RESOLUTION NO. 7 9-281
RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO SUPPORTING
THE APPLICANT'S APPLICATION TO THE FRESNO LOCAL AGENCY
FORMATION COMMISSION IN THE MATTER: OF THE PROPOSED TEAGUB-
MILLBROOK NO 3 DISTRICT REORGANIZATION, INCLUDING THE DETACH-
MENT OF CERTAIN TERRITORY CONSISTING OF 142.4 ACRES FROM THE
MID VALLEY FIRE PROTECTION DISTRICT AND THE ANNEXATION OF SAID
TERRITORY TO THE CITY OF FRESNO
WHEREAS, this proposal is made pursuant to the District Reorganization
Act of 1965 contained in Division. 1 of Title 6 (commenczng with Section; 56000)
of the California Government Code and
WHEREAS, the nature of the proposed change is e reorganization consisting
of the detachment of certain territory consisting of 142.4 acres and herein-
after called the "subject territory from the Mid Valley Fire Protection District
and the annexation of the subject territory to the City of Fresno; and
WHEREAS,, no other counties, cities, or districts are affected; and
WHEREAS, the subject territory proposed to be detached from the Mid Halley
Fire Protection District and annexed to the City of Fresno, and described in
Exhibit "A", and graphically depicted upon the map marked habit "B", by these'
references made a part of this resolutioyx is uninhabited; and
WHEREAS the property owner has submitted an application for environmental
assessment related to the subject territory to the Fresno Counter Planning Depart-
ment for review and final determination; and
WHEREAS, pursuant to the requirements set forth in Government Code Section
3S1.02 , a service plan for the subject territory has been prepared and said ser-
vice plan is attached hereto as Exhibit'IQ",, and by this reference made part of
this resolution. and
WHEREAS, all information and findings, regarding the subject proposal, includ-
ing the service plan., were prepared by the property owner; and
WHEREAS, all of said information, findings and service plan were reviewed
by City staff and found to be adequate for annexation purposes; and
Ti1HEE:t AS, no new districts are proposed to be farmed by . this reorganization;
and
WHEREAS, : the Fresno County Assessor's roll will: be used for the purpose of
levying any assessments or taxes on the subject territory; and
WHEREAS., the subject territory proposed to be annexed to the City of Fresno
shall be exempt from taxation for the payment of principal or interest, or any other
amounts which shall become due on account of any outstanding bonded indebtedness in-
curred by the City prior to the effective date of such annexation; and

WHEREAS , upon completion of this reorganization proposal, the subject
territory will be included in Municipal pond. Area "D" and will not be taxed`
for any existing bonded indebtedness or contractual obli,ga:tionsl and
WHEREAS, the reasons for this proposed reorganization are stated as
follows;
1. Annexation of the subject territory to the City of Fresno will result
in improved land use; planning. All private development controls of the
City will apply following annexation
2. The subject territory is 'within the City of Fresno's Sphere of Influence,
3. The applicant has filed an application requesting annexation to the
City of Fresno with the Fresno Local Agency Formation Commission, and the
City encourages- annexation of the subject territory.
4. The consolidation of the subject area into one detachment annexation
project is beneficial to the affected governmental processes and the resultant
City and district boundaries.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno approves
of the proposal to :annex said territory to the City and hereby requests that pro-
ceedings be taken by the Fresno Local Agency Formation Commission for the herein:
proposed Teague-Millbrook No.3 District Reorganization, including the detachment
of the subject territory, consisting of 142.4 acres from the Mid Valley Fire
Protection District and the annexation of the same territory to the City of Fresno.

