HomeMy WebLinkAboutResolution - City Council - 79-330 - 1979-08-07Path P ul to Ed B#ellcki RESOLUTION No. 7 9 '" 3 3 0 A RESOLUTION APPROVING THE ANNEXATION TO THE CITY OF FRESNO, CALIFORNIA OF CERTAIN UNINHABITED TEP RITORY , DESIGNATED THE HERNDON-MARXS NO. 4 ANNEX- ATION WHEREAS, the Council of the City of Fresno, pursuant to Resolution No. 78-468, applied for and requested the Fresno Local Agency Formation Commission: to take appropriate proceedings, all in accordance with the Municipal Organiza- tion Act of 1977, for the annexation of lance more particularly hereinafter de- scribed to the City of Fresno, and such annexation proposal has been designated Herndon --Marks No. 4 Annexation; and WHEREAS, the Fresno Local Agency Formation Commission, on the 28th day of February 1979, at a duly noticed public: hearing, considered all matters relevant to the proposed annexation and 'heard all persons interested, and adapted Resolution. No. AC--78-�11, "Making Determination and Approving Proposed Herndon -Marks No. 4 Annexation", all at the time and in the form and manner as prescribed by laws and WHEREAS, said Fresno Local Agency Formation Commission Resolution No, AC-78--11 authorized the Council to conduct the proceedings for the annexation in the manner provided by laws and WHEREAS, the Council, 'pursuant to Resolution No. 79-277, initiated proceedings far said proposed annexation and sett a hearing on the proposed annexation for the 7th day of August 1.979,- at 2:05 p.m., in the Council Chamber, City Mall., 2326 Fresno Street,, Fresno, California 93721; and WHEREAS, the Council finds that the required notice.of the passage of said resolution initiating proceedings for the proposed annexation and of the time and place for hearing protests or, ob j ecti,ons to said annexation has been published, posted, and -xw led. in the time, form, and manner required by law; and WHEREAS, said hearing was `duly; held by the Council at said time and place for the hearing of all objections to said proposed annexations and. WHEREAS, protests or objections in writing to said annexation delivered to the Clerk of the City of Fresno up to the hour set for hearing thereof, were con sidered Land said protests or objectionsinwriting are on file and of record in the Office of the Clerk of the City of Fresno, County of Fresno, State of Cali- fornia, and all persons who desired to be heard were heard; and WHEREAS, at said hearing and prior to consideration of protests, the resolu- tion of the Fresno Local, Agency Formation Commission making determinations was presented to the Councils and ' Page 1 of 2 `71q �p� REJWION NO. AC- 7 8-11 1 MAKING DETERMINATION AND APPROVING) RESOLUTION OF THE PROPOSED "HERNDON-MARKS; #41" } FRESNO LOCAL AGENCY 2 ANNEXATION To CITY OF FRESNO FORMATION COMMISSION 4 WHERS, preliminary proceedings have been initiated by the 5 City of Fresno to annex certain territory to the City of Fresno 6 in the County of Fresno, and WHEREAS, an application for said proposal has been accepted 8 ' for filing by the Executive Officer of this Local Agency Formation. 9 Commission pursuant to Title 4, Division: 2, ,Chapter2 ,of the 1.0 Government Code; and 11 WHEREAS, said application was set for hearing by the Executive 12 Officer on the 28th day of February 1979, at the hour of 2:40 P.M. 13 of said day; and 14 WHEREAS, notice of the hearing of said application was. duly 15 given by mail, posting, and, newspaper publication as required by 16 Law; and 17 WHEREAS, the Executive Officer has reviewed said application 18 and prepared a. .report, including his recommendations thereon , said E 19 application and report having been resented to and considered b Pp P 9` p Y 20 this Commission,- and 21 WHEREAS, this Commission has considered all relevant factors 22 and heard all interested parties wishing to speak on said 23 application; and 24 WHEREAS.. a negative declaration of environmental impact had 25 been prepared and properly noticed by the City staff and said 26 negative declaration was considered by the Commission. 27 NOW, THEREFORE, BE IT RESOLVED that the Local. Agency Formation 28 Commission of the County of Fresno does HEREBY RESOLVE, DETERMINE 29 AND ORDER. as follows 30 Section 1. This Commission certifies it has reviewed and 31 considered the negative declaration. The Commission has also 32 found that the proposed inclusion will have no environmental x CAI impact beyond: that addressed in the information submitted in the 2 _environmental finding for the proposal. 3 Section 2. Said proposal .is approved subject to the terms .and 4 conditions hereinafter specified. 5 Section 3. Any resolution of the conductingagency ordering S this annexation shall provide that such annexation shall be 7 subject to the fallowing terns and conditions: $ 1. Inclusion of APN 305-231.-13 and adjacent read and .canal 9 right of way. Prior to further City proceedings an amended map 10 and description.- approved by the County Assessor's Office, be submitted to the Local Agency Formation Commission. 32 Section 4. The boundaries of the territory proposed to'bye' 13 annexed, as set forth in attached Exhibit .A. and as amended by 14 condition, are approved. Said territory is found to be uninhabited 15 and is assigned the following distinctive short form designation: 16 Herndon -Marks # 4 17 Section 5.` The City of Fresno is designated as the conducting 18 agency and the governing body of said agency is hereby directed 19 to initiate annexation proceedings in compliance with . this 20 resolution, 21 Sect.ion. '6. Further proceedings shall. be :initiated, conducted, and completed 'pursuant to required law.
