RESOLUTION VACATING A PORTION CAE BASEMENT FOR PUBLIC
UTILITIES PURPOSES
WHEREAS, there is an easement for public utilities
purposes in, upon, over and across the hereinafter described
strip of read. property , situated in the. City of Fresno, County

of Fresno, State of California, and
WHEREAS the Council of the City of Fresno makes theUZ
following findings based upon all the evidence submitted.:

(1) The portion of the easement descriibed below has not

been used for the past five consecutive years and

(2) said portion of such easement is unnecessary for
present and prospective public utilities Purposes
and
WHEREAS, the Council of the City of Fresno desires to
vacate and abandon a portions',�of such easement
NOW, THEREFORE", the Council of the City of Fresno DOE$
HEREBY RESOLUTE AS FOLLOWS
1. That the portion of easement for public utilities
p-�rposes heretofore and now existing in, upon, over and
across that hereinafter described strip of real property
situated. within the City and County of Fresno be and it is
hereby vacated and abandoned.
2. That the easement to be: vacated: is described as
follows:
That portion of a 16-foot wide. public utility easement
in Lots l - 12, inclu'lve, and Lots 18 - 29,, inclusive,
as dedicated by the Map of Roeding Park Gardens Sub-
division, recorded. January 28, 1947 in Volume 13 of
Plats at. Pages 37 and 38 Fresno County Records;
excepting therefrom that portion:; lying within the
Northerly y 8 feet of Lots 12 and 18 of said Roeding
r Park Gardens.
4. The Council finds and determines that the rights
or way or parts 'thereof vacated are not useful as bicycle

paths or routes

5. The City Clerk of the City of Fresno shall certify
to the passage of this resolution and shall cause a certi-
fied copy thereof attested by the Clerk under the seal of