TEAGUE-MILLBROOK NO. 3 DISTRICT REORGANIZATION
SERVICE AND IMPROVEMENT PLAN
This service and improvement plan has been prepared in accordance with
the requirements set forth in the Local Agency Formation Commission's
"City Change of Organization or Reorganization application" (section
35000/56000 et. seq. California Government Code) The purpose of this
document is to provide summary information regarding the availability of
municipal services and. how they will be provided to the area proposed for
annexation as annexation occurs. Where appropriate, the financing and placement
of such services as discussed. Each service is discussed considering existing
conditions and adopted city plans and policies.
The information: provided herein is principally bused upon 'written .responses
from the concerned city departments, public agencies and special districts.
All written correspondence has been filed with the City of Fresno Planning
Department and is available for inspection

PROJECT LEGAL. DESCRIPTION AND !'ttRAP
PROPOSAL SUMMARY
This proposal is to annex the subject area to the City of Fresno and detach
the area from the Mid Valley Fire District'. The proposed district reorganization
consists of approximately 142. 4 acres generally located at the south east
corner of the intersection of East Teague and North Millbrook Avenues.
The subject area as proposed comprises 11 separate parcels with 10 of these
parcels contiguous to the City of Fresno and LAFCC3 approved annexation
areas. The City of Fresno bounds the subject area on the northern,
western and southern boundaries. The entire area falls within the City
of 'Fresno's Urban Growth Management area and is subject to the U GM process
The current zoning in the area is interim A-2 and RA with current land
uses of single family residential and agricultural (open land, pasture and
orchards)
The City of Fresno's Woodward Park Community Plan proposes low to medium -
low single family residential uses for the subject area. The general area is
of marginal value as farm land (storie index ratings of 23 to 2) and is
experiencing greater and greater urbanization consistent with the City's
community plan.
SEWER,SE1 iICE
City sewer;., service is available to the subject area from the sewer main located
in North Miilbrook Avenue. This 24 inch rain runs the full length of the
proposed annexation. Additional sewer service is available along the northern
boundary in Teague Avenue. The main extension required for City fire
station No 13 is to be installed within the next six months and will be funded
by the fire station developer. ' In the event of further development, all
required main extensions, frontage connections and other appropriate fees
and charges will be the responsibility of the developer.
Properties presently, served by City sewer service will have no changes in
this service. Currently, there are no City service connections within the
subject area. Attachment no. 1 is a City of Fresno sewer service rate
schedule that would be in effect if such connections are made. There are no
special problems or considerations anticipated in providing sewer service to
the area proposed for annexation.
WATER SERVICE
City grater service is available from a: 12 inch water .main that runs the full
length of the subject area along Forth Millbrook Avenue. Additional water
service is 'available along Teague Avenue, The main extension required for
City fire station no. 13 is to be `installed within six months and"will be
-funded by the fire station developer. In the event of further development,
,all required main ext morons, frontage connections and other appropriate fees
and charges will be the responsibility of the developer.
Fire hydrants will be installed by the developer at a spacing not to exceed
600 feet in residential areas and 450 feet in commercial and industrial areas
on those developments served by the City water system. No change in the
number or location of fire hydrants will occur as a result of this district
reorganization.
Properties presently receiving City water service will have no changes in this
service. Currently, here are no City water connections within the subject
area. Attachment no. 2. is a City of Fresno water service rate schedule that
Weald be in effect if such connections are made. There are no special problems
for considerations anticipated in providing water service to the subject area.
FIRE PROTECT ION
The area in the proposed annexation is currently receiving fire protection
services from the Mid Valley dire Protection District station no. 20 located
on East Herndon Avenue near the intersection of north First Avenue. `t'hia
station is approximately 1.5 miles southwest of the subject area
Upton annexation to the City of Fresno, the area will be served by Fresno
City Fire Department station no. 13, located at bast Nees and North Bong
Avenues which is adjacent to the subject area. This station is currently
under construction and is scheduled for completion in August of this your.
Prior" to the completion of station no. 13, the area will be served by »station
no. 11 located at North Fresno and Fast. Wrenwood .venues', which is,
approximately 3.2 miles from the nearest point of the proposed annexation
area and approximately 3.9 miles- from the farthest point. `.'here are; no special
problems in providing fire fighting service at the present time.
The Fresno City Fire Department has iritated that this annexation would be
of advantage to the residents of the area due to the close proximity to the
soon -to -be completed station no. 13

