HomeMy WebLinkAboutResolution - City Council - 79-311 - 1979-08-07" P ann I lidInspection RESOLUTION NO. y7 9 ` 31 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO INITIATING THE AMENDMENT TO THE YOSEMITE JUNIOR HIGH AREA SPECIFIC PLAN WHEREAS, the Yosemite junior High: Area Specific Plan was adopted by the Council of the City of Fresno on March 4, 1976; and MRFAS, the Council of the city of Fresno received communication from Mr. Louis A. Bozigian on June 28, 1979, requesting that the. City Council initiate an amendment ` to the sand. Use and Circulation Element of the Yosemite Junior High Area Specific Plan to delete the planned street alignment linking North Millbrook and North Eighth Street, between East Floradora and: East Olive as depicted in Exhibit "A" and AREAS, the.Council of the City,of Fresno considered; to report and recom- mendation of the Department of .Planning and Inspection, and: the testimony by Louis A. Bozig an and matte its own independent investigation in connection therewith. NOW,, THEREF01M,, BE IT RESOLVED that the Council of the City of Fresno does hereby initiate the procedure to amend ;the Yosemite Junior High area Specific Plan as it applies to t xe planned street alignment linking North ;t illbrook Avenue and North Eighth Street between East Olive and East Floradora to delete the afore- mentioned local street from the Specific Plana as depicted in Exhibit "B" . FURTHER:, BE IT RESOLVED that the proposed amendment be referred to the Plan- ning commission for report and recommendation. CITY OF, FRESNO City Hall 232,6 Fresno Street Fresno, California 93721 Gentlemen. This is in reference to a parcel of land located at 1298 N. Millbrook (see parcel' map). The property is located on. the eastside of North Millbrook Avenue between East Hammond and Fast Lamona Avenue. The property is currently zoned R-A but is recommended: to be zoned for multiple family residential use in the Yosemite Jr. Hi area Specific Plan. I am requesting that the city council initiate are amendment that would eliminate the planned street through subject property. (See attached copy of Specific Man for Yosemite Jr. Hi Area. We understand that this is one of the areas now in the process of annexation to the City, and this certainly is good news. I am informed that the said specific plan recommends that an East --West Street be built between North Millbrook Avenue and North Eighth Street at the East Hedges alignment. However, if the circulation element of this planis more than just a.. recommendation then it appears that I must request an amendment to the plan. Our intention is to improve the property by providing multiple dwellings and I want to pursue the process properly. We have received°encou.raging legal opinion from the City Attorneys office concerning what we hope to be abandonment of the road under the Yosemite plan. We understand there are no land locked parcels and a'60 ,foot right-of-way through a 100 foot frontage lot would create a hardship on the landowner. We know this was not the intent of the City of Fresno. Under the proposed R-3 zoning for this area, parcels with 30 foot depth are ideal for development and any access that my be needed.
