be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual obligations; and Page 1 of 2 WHEREAS, the reasons for this ,proposed reorganization are stated as follows 1. Annexation of the subject territory to the City of ,Fresno will result in improved land use planning.. All private development controls of the City will apply following annexation. 2. The subject territory is within the City of Fresno's Sphere of Influence. 3. The consolidation of the subject area into one detachment annexation project is beneficial to the affected governmental processes and the resultant City and district boundaries. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby request that proceedings be taken by the Fresno Local Agency Formation Commission for the herein proposed Browning--Maroa No.l District Reorganization, including the detachment of the subject territory, consisting of 32.5 acres from the Mid galley Fire Protection District and the annexation of the same' territory to the City of Fresno. B.— Dr. by Jeff Horper gRQWNING -- MAROA No. I Checked by i • Sheet _ Of Drawing No. _ r� The proposed annexation area is presently served by Consolidated Fire District from the Fig Garden Station located at Wishon and Gettysburg. Upon annexation to the City, service would be providedl by Fresno City Fire Station No 11 located at North Fresno Street and East Wrenwood Lane, which is approximately 0.9 mile from the nearest point of the area and approximately 1.5 miles from the farthest point. This station is equipped with a pumper and a ladder truck. The ladder truck has paramedics as part of the crew. Backup support would be provided by Station No. 5 located at North Fresno Street and East Shields Avenue, approximately 3,3 miles from the nearest point of the proposed annexation and, approximately 3,.9 miles from the farthest point. This station has the same equipment and manpower capabilities as Station No. 11, Water and Hydrant Service The area is presently within County Waterworks District No. 25 at the section between West Browning and West Dovewood Lane. The remainder of the proposed annexation is within the Fresno City Water District,` Upon annexation to the City, the area would be required to provide hydrants and fire flow to meet Fresno City Fire Protection Standards. In single-family residential subdivisions the Fire Department requires that fire hydrants be installed in accordance with Fresno City specifications on no less than a minimum 6-inch water main capable of flowing 1-00 gallons per minute as calculated by using methods in Fire Flow Vests, published by the Insurance Services Office. This system may be incorporated with the domestic water system. Hydrants shall, be further than 600 feet apart. Analysis This proposed annexation should be of benefit to the area involved due to the close proximity of Station No. 11, which: provides paramedic service. Also, with the addition of Fresno Fire Department approved hydrants, the City would' provide a greater complement of fire fighting farce from the same station. Police Protection As illustrated on the enclosed map, Exhibit SP-21 the project area is presently receiving police protective service from the Fresno Sheriff's Department Upon completion of the annexation, the responsibility for providing police service will he immediately by the Fresno Police Department. The level of service provided to the project area will be the same as that provided to the neighboring service areas of the Fresno Police Department. Upon receipt of notification of pending annexations to or developments within the City of Fresno, the Police Department,immediately evaluates the impact such changes will have on service delivery. Any manpower deployment adjustments which may be necessary are then made. No specific problems are anticipated in providing police service to the proposed annexation of the project area. Streets The following information was provided by the City of Fresno, Public Works Department. I t Page 2 of 6 a Solid Waste I3isposal The subject territory is now being served by a private waste disposal company.. Upon annexation the City of Fresno will provide this service in accordance with. Section 35005 of the Government Code, Fart 2 Division 5, Chapter 2.7 section., 4272 of the Health' and Safety Code. Following the annexation, "Notice will be sent to private company that the area is annexed to the City and that the above mentioned Government Cade applies." All new customers will be served by the ,City; Street Sweeping There are no street sweeping services provided to the area at this time. City of Fresno will provide future street sweeping'. There are no provisions to govern any transition period. Transit The following information was provided by the Fresno City Department of Transportation.. 1. Fresno Transit currently operates a. Route No. 51 (Barstow Avenue Crosstown) east and west beyond the general limits of Maroa and Blackstone Avenues near the project area 14 hours per day Monday thru Friday with 30 minute headway. It does not .operate: on Saturday or Sunday since this route goes through the campus during weekdays and Barstow Avenue is closed through the college on weekends. Bus stop locations with improvements i) Eastbound - S f W cornea` Maroa -- stop SIB corner San Pablo - stop ii) Westbound. North side at San Fablo�stop N/W corner Maroa -- stop b. Route No. 30 (Blackstone Avenue) north and south beyond the general limits of Barstow and Bullard Avenues near the project area 14 hours per day Monday thru Saturday; 12 hours per day on Sunday and holidays with 30 minute headway. Monday thru Friday there is peak hour service -approximately 311 hours in the morning and 3111 hours in the afternoon providing 1.5 minute headway. Sunday and holiday service is operated with one hour headway. Bus stop Locations with improvements: w Blackstone Avenue: i) Northbound - NIB corner Bullard -- bench ii) Southbound - S/W Corner Bullard - bench See attached map and schedules for Route Nos. 51 and 30. 2. Route No. 51 (Barstow Ave.) would provide better service to the project area if it could operate, on weekends. Route No. 3€3 (Blackstone Ave.) is adequate service although it is just over one -quarter mile from the proposed annexa- tion area. 3. At the present time, there are no comtemplated changes to improve service to the subject area.
