RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO MAKING
APPLICATION FOR APPROVAL OF PROPOSAL TO INITIATE THE
ANNEXATION OF TERRITORY DESIGNATED THE WELDON--FIRST
NO. 3 ANNEXATION
WHEREAS, pursuant to the Municipal Organization Act of 1977, beginning
with Section 35000 of the Government Code, the Council desires to annex the
hereinafter described territory to the City of Fresno in order to promote
the logical formation and determination of City boundaries and to encourage
orderly growth and development which are essential to the social., fiscal, and
economic well-being of the City; and
WHEREAS, the territory herein proposed to be annexed is designated the
Weldon -First No. 3 Annexation and consists of that real property situated in
the County of Fresno, State of California, the boundaries of which are specifi-
cally described in Exhibit "A" attached hereto and incorporated herein by this
reference and more particularly depicted upon a map marked Exhibit '"B" attached
hereto and incorporated herein by this reference; and
WHEREAS, pursuant to the requirements set forth in Government Cade Section
35102, a service plan for the subject territory has been, prepared and said ser-
vice plan is attached: hereto as Exhibit "C" and, by this reference, made part
of this resolutions and
WHEREAS, review of the environmental assessment related to said annexation
project resulted in a Categorical Exemption: by the Evaluation. Section of the
Department of Planning and Inspection of the City of Fresno,- and
WHEREAS, an informational_ letter explaining the ramifications of annexation
Will be mailed to all property owners.within the subject territory at the time of
filing with the Fresno Local Agency Formation Commission; and
WHEREAS, the Council finds that the territory contained in the proposal..
a. Does not exceed 100 acres in area and such territory constitutes
the entire unincorporated island of territory;
b. Is substantially surrounded by the City of 'Fresno which is proposing
the annexation,
c. Is substantially developed;
d. is not prime agricultural land as defined in Section 35046;, and
e. Will benefit from such annexation and is receiving certain bene-
fits from the City of Fresno.
WHEREAS, the Fresno County Assessor's roll `'will be used for the purpose of
levying any assessments or taxes on the subject territory.

ceedings to annex to

SUMMARY SERVICE PLAN POR THE
WELDON-VIRST NO. 3 ANNEXATION
June 8, 1979
The purpose of this document is to provide a summary of information regarding
now municipal services will be provided to the subject territory should annexaa�
tion to the City occur, when such municipal services would be available, any
modifications to be made to existing facilities and ;how such facilities will be
financed.
The service plan has been 'prepared in accordance with the requirements of
Government Cede Section 35102.It consists of responses from the following
City departments: Planning and Inspection, Public Works, Finance, Parks and:
Recreation, Police and Fare Protection, and from the Fresno ;Metropolitan Flood
Control District. Copies of the original responses from the above --mentioned
sources are available for inspection with the City's Urban' Unification Team.'
Requests to examine the original responses should be directed to Mr. Ed Eielicki,
488-1567. The information provides an enumeration and description of the services
to be extended to the affected territory and the level and range of such services.
The proposed Weldon -First No 3 Annexation consists of the annexation of 40.52
� acres, consisting of 1.20 parcels, to the City of Fresno. The project area is
exempt from the UGM process. The subject territory is a substantially surrounded
county island and is proposed to be annexed to the City of Fresno as inhabited
territory by virtue of Government Code Sections 35150(f) and: 35013.
The subject territory is well within the City's Sphere of influence and consists
of an area with irregular boundaries., generally located on the west side of
North First Street between East Weldon and East McKinley Avenues, Existing
lend: use includes III single family dwellings, vacant residential lots, one
commercial establishment, and portions of the proposed State Freeway 41 road
rights -of' -way.
The adopted 1974 FCbVA General Plan indicates the properties appropriate fox
medium -high density residential uses. The adopted McLane Community Flan
indicates the subject properties .appropriate for medium density residential
uses. The subject territory is zoned R 1, R 3-A. and CM-4.
Sewer Service
The following maps and information were provided by the City of Fresno Departments
of Public Works and Finance.
The subject territory its served by the City of Fresno sever system. No modifica-
tions will be required to continue to provide the present level of service. {see
the attached map, Exhibit A-1, for location and. size of sewer main
There are currently 83 sewer connections within the island, two of which are
billed commercial. rate ($8.50 bi-monthly) and the balance are billed at $7,20
bi-monthly which, is the. current "outside" rate for single family dwellings. There
will be several parcels which will be abandoned due to Freeway right-of-way., Should
the area be annexed sewer rates would be reduced 33 1/3 percent.
Water Service
The following information was provided -by the City of Fresno' Departments of Public
Works,and Finance.
County Waterworks District No. 3 provides service to the area proposed for
annexation.. There are approximately Ill services in this area. No modifications
will; be required to continue to provide the present level of service. (See the
attached map, Exhibit B-1, for location and size of water mains).