PARAMEDIC SERVICE
Paramedic services are currently being provided by the Fresno Fire Department
Station no. 11, located approximately 3.2 wiles from the subject area. The
service is provided 'under agreement with the Mid Valley Fire District and
the Fresno City Fire Department. Upon annexation, station no. 11 will
continue to provide paramedic services to the subject area. After completion
of the City's fire station no. 13 at East flees and North Bond Avenues,
adjacent to the subject area, emergency rescue service will be provided by
the crew at this new station. Station no. 13 staff will respond to emergence
cads and provide emergency rescue service until paramedics from station
no, 11 arrive.
POLICE PROTECTION
The project area presently receives police protective services from the Fresno
Sheriff's department and traffic enforcement services from the California
Highway Patrol. Upon consummation of annexation proceedings, both service
responsibilities Will
be assumed by the Fresno Police Department.
The proposed annexation abuts existing Fresno Police Department service
boundaries on the northern and western most edges. As a result, the
geographic location of the .project (does not pose a substantial hindrance to the
extension of police services. The demographic features of the area indicate
that a m1n1ma4 number of calls for service: will be generated upon initial `
annexation, It must be noted, however, that residential and/or commercial
devealopment in the annexed area will significantly impact police service delivery.
Although the proposed annexation does not singularly constitute a significant
influence on the ability of the Police Department to service the area, another
factor must be crnsidered relative to the present service deliverer capa-
bilities of the Department.
The City of Fresno is, or soon will be, processing the following projects for
annexation:
Alluvial -Blackstone No.
Barstow -Fresno No.
Nees -Fresno No. Z-
Barstow -Fourth No. I
Bullard -Blackstone No.
Alluvial -Fresno No. 1-A
Teague -Cedar No. 4-A
All of these proposed annexations are located in the area east of Blackstone and
north of Shaw. This area is, generally serviced by one or two "beats" which
are presently operatingat, a saturation level without the addition of -any of
these projects. As a result, the annexation of projects in this area will
immediately result in a slight service level reduction until the modification
of existing deployment patterns and the addition of personnel are accomplished,
The Urban Growth Management process, ultimately, will provide sufficient
funds from development in the area to extend the laity -wide level of police
services to this proposed annexation
PARKS, AND RECREATION
The parks and recreation needs of the proposed annexation area will be met
through the acquisition` and development of a parksite at the north west
corner of forth Milibrook and East Teague Avenues, which is adjacent to the
subject area. Additional recreational facilities are also available at the Fort
Washington Elementary School and =the Clovis- Vest High School. Clovis
West thigh School has lighted tennis courts, an olympic swimming pool, outdoor
basketball courts and large open areas with baseball diamonds available for
use. Fort Washington Elementary School also has outdoor basketball courts
and a iarge opera area with baseball diamonds.
The Parks and Recreation Department of the City of Fresno proposes the
design of the 9.95 acre Millbrook-Teague Neighborhood parksate in fiscal
f year 'i 979- 80. The parksite is currently scheduled for completion in fiscal

year 1983--84 contingent upon the availability of capital improvement funds.
Once; the parksite is developed, the departments' standards for the subject
area will be met.
The areas regional park needs are currently being met and will continue to be
met by Woodward park.
STREET IMPROVEMENTS
The Woodward Park Community Plan designates East Teague and North
hlillbrook Avenues as collectors and East Nees Avenue as an arterial. In the
event of development, East Teague and North Millbrook Avenues will require
expansion from the existing two lane country roads into four lane undivided
streets, with concrete curbs, gutters, and sidewalks to meet City of Fresno
standards. East Nees Avenue will require expansion from the existing two
lane,country road into a four lane divided roadway with traffic signals at
half -mile intersections with major streets. .All of the streets surrounding
the subject area will require the dedication of additional rights -of -way as
well as permanent pavement and concrete improvements. !pity standards

provide the following with regard to steet development; 1 ) Arterial Street
1001 to 106' of right -cif -way, 4-lane divided roadway; 2) Collector Street -
84' to 84' of right-of-way, 4 lane undivided roadway; 3) Local Industrial
Street - 64' of right-of-way, 2 lane undivided; 4) Local Residential Street -
60' of right-of-way, 2 lane undivided. There are no current !alms for
street Improvement projects within the subject area.
It is the property owner's responsibility upon development of the property
to install at his expense the adjacent curb, gutter, sidewalk and 181 of
paving in addition to dedicating right-of-way necessary for widening the
street from the current to the ultimate width.Further, it is the property
owner's responsibility upon development to install those improvements required
in the UGVI Service Delivery flan.
The City will become responsibile for maintenance of all existing pavement
marks on public streets upon completion of the annexation. New boarder
streets will be maintained in accordance with existing multi -agency agreements
for these services.
The City will become responsible for maintenance of all existing public _
street signing. Street name sign replacement to conform to City standards
would be programmed within: a five (5) year program.'
The City will become responsible for programming the installation of new
traffic signal, using existing warrants, priority, and scheduling processes.
All annexed traffic signals now existing will be maintained and operated by
the City in conformance with existing multi -agency agreements where equipment
is shared with another agency.

