A RESOLUTION OF THE COUNCIL OF THE CITE' OF
FRESNO,, FRESNO CALIFORNIA, REQUESTING AMEND-
MENT TO SECTION 99268.5 OF THE PUBLIC UTILITIES
CODE RE REVENUES FOR TRANSPORTATION OF ELDERLY'
AND HANDICAPPED
WHEREAS, the City of Fresno operates ,a transportation
service for the elderly and handicapped; and
WHEREAS, the service is " called Tandy Ride; and
WHEREAS, the City of Fresno? uses Transportation Development
Act funds to offset some of:. the operating costs for the Handy
Ride service,.- and
WHEREAS, Section 21 of Senate Bill 620 amends the 1971
Transportation Development Act by adding Section 99268.5 of
the Public Utilities Code to require a ratio of fare revenue
to operating costs ` of ten percent in order to be eligible for
continued funding, and
WHEREAS, the Handy Ride Division has a: farebox operating
ratio of only two percent during .the bench mark 1978-79 fiscal
year; and
WHEREAS, the Urban Mass TransportationAct of 1964 precludes
the City of Fresno from raising its fare a for elderly and handi-
capped service without placing federal funds in jeopardy,' and
WHEREAS, the City of Fresno desires legislative amendments
to Section 99268..5 of: the Public Utilities Code allowing the
City of Fresno to continue to use TDA funds for the important
and necessary transportation sere .ce for the elderly and handicapped.
NOW ff THEREFORE, BE -IT RESOLVED that the Council of the City
of Fresno requests amending legislation of Section 99268.5 of
the Public Utilities Code to read:
99268.
5.. Commencing with claims for the 1980-81
seal year, no funds shall be allocated under
this article- in any fiscal year to an operator
providing services using vehic-1es for the exclusive
use of elderly and handicapped persons, unless the
operator maintains., for the fiscal year, a ratio
of the sums of fare revenues and local support to
operating cost, as defined by subdivision. (a) of
Section 99247, for such services at least equal
to the ratio it had for such services during the
1978-79 fiscal year.
