RESOLUTION NO. 79 - 2 8
A RESOLUTION OF THE COUNCIL OF THE CITE
OF FRESNO.EXTENDING THE CONDOMINIUM
MORATORIUM TO OCTOBER 18 , 1979.
WHEREAS, on May 15 1979, the Council directed City
staff to prepare an ordinanceregulating regulating condominium con --
version projects, and
WHEREAS, the Council has found that state law substan-
tially restricts the ability of local'
goverment to regulate
condominium -conversion projects absent local ordinances
specifically addressing conversions; that' there is a high
level of condominium conversion projects proposed in the
Fresno area to which the provisions of the proposed Condominium
I Conversion ordinance should be applied; and that the health,
i safety and welfare of the inhabitants of the city of Fresno
required a moratorium pending the adoption of a Condominium
Conversion Ordinance and
WHEREAS,, the Council instructed City staff to not accept
for processing any further condominium conversion projects fo
90 days; and
WHEREAS a City staff has prepared a proposed ordinance
which the Council has introduced; and
WHEREAS, the Council desires to provide adequate time
for review and comment upon the proposed ordinance by all
interested parties
NOWT THEREFORE, THE COUNCIL OF THE CITY OF FRESNO RESOLVEs
AS FOLLOWS:
l Based upon the following findings the moratorium on
processing applications for subdivision maps for proposed con-
dominium conversions is extended until. October 1.8, 1979
2. The Council finds as follows
(a). There is a. high degree of condominium conversion
activity within .the City of Fresno
(b) Available rental housing stock within the City
of Fresno would.be Significantly impacted, and current
building and: safety standards of the City of Fresno would
not be complied with .absent City regulation of
condominium conversion projects;
(c) Without local ordinance provisions specifically
addressing condominium conversions, state law substantially
restricts the City's ability to regulate such conversions.
8 Any application for a tentative Subdivision Map for
a proposed condominium conversion projectaccepted after October
18, 1979, shall be processed: in accordance with t
f hp provisions
of any ordinance adopted by the Council bar October 18r 1979
frelating to condominium conversions.
