RESOLUTION of THE COUNCIL OF THE CITY OF FRESNO SING
APPLICATION. FOR APPROVAL OF PROPOSAL TO INITIATE THE
ANNEXATION OF TERRITORY DESIGNATED THE CHURCH --ELM NO.3
ANNEXATION.
WHEREAS, pursuant to the Municipal. organisation Act of 1377, -beginning
with Section 35000 of the Government Code, the Council desires to annex the
hereinafter described territory to the City of Fresno in order to promote the
logical formation and determination of City boundaries and to encourage orderly
growth and development which are essential to the social,, fiscal, and economic
well-being of the City; and
WHEREAS, the territory herein proposed to be annexed is designated the
Church -Elm Rio. 3 Annexation and consists of that real property situated in the
County of Fresno, Stateof California, the boundaries of which, are specifically
described in: Exhibit "A`t attached hereto and incorporated heroin by this reference
and more particularly depicted upon a map marred Exhibit "B" attached hereto and
incorporated herein by this reference; and
WHEREAS, pursuant to the requirements set forth in Government Code Section
35102, a service plan for the subject territory has been prepared and said service
plan is attached hereto as Exhibit "C„ and, by this reference, made part of this
resolution.; and
WHEREAS, review of the environmental assessment related to said annexation
project resulted in a Negative Declaration by the Di riactor of the Department of
Planning and Inspection of the City of Fresno; and
WHEREAS, an informational letter explaining the ramifications of annexation
will be mailed to all, property Downers within the subject territory at the time of
filing with the Fresno Local Agency Formation Cormission and
WHETREAS, the Council finds that the territory contained in the proposal;
a. Does not exceed 100 acres in area, and such territory constitutes the
entire unincorporated island of territory;
b. Is surrounded by the City of Fresno which is proposing the annexations
c. Is substantially developed or developing;
d. is not prune' agricultural land as defined in Section 3 W; and
e. Will benefit from"such annexation and is receiving certain benefits
from the City` of Fresno.

SUMMARY - SERVICE PLAN FOR THE
CHURCH -ELM NO. 3 ANNEXATION
May 25, -1979
The purpose of this document is to provide a summary of information regarding
how municipal services will be provided to the subject territory should annexa-
tion to the City occur, when such municipal services would be available, any
modifications to be made to existing facilities and how such facilities will
be financed.
The service .plan has been prepared in accordance with the requirements of
Government Code Section 35102. It consists of responses from the following
City de:partme.nta Planning and Inspection, Public Works, Finance, Parks and
Recreation, Police and Fire Protection, and from the Fresno Metropolitan Flood
Control District. Copies of the original responses from the above-menetoned
sources are available far inspection with the City's urban Unification Team.
Requests to examine the original responses should be directed to Mr. Ed Bielicki.,
488-1567. The information provides an enumeration and description of the services
to be extended to the affected territory and the level and: range of such services.
The proposed Church -Elm No. 3 27m,.nexation consists of the annexation of 20.3
acres consisting of 11 parcels to -the City of Fresno„ : The project area is exempt
from the UGM process , The subject territory is an entirely' surrounded county
island and is proposed to be annexed to the City of Fresno ;as inhabited territory
by virtue of _Government Code Sections 35150(f) and 35013.
The subject territory is well within the C ty's Sphere of Influence and consists
of an area with irregular boundaries, generally located on the west side of South
i Elm Avenue, north and south of East Church Avenue. Existing land use includes
six single family dwellings,, two institutional establishments,, commercial develop-
ment, agricultural, and vacant land.
The adopted 1974 FCMA General Plan indicates the
p properties are appropriate for
medium density residential uses., The adopted Edison Community Plan indicates the
subject properties appropriate for general, heavy commercial:, and medium high
density, residential lases. The adopted 1972 Southwest Fresno Genera3 Neighborhood
Renewal Plan (Departi.wnt of Housing and Community Development) indicates the sub-
ject properties appropriate for medium density residential and for commercial. uses.
Sewer Service
The following maps and information were provided by the City of Fresno Department
of Public Works and'Finance.'
The subject territory is served by the City of Fresno sewer system. No modifica-
tions will be required to continue to provide the present level of service. See
the attached map, Exhibit A-1, .for location and size of sewer mains There are
currently 2 sewer service customers served in this area. All charges would reduce
approxz.tnateZy 6Q percent upon annexation.
Water Service
The following information was provided by the City of Fresno Departments of Public
Works and Finance,
The City presently provides water service and no change will occur in water service..
There are no current plans for maim extensions. The City serves water
to approximately six customers in this area, All the properties are currently.

