OF THE BAR.STOW-VAN.NESS NO. 3 DISTRICT -REORGANI- ZATION ORDERING A REORGANIZATION TO THE CITY OF FRESNO AND THE NORTH CENTRAL FIRE PROTECTION DISTRICT WHEREAS, this proposal is made pursuant to the District Reorganization Act. of 1965 contained -in Divi lion l of Title 6 (commencing with Section 56000) of the California Government Code; and WHEREAS, the nature of the. proposed Change is a reorganization consisting' of the detachment of certain territory consisting of 1.23 acres and hereinafter called the "subject territory"` from the North Central. Fire Protection District and the annexation: of the subject territory to the City of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the subject territory proposed to be detached from the North Central Fire Protection District :and annexed to the City of Fresno is uninhabited, is described in Exhibit "A", and is graphically depicted upon the map marked Exhibit "B" , and by these references is made a part of this resolution; and WHEREAS, LAFCO has determined the project to be an activity of a .type which would not have a significant effect on the environment; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and: said ser- vice plan is attached hereto as Exhibit "C", and by this reference made part of this resolution; and WHEREAS, all, information and findings regarding the subject proposal, in- cluding the service plan, was prepared and provided by the applicant and: has been found to be adequate by City staff, and WHEREAS, no new districts are proposed to be farmed by this reorganization; and WHEREAS, the owner of the subject territory to be annexed has given this written consent to the reorganization; and WHEREAS, the Fresno Local Agency Formation Commission, on the 27th day of Tune, 1979, at a duly noticed public hearing, considered all; matters relevant to the proposed reorganization and heard all, persons interested, and adopted Resolution No. RO-79-1.6, "Making Determination and Approving Proposed: Barstow - Van Ness No. 3 Reorganization"', all at the time and in the form and manner as prescribed by law; and Page 1 of 3 WHEREAS, said Fresno Local Agency Formation Commission Resolution No. RO- 79-1.6 authorized this Council to conduct the proceedings for the reorganization .both without notice, hearing, or election, pursuant to Government Code Section 56261 and WHEREAS, the Fresno Local Agency Formation Commission's resolution making determinations was presented and summarized to this Council; and WHEREAS, the Fresno County Assessor's roll will be used for the purpose of; levying any assessments or taxes on the subject territory; and WHEREAS, -the subject territory proposed to be annexed to the City of Fresno shall be exempt from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebted- ness incurred by the City prior to the effective date of such annexation; and WHEREAS, upon completion of this reorganization proposal, the subject terri- tory will be included in Municipal Bond Area. "D" and will not be taxed for any existing ]bonded indebtedness or contractual obligations, and WHEREAS, pursuant to Fresno Municipal Code Section 2-208 the subject territory is allocated to the Bullard Council District No. 2. NOW, THEREFORE, the Council of the City of Fresno resolves and orders: 1. The territory within those boundaries described in Exhibit "A"IT attached hereto and incorporated herein and more particularly depicted upon the map marked Exhibit "B'" attached hereto and incorporated herein, is hereby annexed to the City of Fresno and the same territory is hereby detached from the North Central Fire Protection District of Fresno County. 2. It will be to the best interest of said territory to annex the same or detach the same, as the case may be, and that lands have not been improperly omitted from, or included within said proposed annexation and detachment. 3. The reasons for this proposed reorganization are as follows a. The subject territory is within the City of Fresno's Sphere of influence. b. The owner of the subject territory has expressed a desire to annex to the City. c. The consolidation of the subject territory into one detachment - annexation project is beneficial to the affected governmental processes and the resultant City and District boundaries. g Page 2 of d. That proposed reorganization requires the annexation of the subject territory to the City of Fresno and the detachment of the same territory from the North Central Fire Protection District 4 The Clerk of the City of Fresno shall immediately cause to be trans- mitted to the Executive Officer of the Fresno Local Agency Formation Commission a certified copy of this resolution. Upon the filing of the appropriate documents by the said Executive Officer in the manner prescribed by law, the reorganization shall be completed. I'.I.' Fire Protection 1 7 District in, the County of Fresno; and 8 WHEREAS-, an application for said proposal has been accepted 9 for filing by the Executive Officer of this Local Agency Formation 10 Commission pursuant to Part 2 of Title 4, Division 2 of the 11 Government. Cade and .2 WHEREAS , the Executive Officer has reviewed said application 13 and prepared a report, including his recommendations thereon, said 14 application and report having been, presented to and considered by 15 this Commission; and 16 WHEREAS, this Commission has considered all relevant factors 17 and heard all -interested parties wishing to spear on said 18 application; and 19 WHEREAS, it appears to the satisfaction of ` this Commission 24 that all owners of the Land within the territory proposed to be 21 reorganized have given written consent to such proposal; and 22 WHEREAS, written notice was given to those agencies whose 23 boundaries would be affected by the proposal as required by 24 Section 56261 of the Government Code, and no demand for public 25 Dearing was made; and 26 WHEREAS, the proposed project was determined to be an 27 activity of a type which would not have a significant effect on 28 environment and is therefore., not subject to the provisions the env roam nt d , h r � '29 of the California Environmental Quality Act. 30 NOW,, THEREFORE, the Local Agency Formation Commission of the 31 County of Fresno DOES HEREBY RESOLVE, DETERMINE AND ORDER as 32 follows MUNTY 1411 t 90140 1 Section 1. This Commission certifies it has reviewed and considered the environmental finding. 3 Section 2. Said proposal is approved subject to the terms 4 and conditions hereinafter specified. Section 3. In accordance with the 1963 policy of the Commission 6 discouraging annexations which violate adopted plans, the Commission 7 dues direct the Executive Officer to work with the affected agencies 8 and parties to resolve conflicts or violations of general plans 9 prior to the proposal's consideration by the Commission.. The 10 Commission does direct the Executive Officer to send a letter to 11 the City expressing the concern of the Commission. as to, the 12 conflict in the proposed development and existing plans and policies 13 and that any proposal for the affected territory of this reorgani- 14 zation be reviewed by the City as to its consistency of all adopted 15 plans and policies, including Van Ness-Forkner Land Use Policy. 16 Any conflicts with plans and policies should be resolved via the 17 plan amendment process with review .and testimony by affected 18 agencies, the county, residents, and the public. The Commission 19 would :also encourage the staff of the City and County to resolve 20 any conflict with existing City and County Specific or -General 21 Plans. 22 Section 4, :any resolution of the conducting agency ordering 23 this reorganization shall provide that such reorganization shall be 24 subject to the following terms and conditions 25 None 25 Section 5. The boundaries of the territory proposed to be 27 reorganized, as set forth in attached Exhibit A or as amended by 28 condition, are approved. Said territory is found to be uninhabited 29 and is assigned the following distinctive short form designa.tion.- 30 Barstow --Van Ness 31 Section 6. The City of Fresno is designated as the conducting 32 agency and the governing body of said agency is hereby directed to C4vMT OF FRXsHa 1 initiate reorganization proceedings; said proceedings are 2 authorized both without notice and hearing, and election, pursuant 3 to Government Code Section 56261. 4 Section 7. Further proceedings shall be initiated, conducted 5 and completed pursuant to required law. Proceedings and any 6 resolution of approval shall comply with this resolution. 7 Section 8.
