HomeMy WebLinkAboutResolution - City Council - 79-334 - 1979-08-07Recoolng- reclussfed by 95438 Aft * W City Clerk, Fresno, Celiomlly No Fee-Goit, Cod# 6103 & 27282 FILE NO. 7340 Return to City Clerk, Fmsno RESOLUTION NO* RESOLUTION ORDERING VACATION OF A PORTION OF EXCESS PUBLIC RIGHT--OF-WAY ON 5 1 13 3 RIALTO AVENUE, EAST OF ORCHARD AVENUE WHEREAS pursuant to Resolution of Intention No. 770--Dd on file herein, a public hearing was held: at 2:30 p.m. on the 7th day of August y 1.979, at a regular meeting of the Council of the City of Fresno, in the Council Chambers of the Fresno City Hall in the City of Fresno, County of Fresnor State of California, at which bane and place evidence was heard for .and against the vacation of a public street. For further particulars as, to the proposed vacation, reference is hereby made to the map Entitled "Map Attached to Resolu- tion of Intention No, 77 0-011 on file in the office of the City Clerk of the City ;of Fresno, at the Fresno City Hall, 2326 Fresno Street, Fresno, California 93721and WHEREAS, all of the owners fronting the street` proposed to be vacated have approved of the subject action; and WHEREAS, the portion of East Rialto Avenue proposed to be vacated is a „paper street" (unimproved); and WHEREAS, the City Traffic Engineer has reviewed the proposed vacation action and determined that it will have no adverse effects upon traffic circulation; and WHEREAS, findings of Environmental. Assessment No. 2909 indicate that the proposed vacation action will have "no possibility of significant effect on the! Environment" and WHEREAS d the Council of the City of Fresno now finds and determines from 'a.11 the evidence submitted that such street, hereinafter particularly described, is unnecessary for present and prospective public street purposes; NOW, THEREFORE, THE COUNCIL OF THE CITY OF FRESNO pursuant to the provisions of the "Street Vacati6n Act of 1941", being Sections 8300--8374 of the California Streets and Highways Coded DOES HEREBY RESOLVE AS FOLLOWS 1. The public interest and convenience require, and i it is hereby ordered, that as contemplated by Resolution of RECORDED CIAL RECORDS, OF fReSNO COUNTY, CALWORN A, ., �•T_..�... MIN. PAST--- h AUG 6 1979 Coumy Aecorror o=7351 134 Intention No. 770 -D, adapted by the Council of the City of Fresno on the loth day of July, 1979 the hereinafter des- cribed public street, as shown: on the map entitled "Map Attached to Resolution of Intention. No. 770 - D", on file in the Office of the Fresno City Clerk, situated, in the City and County of Fresno be and the same is hereby closed, vacated and ' abandoned for public street purposes 2 That the City of Fresno imposes the condition that abutters' rights are relinquished to prohibit direct access to the existing East Rialto Avenue cul-de-sac. 3. The Council finds and determines that the rights - of -way or parts thereof vacated are not useful as bicycle paths or routes. 4. The City Clerk of the City of Fresno shall certify to the passage of this resolution and shall cause a certi- fied copy thereof attested by the Clerk under the seal of the City of Fresno, to be recorded in the office of the County Recorder of the County of Fresno..