metered and would remain so as they are either commercial or multi -family
residences. All Charges would reduce approximately 60 percent upon annexation.
Fire Protection
Fire protection is currently being provided by Mid Valley Fire Protection
District.
Upon annexation fire protection would be provided by City Fire Station No. 7,
located at Church and dolly. This station is located approximately 700 feet
from the nearest point of the subject territory and. approximately .4 mile from
the farthest point„ There is one pumper located at this station and one reserve
ladder truck
The next response would be from Station No. 3, located at Fresno and E Streets.
This station is located approximately 1..2 miles from the nearest point of the
territory and approximately 1.6 miles from the farthest point. This station
responds with a pumper and a ladder truck. The Ladder truck is a 100-foot
aerial and is manned with two paramedics as part of its crew.
The area is presently being_served, by the Fresno City Water Department. The
water system is of adequate pressure and volume for Fire Department purposes.
(Average pressure 55 lbs., volume 1500 GPM or better, 1978 tests)
Fire hydrants are located as shown on the project map attached, Exhibit SP-1
It appears there are sufficient hydrants presently available. It appears that
this territory would be much better served as to fire protection if it were
annexed to the City due to its close proximity to a City fire station and the
existing water availability.
Police Protection
The following information was provided by the City of Fresno Police Department.
The above referenced annexation has been reviewed by this Department and the
following comments are submitted -.-
Location and Proximity to Nearest Serviced Area: The project
proposed for annexation is located west of Elm Avenue and: south
of East Church Avenue, which is a current serviced beat zone.
Service Delivery Im2act Theaddition. of this territory will
increase the number of annual calls for service generated
within its assigned beat; however, overallpolice service work
load factors should remain at acceptable levels after this
annexation.
Streets
The following information was provided by the City of Fresno Public Works
Departrlent.
In accordance with the Major Streets and Highways Phan, the projected status
(:including street name, width, number of lanes, and type) of all streets within
or adjacent to the project area.
See attached map, Exhibit C-1 C-2, City standards provide the following with
regard to street developments
1. Arterial Street, 100' to 105' of right-of-waye 4-lane divided roadway;
2. Collector Street, 801'to 841
of right-of-way, 4-lane undividied roadway,

3. Local Industrial Street, 64' of right-of-way, 2-lane undivided. -
A. Local Residential Street, 60' of right -of --way, 2-lane undivided.
All streets not shown on attached reap, Exhibit C-1, C-2 are to be considered
local streets.
Elrn Avenue is classified as an arterial street, Church Avenue is classified as
a collector street, and the remaining are all local streets. There are no
currently planned street projects for this area.
Any curbs, gutters, additional right-of-way, permanent pavement sidewalks, etc.,
the property owners/developers would be required to install/provide (including
the measurements and 'location for right-of-way), as well as timetable, and the
financial responsibilities for any of the above.
It is the property owner's responsibility upon development of the property to
in.>ta:ll at his expense the adjacent curb, gutter, sidewalk and IS' of paving
in addition to the dedicating right--of-way necessary for widening the Street
from the current, to the ultimate width.
Street Li htin f2Traffi<c Signalxation
The City will prepare master street lighting plans for the new City areas in
cooperation with PG&E to facilitate the scheduling of installation of temporary
(wood pole mounted) lighting by the utility company. However, no lighting of
this type where the new areas are served by underground electrical equipment
or where the area is situated in a designated "Underground utility District".
Existing 'street lighting energy and maintenance casts will become the City's
responsibility, including special districts for street lighting.
Street Marking
The City will become responsible for maintenance of all existing pavement marks
can public streets upon completion of the annexatiox. New boarder streets will
be maintained in accordance with existing multi --agency agreements for these
services
Street Signing
The city will become responsible for maintenance of all existing public street
Signing. Street name sign replacement to conform to City standards would b
programmed within a five --year (5) program
Traffic Signals
The City will become responsible for programming the installation of new traffic
signal, using existing warrants, priority, and scheduling processes. All annexed
traffic signals now existing will be maintained and operated by ,the City in con-
formance wit'n existing multi -agency agreements where equipment is shared with
another agency.
Solid Waste Esposal
The subject territory is now being servedbya private waste disposal company.
Upon annexation the City of Fresno will provide this service in accordance with
Section.35005 of the Government Code, Part 2, Division 5, Chapter 2 7, Section,
4272 of the 'Health and Safety Code. The Government Code applies to existing
structures. Any new structures will be serviced by the City. Following the