STREET LIGHTING
Upton development of the subject area, the developer will be responsible for
the installation of interior street lights. The exact number and location
wilii be determined at the time the specific development proposals are reviewed,
The. City will prepare master street lighting plans for the new, City areas in
cooperation with P.G,&E. to facilitate the scheduling of installation of
temporary (wood pole mounted) lighting by the utility company. However,
no lighting of this type will be installed where the new areas are served by
underground electrical equipment or where the area is situated in a
designated "Underground Utility, District".
Existing street lighting energy and maintenance costs will became the City's
responsibility, including special districts ,for street lighting.
PUBLIC TRANSIT
Fresno City Transit route numbers 34 and 38 are the nearest existing transit
service routes to the area proposed for annexation. Route No 34 runs
from downtown to First Street, passes Fashion Fair, St. Agnes Hospital to
Alluvial, to Pinedaie. Then returns by the same route. RouteNo. 34
has the following bus stop locations near the subject area
.Southeast corner of First and Alluvial; curb and sidewalk.
North side at 336 E. Alluvial.
South side at 336 E. Alluvial.
Southwest corner of First and AlluvsL
Route No. 34 operates fifteennninute' service during the peak hours on weekdays;
thirty minute service during the non -peak hours can weekdays and all day
Saturdays, sixty minute service on Sundays and holidays.

Route No. 38 runs from downtown to west Fresno, Caiwa to St.; Agnes
' Hospital vxa Cedar Avenue} Then returns by the same route. Route No.. 88
has the following bus stop locations near the subject area,
St. Agnes Hospital Parking, Lot shelter, curb and sidewalk
Northeast corner of Herndon and Allillbrook; curb onlyF
Southwest corner of Cedar and Herndon; shelter, curb and
sidewalk.
Route No. 88 operates twenty minute service on weekdays; thirty minute
service on Saturdays; and sixty minute service on Sundays.
Handy ride does not serve this area.
The Fresno City 'Transit District currently has no plans to expand services
to provide more convenient service to the subject area. However, they
anticipate no specific problems in providing service in the :area.
SOLID WASTE DISPOSAL,
Upon annexation of the proposed area, City waste disposal services will
become available to the residents and property owners. State: law provides
that private waste disposal :services may continue for a period of up to five
years from the date- an area is annexed to the City* providing these services
meet the three conditions listed below. Otherwise, service must be obtained
from the City°s Waste Disposal Division. 1n any event, conversion to City
waste disposal services must occur within five years of the c#late of annexation.
Conditions
1 The company must have been licensed by the County of
Fresno for a minimum of three years
2. A customer cannot change from one disposal company to
another. He may only change to the 'City's waste
disposal service.
3 The quality: and frequency of services of the private
company must meet the standards required by the
City of Fresno.
There will be no change required in solid waste disposal service in the
subject area at the time of annexation unless requested by the resident.
Additionally, there will be no additional cost or City tax as a result of
annexation.
FLOOD CONTROL
The Fresno Metropolitan Flood Control District is responsible for providing
two basic services in the subject area. First and foremost, is flood control
protection of the lands within the District. This responsibility entails the
protection of District lands from intrusion of flood waters from the foothill
region. Secondly, the district is responsible for the provisions of urban
storm drainage services as certain lands are convered to urban uses.
The timing of construction or urban drainage facilities is heavily dependent
on the rate of development within a particular watershed and the availability
of capital improvement funds. Generally, these facilities are cnstructed
through one of two funding methods; either at the time of development through
drainage fee ordinate of the City or County, or through the formation of an
assessment district. These fees are collected on all metropolitan area
development, whether inside or outside of the District. Because the drainage
fees and assessments finance the urban drainage system, said fees and
assessments are determined on the basis of land use and area. Such fees or
assessments represent a one --time contribution to the construction cost of the
urban drainage system serving the watershed in which the parcel being
charged is located. -