Fire Protection
The following information was provided by the City of Fresno Fire Department.
The proposed annexation area is now being protected by did Valley Fire District.
Upon annexation to the City, the area would be served by Fresno Fire Department
Station No. 5 located at North Fresno Street and Fast Shields .Avenue, which is
approximately 1.0 mile from the nearest point of the proposed annexation area
and approximately 1.3 miles from the farthest paint.
This station,is equipped with a pumper and a ladder truck. All ladder trucks
have paramedics as part of the crew.
Backup response is provided by Station No. 4 located, at First and Iowa Streets,
which is approximately 1.6 miles to the nearest point of the area 4nd 2.0 miles
to the farthest point. This station is equipped with a pumper .and.,a ladder
truck. All ladder tracks have paramedics as part of the crew..
Toter and Hydrant Service
The proposed annexation is presently being provided water service by Fresno County
Waterworks District No.. The hydrants in the area would not meet requirements
f of the Fresno Fire Department. If additional, hydrants or water supply is needed,
the below recommendations are suggested, and if needed, a map showing hydrant
locations is enclosed. Additional: hydrants would be needed to provide the. require-�
meats of the Fresno Fire Department. hydrants should be no further than 600 feet
apart.
Analysis
This annexation would: be advantageous to the residents due to the following
reason.
The close proximity of both station No 5 and. Station No. 4 will supply excellent
fire response to the project area. 4
Police Protection
The following information was provided by the City of Fresno Police Department.
This proposed island, annexation presently receives police protective services
from the Fresno Sheriff's Department. Upon annexation, the responsibility for
providing such services will be assumed by the Fresno Police Department.
It is anticipated, initially, that the service level providid to the annexation,
will be equal to that provided: -to neighboring areas within the pity. It is also
projected that the work load generated by the proposed annexation will require an
adjustment in deployment patterns and a possible increase in manpower. A final
determination of the impact is riot possible until work load statistics are
received from the Sheriff's Department in late April, 1979.
Streets
The following information was provided by the City of Fresno PubswX .works
Department
In accordance with the major Streets and Highways Plan, the projected status
(including street name, width, number of lanes, and type) of all streets within
or adjacent to the project area.
see attached map, -Exhibits C--1 and C-2. City standards provide the following with

regard. to street development.
1. Arterial Street, 1009 to 106' of right-of-way, 4--lane
divided roadway;
2. Collector Street, 80' to 84' of right-of-way, 4-lame
undivided roadway;
3. Local. Industrial Street, 64' of right-of-way, 2-lane undivi.,ed;
4.: Local Residential Street, 60' of right-of-way, 2-lane undivided.
All streets not shown on attached map, Exhibits C-1, C--2, are to be considered
local streets. McKinley Avenue and First Street are classified as arterial
streets and the remaining are all local streets. phase 4 of McKinley Avenue
is planned. for 1980/81 and will be financedthrough the gas tax. Freeway 41
construction adjacent and within the project area is planned by CalTrans.
Any curbs, gutters, additional right -of way, permanent pavement, sidewalks,
etc., the property owners/developers would be required to install./provide
(including the measurements and location for right-of-way), as well as time
table and the financial responsibilities for any of the above.
it is the property owner's responsibility upon development of the property to
install at his expense the adjacent .curb, gutter, sidewalk and 18' of paving
in addition to dedicating right-of-way necessary for widening the street from
the current to the ultimate width.
Street Lighting/Traffic Sgnalizaton
City will prepare master street lighting plans for �� =new City areas in coopera-
tion with pG&E to facilitate the scheduling of installation of temporary (wood
pole mounted)ligh:tinq by the utility company. However, no 'lighting of this type
where the new areas are served by underground electrical equipment or where the
area is situated in a designated "Underground Utility District"
Existing street lighting energy .and maintenance costs will become the city`s
responsibility, including special'distri.cts for street lighting.
Street Marking
City will became responsible for maintenance of all existing pavement marks on
public streets upon completion: of the annexation. New hoarder streets will. be
maintained in accordance with existing multi -agency agreements for these services.
Street Signing
City will become responsible for maintenance of all existing public street signing.
Street name sign replacement to conform to City standards would be programmed
within a five-year (5) program.
Traffic Signals
City will become responsible for programming the installation of new traffic
signal, using existing warrants, priority, and scheduling processes. All annexed
traffic signals now existing will be maintained and operated by the city in con-
formance with existing multi. --agency agreements where equipment is shared with
another agency,