annexation, notice will be sent to private company that the area is annexed
to City and that Government Code applies.
Street Sweeping
There are no street sweeping services provided to the area at this time. There
are 600 feet of existing curb miles. City of Fresno will provide future street
sweeping. There are no.provisions to govern any transition period.
The southeast corner of Florence and Ivy has 600 feet of paving --other areas
cannot be swept._
Transit
See Exhibit SP-2A Map, Exhibit SP--2B, and attached Fresno Transit Map, provided
by the City of Fresno Transportation. Department,
Parks and Recreation
The following information was provided by the City of Fresnor Parks and Recreation
Department.
The proposed Church -Elm No. 3 Annexation area is presently served by the following
Park and Recreation facility and services;
1. The neighborhoodparkpark needs of the project area are currently
being met by two existing facilit es
a. Hinton Community Center
2355 South Fairview
b. Frank B. Ball Playground
759 "A" Street
Both areas are located within one mile of the project area.
2. Roeding Park will provide regional park needs for the
project area.
3. No additional construction of facilities will be required.
An additional six acre parksi.te is being constructed adjacent
(north) of Hinton center and will . be completed by approximately
1985.
4. No special problems are anticipated in providing parks and
recreation services for the proposed annexation area.
Flood Control
See' Exhibit SP-31 Letter from Fresno Metropolitan Flood Control District.
Animal Control
There are no differences in the level of animal control.services provided by
the Society for the Prevention of Cruelty to Animals throughout the Fresno
Metropolitan Area.
Utility Tax
The city's 4.6 percent utility tax will be applicable to,all natural gas, electric

This correspondence serves as the Flood Control District's
response to information requested in conjunction with the
service plan of each of the subject proposals. In an effort
to expedite our response, that information of a common nature
to all of the subject proposals shall be provided ,by general
comment. Information relating to a single proposal shall be
provided as such.
The :service delivery system of the Fresno Metropolitan Flood
Control District is ide�it f .ed within the legislative respon-
sibilities of the District. These responsibilities are gen-
erally divided into three basic -hypes of services. First and
foremost, is flood: control protection of the lands within the
District. This responsibility entails the protection of
District ,lands from the intrusion of flood graters from the
foothills region. Secondly, the District is responsible for
the 'provision of urban storm drainage services' as certain
lands are converted to urban uses. This is a totally separate
service of the District from that of flood control. Finally,
the District's service systementails the conservation of
flood and storm. waters.
The timing of construction of urban drainage facilities is
heavily dependent on the rate of development within a partic--

cular watershed and the availability of capital improvement
funds. Generally these facilities are constructed through
-
ono of two funding methods participations is ' effected either
at the time of development through the drainage fee ordinance
of the City or County, or through the formation of an assess-
ment district. These fees are collected on all metropolitan
area development,, whether inside or outside of the District.
Because the drainage fees and assessments' tinance the urban
drainage system, said fees and assessments are determined on
the basis of land use and area. Such fees or assessments
represent a one-time contribution to the construction cost of
the urban drainage system serving thewatershed in which the
parcel, being charge. is located.
In addition to the above infoxmationt all of the subject
annexation and reorganization proposals are within the bound-
aries of the Flood Control District. The following g information
relates to each ,proposal individually.
Woodward --Chance No. 3
The Woodward -Chance No. 3 Annexation is located in,Drainage
Zone "GG." Although permanent dra.inage�services are not
currently available, the basin facility was recently acquired
by the District and is included within the boundaries of the
annexation. After fencing of the basin site, it shall be
available for excavation and shall provide permanent. service in
conjunction with the construction of the collection system.
Nees -Fresno No. 2
The Nees -Fresno No. 2 is located on the extreme southern
portion of Drainage Zone "GW.`t The basin site serving this
area is located at Nees. and Fresno ,Street and is undergoing
excavation in conjunction with development activity occurring
within the watershed. The adopted master plan envisions storm:
water collection through surface flows
Holland --Marks No.. 3
The subject proposal is located in Drainage Zone 'IA":and on
permanent service
Barstow --Fourth No
The subject proposal is located in Drainage Zone `P and on
permanent service.
Weldon -First No 3
The Weldon -First No. 3 Annexation is located in Drainage
Zone "CC." The basin site serving the subject proposal ,is

located on the rust side of the Santa: Fe railroad tract along
the Floradora allignment. The sub'eot area is not receiving
permanent drainage service; there is no ,ray of knowing at this
time when permanent service may be available.
f----Ch.urch-Elm No. 3 District Reorganization
The Church --Elm No.. 3 District Reorganization proposal is located
in Drainage Zone '!1I--1." The area is served by permanent drainage
facilities by a collector system in Grove Avenue and Church
Avenue. The storm water is deposited in the 11-1 basin site
located on the south side of Church Avenue adjacent to and east
of George Carver School.
Church -Walnut No 3 District Reorganization
The subject proposal is located, in Drainage Zone 'ITT." The basin
site serving that area 'south of Grove Avenue is located along
Grave Avenue approximately 500 feet west of Walnut Avenue.
