RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO MAKING
APPLICATION FOR APPROVAL OF PROPOSAL To INITIATE THE
ANNEXATION OF TERRITORY DESIGNATED THE HOLLAND-MARKS
No. 3--B ANNEXATION
WHEREAS, pursuant to the Municipal organization Act of 1977, beginning
with Section 35000 of the Government Code, the Council desires to annex the
hereinafter described territory to the City of Fresno in order to promote
the .logical formation and determination. of City boundaries and to encourage
orderly growth and development which are essential to the social, fiscal:, and
economic well-being of the city, and
WHEREAS, the territoryherein proposed: to be annexed is designated the
Holland -Marks No. 3-B Annexation and consists of that real property situated
in the County of Fresno, State of California, the boundaries of which are spe-
cifically described in Exhibit "All attached hereto and incorporated herein: by
this reference and more particularly depicted upon a map marked Exhibit "B"
attached hereto and incorporated herein by this reference, and
WHEREAS, pursuant to the requirements set forth in Government Code Section
35102, a service plan for the subject territory has been prepared and said ser-
vice plan is attached hereto as Exhibit "C" and, by this reference, made wart
of this resolution.; and
WHEREAS, review of the environmental assessment related to said annexation
project resulted in a Categorical Exemption by the Evaluation; Section of the
Department of Planning and Inspection of the City of Fresno; and
WHEREAS, an informational letter explaining the ramifications of annexation
will be mailed to all property owners within the ,subject territory at the time
of filing with the Fresno Local Agency Formation Commission; and
WHEREAS, the Council finds that the territory contained in the proposal:
a Does not exceed 100 acres in area and such territory constitutes
the entire unincorporated island of territory
b , Is surrounded by the City of Fresno which is proposing the annex-
ation;
c. 3s substantially developed,
d, is not prime agricultural land as defined in Section 35046; and
e Will benefit from such annexation and is receiving certain bene-
fits from the City of Fresno.

Consists of Rancho Sequoia tract, lying in Section 13, 13/19j M.D.M.
BEGINNING at the Northeast corner of Rancho Sequoia tract, according
to the map thereof, , filed in the Office of the County Recorder March
25, 1959 and recorded in Volume 19 of the Plats, at page 67, Fresno,
County Records, said Northeast corner being on the East line of
Section 13, Township 13 South, Mange 19East, Mount Diablo Meridian,
aS said Section is shown on the United. States Township Plats, said.
Northeast corner being 1320.32 feet North of the ,South.east comer
of said. Section 13 being also, a point on the existing City Limits
of the City of Fresno; thence Westerly along the North line of said
Rancho Sequoia tract, being also, along said existing City Limits,
to the. Northwestcorner of said. Rancho Sequoia tract; thence Southerly

.The purpose of this document is to provide a summary of information regarding
how municipal services will be provided to the subject territory should
F annexation to the. City occur, when such municipal services would be available,
E any modifications to be made to existing facilities and how such facilities
will be financed.`
The Service Plan has been prepared in accordance with the requirements of
Government Cade Section 35102. It consists of responses from the fallowing 'City
degartmentsz Planning and Inspection, Public Works, Finance, Parks "and Recrea
tion, Police and Fire Protection, and from. the Fresno Metropolitan Flood Control
District. Copies of the original responses from the above -mentioned sources use
available for inspection with; the City's Urban. unification Team. Requests to`
examine the original response should be directed to Mr. Ed Bielicki., 488--1567.
The information provides an enumeration and description of the services to be
extended to the affected territory and the level and range of such services.
The proposed Holland -Marks No.3 B annexation consists of the annexation of 19.11
acres, containing 65 parcels, to the City of Fresno. The project area is
exempt from the U.G.M. process. The subject territory is an entirely surrounded
county island and is proposed to be annexed to the City of Fresno as inhabited
territory by virtue of Government Code Sections 35150(f) and 35013.
The subject territory is well within the City's Sphere of Influence, generally
located southwest of N. Marks and W. Holland Avenues. Existing land use consists
of 64 single family dwelling units.
The adopted 1974 FCMA General Plain indicates the subject properties are, appropriate
for medium .low density residential uses. The adopted Bullard Community Plan in-
dicates the properties are appropriate for medium density residential uses. The
entire area is presently zoned R.-A.
SEWER SERVICE
The following map and information were provided by the City of Fresno Department
of Public Works and Finance
The subject territory is served by the City of Fresno sewer system. This area is
located within Assessment District #169. No modifications will be required to
continue to provide the present level of service. See the attached map, Exhibit
A-1, for location and size of sewer mains. Upon annexation, the monthly resi-
dential sewer service rate of $2.40 will apply with a savings of $1.20 per month
per residence.
WATER SERVICE
The following information was provided by the City of Fresno Departments of
Public Works and Finance.
The subject territory is being served by the Rancho Sequoia Water Company. How-
ever, the City is presently in process of purchasing this water company. See the
attached maps,, Exhibits B--1,'and B-2.for location and size of water mains plus
the plans for water main extension. The main extensions will occur within
30 days by the City upon acquisition at no cast to property owners.. Water rates
are currently $6.15 per month. 'here has-been a proposal to increase water
rates to $10.00 per month. Should the annexation and the purchase of the
private water company be completed, water would be billed on a flat rate basis
depending on area size. There are 64 services, with the average lot being
approximately 91000'square feet which would be billed. at $5.00 per month.