Solid waste Disposal ,
The subject territory is now being served, by a private waste ` disposal company.
Upon annexation the City of Fresno will provide this service in accordance
with Section 35005 of the Government Code, Pant 2,, Division 5, Chapter 2.7,
Section 4272 of the Health and Safety Code.
Following the annexation, notice will be sent to the private company that the
area is annexed to the City and that the above -mentioned Government Code applies
Street Sweeping
There are no street sweeping services provided to the area at this time. There
are 1,600 feet of existing curb miles. City of Fresno will provide future
street sweeping. Them: are no provisions to govern_ any transition period.
Transit
See Exhibit P--1 provided by the City of Fresno Transportation Department.
Parks and Recreation
The following information was provided by the City of Fresno Parks and Recreation `
Department.
The proposed Weldon -First No. 3 annexation area is presently, served by the follow-
ing Parks and Recreation facilities and services
1. The days -to -day neighborhood park and recreational needs of
the project area are currently being served by the City of
Fresno Parks and Recreation Department according to the
Department's standards.
The Department's standard require the location of a neighbor --
hood park within a mile of each residence to serve the recrea-
tional needs of the youth, seniors and adults in the area
The nearest facility to meet that need is within one mile
of the areas.

b. Cedar/Si.erra. Park - Cedar and Paul
2 Woodward Park will, provide regional park needs for the project`
area:
3 No additional land acquisition or facility. development will be
required to meet current Department standards
4. At present, no problems are anticipated in providing parks and
recreation services (as per the Department t s standards) for the
proposed annexation area

Animal Control
There are no differences in the level of animal control .services provided by
the Society for the Prevention
of Cruelty to Animals throughout the Fresno
Metropolitan Area,
UtilLX Tax
The City's 4.6 percent utility
tax will be applicable to all natural gas,
electric and telephone bills..
The actual cost of such tax can be estimated
by relating this tax .rate to the current utility bills.
Property Tax
,annexation to the City of Fresno will cause no property tax increase to the
property owner.

This correspondence serves as the Flood Control. Distr cats
response to information requested in conjunction with the
service plan of each of the subject proposals. In an effort
to ,expedite our response that in.format on. of a common nature
to all of the subject proposals shall be provided general
comment Information relating to a single proposal shall be
provided as such.
The service delivery system of - the Fresno ' Metropolitan Flood
Control District is identified within the Legislative respon-°
si}lites of the District* These responsibilities are 'gen�-
erally divided: into three basic types of services. First and
foremast, is flood: control protection of the lands within the
District. This responsi�ail ty entails the protection' of
District Lands from the intrusion of food waters from the
foothills region. Secondlyt the District is retp onsible for
the provision of urban storm drainage services as certain
lands are converted. to urban uses. This is a otall separate
service of the District from that of flood; control. Finally't
the District's service system entails the conservation of
flood and storm waters.
The tiring of construction of urban drainage facilities is
heavily dependent on the rate of development within a partic-

cular watershed and the availability.of capital improvement
funds. Generally these facilities are constructed through
one of two funding methods, participation is effected either
at the time of development through the drainage fee ordinance
of the city or County,, or through the: formation' of an assess-
ment district. These fees are collected on all metropolitan
area development,, whether inside or outside of the District.
Because the drainage fees and assessments finance the urban
drainage system, said fees and assessments are determined on
the basis of land use and area.. Such fees or assessments
represent a one --time contributionto the construction cost of
the urban drainage system serving the watershed in which the
parcel being` charged is located.
In addition to the 'above information, all of the subject
annexation and reorganization proposals are within the bound-
aries of the Flood Control District. The following information
- relates to each proposal individually.
! Woodward -Chance No. 3

The Woodward -Chance No 3 Annexation , is located in Drainage
Zone "GGG" Although permanent drainage services are not
currently available, the basin facility was recently acquired`
by the Dst:f`ct and is included within the boundaries of the
annexatioo; After fencing of the basin site, it shall be
available for excavation and shall provide permanent service in
conjunction with the construction of the collection system. {
Nees -Fresno No'
The Nees -Fresno No. 2 is located on the extreme southern
portion of Drainage Zone "CW." The basin site serving this
area is located at Nees and. Fresno Street and is undergoing
excavation in conjunction with development activity occurring
within the watershed. The adopted master plan envisions storm
water collection through surface flow.
Holland --harks No.- 3
The subject proposal is located in Drainage Zone "AGII and on
permanent service.
Barstow --Fourth No. 1
The subject proposal is located in. Drainage Zone 11M11 and on
permanent service.
Weldon -First Nos 3
The Weldon -First No. 3 Annexation is located in Drainage
Zone "CC." The basin site serving the subject proposal is