The proposed annexation area is located in planned drainage zone "CX"
Only that portion of the area located "test of Milibrook Avenue is located within
the boundaries of the Flood Control District.
Current master Manning envisions the collection system to extend as far
north as the Cole Avenue alignment and as far East as Willow Avenue. The
collection system shall carry the storm water to a ten -acre basin site
currently proposed north of East bees Avenue between North Millbrook and
Cedar Avenues. The basin facility is not under the ownership of the Flood
Control District and is not budgeted for acquisition.
STREET SWEEPING
Street. sweeping services will be provided to the subject area upon,,annexation
conditioned upon the installation of permanent paving, concrete curbs,
gutters and. sidewalks,
ANIMAL CONTROL
There are no differences in the level of animal control -services provided by
the Society for the Prevention of Cruelty to Animals throughout the Fresno
Metropolitan Area.
UTILITY TAIL
The City of Fresno's 4.6 percent utility tax will be applicable to all natural'
teas, electricity and telephone bills.
PROPERTY TAX
With the passage of Proposition 13, there is no difference in City of Fresno and
County of Fresno property taxes. Thus, there will be no increase in property
tax to the property owner clue to annexation to the City of Fresno. �

Revised Rates Effective July 1, 197+_ SEWER SERVICE CHARGE
(A) Premises Within the City. The monthly sewer service charge for use of the sewage system
and treatment facilities by premises located within the city shall be as follows:
(1) A flat rate of two dollars and forty cents ($2. 40) per living unit, except as
provided in subdivisions: (2) and (3) of this subs' coon=
(2) For living units served by a common water meter and operated exclusively as
housing for the aged by a nonprofit corporation having a welfare exemption `issued by the
State Board of Equalization, pursuant to Section 214 and Section 254,E of the California
Revenue and Taxation Code, the rate shall'- be two dollars and forty cents (2.40) for the
first unit and one dollar and ninety-five cents ($1Q95) for'each additional luring unit.
(3) For multiple living units located on a single premises ane- rented or leaned or
available for rent or lease, the rate shall be two dollars and forty cents ($2.40) for the
first unit and two dollars and teen cents ($2, lo) for each additional 'l i`ving unit.
(4) For industrial users and other groups of users (other than living units) as may
be designated by the Director, such as restaurants, car washes, laundries, hospitals and
markets-,. which have at any time during the year sewage effluent volume of more than
50,000 gallons per day, or BOD greater than 120 mg/l, or Suspended Solids greater than
80 mg/11, the rate for sewage shall be 7.4� per 100 cu. ft of metered potable water (or
8.2t per 100 cu. ft. if sewage effluent is metered) plus, in either agent, an additional
charge of 2.5t per pound for each pound of Biochemical Oxygen Remand required, and are
additional ,charge of 2,2� per pound for each pound of Suspended Solids produced,

(1) For industries and commercial users discharging waste which is suspected by,
the Director to be above ` 120 mgll' SOD or $4 mg/I Suspended Solids, 'hereinafter referred
to as high strength sewage, the Director shall make, within each billing period, at
least three measurements of waste strength. Composite samples of a waste which varies
greately in strength may be required by the Director. Tests and measurements shall be
made as required with testing performed in accordance with Standard Methods. The strength
for billing purposes shall be the average of the six most recent analyses. Where an
industry operates on a seasonal basis, charges will be based upon anal yses made during
the appropriate season.
(2) When requested by the Director, an industry which has high strength sewage
must provide an observation manhole for sampling sewage. The manhole shall be maintained
In a safe manner, satisfactory to the -Director. Access to the manhole shall be provided-
at all times,
(3) Users that contribute high strength sewage to the sewer system may be required
to provide effluent meters, traps, screens, catch leasing and such other pre-treatment as
may be deemed necessary by the Director to prevent adverse effects on the city sewer
system or the sewage treatment processes and equipment'
