RESOLUTION OF INTENTION TO VACATE A PORTION OF MERCED STREET
BETWEEN FREEWAY 99 AND 'IF" STREET AND THE E--F AND E—
FREEWAY 99 ALLEYS BETWEEN FRESNO AND MERCED STREETS
UPON PERFORMANCE OF CONDITIONS
WHEREAS, pursuant to Resolution of Intention No. 769-D
adopted on July 17, 1979, the Council of the City of Fresno
declared its intention to order the vacation of a portion of
Merced Street between Freeway 99 and "F`° Street and the E-E
and E-Freeway 99 Alleys between. Fresno and Merced Streets
situated: within the City and County of Fresno. For further
particulars as to the proposed vacation, reference is hereby
made to the map entitled "Map Attached to Resolution of Intention
769-D" on file in the Office of the City Clem of the City of
Fresno, at the Fresno City Hall, 2326 Fresno Street, Fresno
California, 93721
WHEREAS, this Council fixed, the hour of 2:35 p.m. on the
7th day of August, 1979, in the Council, Chambers of the Fresno
City Hall, 2326 Fresno Street, Fresno, Oa.lifornia, as the time
and place for hearing` upon such resolution, and
WHEREAS, the City Traffic Engineerhas reviewed the
proposed vacation action and has determined that it will
have no adverse effects upon traffic circulation; and
WHEREAS, the proposed, vacation action will have no
significant effect upon the environment as indicated by
Environmental Assessment No. 2894 and
WHEREAS, the Council at such hearing received and
considered: the evidence submitted and finds as follows
1. Due notice of such hearing was given as required by law,
2. Said street and alleys are unnecessary far present or
prospective street purposes, provided the following work is done
prior to the vacation thereof:

a. Construct curb, gutter, sidewalk and paving
transitions to close all street and alley
ways to through traffic
b.. The removal of all existing curbs, gutters,
sidewalks, paving and street furniture (i.e.
street lights, parking'metersi fire alarm
boxes, etc.) within the street and alleys
proposed to be vacated.
c. Backfilling and, compacting those portions of
Merced Street and alleys where utilities and
existing street improvements are removed.
d. Remove existing storm water inlets and construct
new facilities where required by Fresno Metropoli-
tan Flood Control District,
e, Curt and plug all sewer and water lines to be
abandoned where they intersect existing mains.
NOW, THEREFORE, the Council of the City of Fresno, pursuant
to the provisions of the "Street Vacation Act of 1941", being
Sections 8300-8374 of the Streets and Highways Code of the State
of California:, DOES- HEREBY RESOLVE AS FOLLOWS
1 That the hearing having been closed, the matter shall
be and it is hereby continued to each time as the Public Works
Director shall have determined that the aforementioned work has
been completed and presents the matter again to Council, and.at
such time it shall be the intention of this Council to adapt an
appropriate resolution ordering the vacation of a portion of Merced
Street between Freeway 99 and "F" Street and the E_F and: E-Freewa
99 Alleys between Fresno and. Me.rc;ed. Streets specifically herein -
before described provided that evidence is submitted to the satis-
faction of the Council that the hereinbefore-described work has
been completed without cost to the City, and
2 That any and all Reservations and Exceptions to this
vacation as contained in Resolution of Intention No._'769-D are
and they shall apply to this resolution.
3. That this Council's preliminary determination made in
Resolution of Intention No. 697-D is herein reiterated that the
rights of way or parts thereof proposed to be.vacated are not
useful as bicycle paths or routes.
