A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO RELATING TO THE ABATEMENT OF PUBLIC
NUISANCES AND .ASSESSMENTS FOR THE COST
THEREOF PURSUANT TO THE WEED ABATEMENT PRO-
VISIONS OF THE GOVERNMENT CODE OF THE STATE
OF CALIFORNIA.,(Supplement to Resolution
79-257.
WHEREAS, on January 30, 1979 and April 31 1979 this
Council, by Resolutions No 79--37 and 79-»125 declared the
fact of public nuisances on certain properties, and on April
17 1979 heard alb. objections to the abatement thereof, and
by Resolution No. 79-157, ordered that said nuisances be abated,
and also empowered the Purchasing Agent of the City of Fresno
to contract for the removal of the weeds that constitute the
nuisance on said properties; and
WHEREAS, on June 26, 1979, this Council by Resolution
79-257 confirmed the report of the Fire Marshal and authorized,
special assessments against the respective lots and parcels of
land as set forth in Exhibit "A," attached thereto; and
WHEREAS, the Fire Marshal desires to supplement his report
confirmed by Resolution 79-257 by adding Exhibit "B-., " attached
hereto and made a pant hereof; and
WHEREAS, the Fire Marshal of the City of Fresno has abated
said nuisances and reported to this Council the costs thereof
as appear on Exhibit "B" and duly posted said itemized report
for a period of at least three days on or near the door of the
Council Chamber, City Hall, Fresno, California; and,
WHEREAS, this Council, has heard all objections, if any,
to said. report;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF FRESNO
SECTION 1. That said report of the Fire Marshal' is hereby
confirmed, pursuant to the authority crested in the Council under
Section. 39576 of the Government Code of the State' of California,
SECTION 2. That the various amounts appearing in Exhibit
"B, f" attached hereto and made a part hereof, shall constitute
special assessments against the respective lots and parcels of
land, and, as .herein confirmed, shal.l constitute liens on such
property for the amounts of such assessments.
SECTION 3. That a. copy of said report as herewith confirmed
shall be transmitted to the Fresno Counter Tax Collector and the
Fresno County Assessor, who are hereby expressly authorized to,
assume and discharge the duties of collecting such special
assessments by adding the amount of the respective assessments
to the next regular bill for taxes, for municipal purposes
levied againstthe lots and parcels of land in Exhibit "B..
and thereafter such amount shall be collected at the same
time and in the same manner as ordinary municipal taxes are
collected and shall be subject to the same per.alities and the
same procedure under foreclosure and sale in case of delinquency
as provided for ordinary municipal taxes. On or before July 4,
1979 a certified copy of said report shall be filed with the
Fresno County Auditor.
SECTION 4. Except as supplemented. herein:, Resolution
No. 79-257 shall remain in full force and effect.