FIRE PROTECTION
The following information was provided by the City of Fresno, Pi.re Department.
The subject area is presently receiving fire protection from North Central Fire
Protection District. Upon annexation to the City, the first response to this
area would be from ' `ire Station No.12 located at Marks and Acacia, which, is
approximately .5 miles from the nearest point and approximately .7 miles from
the farthest point of the proposed annexation., This station has a newly -
purchased pumper.
The second response station, would. be Fire Station No.0' located at East Andrews
and North West .Avenue, which is approximately 2.1 miles from the nearest point
of the proposed annexation and approximately 2.3 miles from the farthest point.`
This station also responds with a pumper.
Paramedic response would come from Fire Station No,11 located at North Fresno
Street and East Wrenwood, which is approximately 4 8 miles from the Annexation.

The area is located in the Rancho Sequoia Water District. The hydrants in this
F area are of sufficient number and properly spiced,, although they are of the
"wharf" type and have only a 2-1/2 inch opening and therefore should be re-
placed with the type that is used by the City. See Map, Exhibit SP-I
ANALYSIS
This annexation would provide better fire protection in this area due to the close
proximity of City Fire Station No.12 and the existing water supply.
Future paramedic response for this general area is now in the planning stage.
POLICE PROTECTION
The following information was provided by the City of Fresno, Police Department.
The island territory, proposed for annexation is surrounded by areas currently
receiving police services. Consequently, the addition of this territory will not
impact existing police service delivery plans for this area. Furthermore, it is
anticipated: that calls for service will not increase significantly by this
annexation to affect current police work loads and response times.
STREETS
The following information was provided by the City of Fresno, Public Works
Department.
In accordance with Major Streets and Highways Plan, the projected. status Un-
cl.uding street name, width, number of lanes, and type) of all streets within
or adjacent to the project area.
See attached map, Exhibit,, C-1, C,--2. City standards provide the following with
regard to _street developments
1. Arterial.. street, 100' to 106' of right—of-way, 4—lane divided roadway;
2. Collector street, 80' to 84' of right -of --way, 4--lane undivided roadway;
3. Local industrial street., 64' of right -of --way,, 2-Lane undivided
4. Local residential street, 60' of right—of—way, 2—Lane undivided*
All streets not shown on attached map, Exhibit. C--1, Cr2, are to be con-
sidered Local streets;
Marks Avenue is classified as an arterial street and the remaining are all local.
streets;
There are no currently planned street projects for this area.

Any curbs, gutters, additional right-of-way, permanent pavement, sidewalks, etc.,
the property owners/'developers would be required to install/provide (including
the measurements :and location for right -of: w. ay) , as well as,? timetable, and the
financial responsibilities for any of the above.
It is the property owner's responsibility upon development of the property to
install at his expense the adjacent curb, _gutter, sidewalk and 18' of paging in
addition to dedicating right-of-way necessary for widening thestreet from the
current to the ultimate width.
STREET LIGHTING/TRAFFIC SIGNALIZA� TION
City will prepare master street lighting plans for the new City areas in
cooperation with PG and E to facilitate the scheduling of installation of
temporary (wood pole mounted) lighting by the utility company. However, no
lighting of this; type where the new areas are served by underground: electrical
equipment or where the area is situated in a designated. °'Underground. Utility District.`#.
Existing street lighting energy and maintenance costs will become the City's res
ponsib lityY including special districts for street lighting
STREET MARKING
City will become responsible for maintenance of all existing pavement marks on
public streets upon completion of annexation. Now border streets will be main-
tained in accordance with existing multi. -agency agreements for these services.
STREET SIGNING
City will become responsible for maintenance of all existing public street sign-
ing. Street name -sign replacement to conform to City standards would be pro-
grammed within a five -yeas (5) program.
TRAFFIC SIGNALS
City will become responsible for programming the installation of new traffic
signal., using existing warrants, priority, and scheduling processes. All
annexed: traffic signals now existing will be maintained and operated by the City
in conformance with existing multi -agency agreements where equipment is shared
with another agency.
SOLID WASTE DISPOSAL
The subject territory is now being served by a private waste disposal. company.
Upon annexation the City of Fresno will provide this service in accordance with
Section 35005 of the Government Code, Peat 2, Division 5, Chapter 2.7,
Section 4272 of the Health and Safety Code. Following annexation notice will be
sent to the private company that the area is annexed to the City and that the
above -mentioned Government Code applies.
STREET SWEEPING
There are no street sweeping services provided to the area at this time. There
are 3,250 feet of existing curb miles. city of Fresno will provide future street
sweeping. There are no provisions to govern any transition period.
TRANSIT
See Exhibit SP-2A, Map, Exhibit SP-2B, and attached. Fresno Transit Map, provided
by the City of Fresno Transportation Department.
PARKS AND RECREATION
The following information was provided by the City of Fresno, Parks and Recreation
Department.

Proposed Holland -Marks No. 3--B annexation area is presently served by the
following parks and recreation facility and services
1. The day -to --day playfield heeds of the project area are currently being met
by one existing facility.
a. Lions Neighborhood Park, Marks and Emerson Avenue. The area is
located within one mile of the project area.
2 Woodward Park will provide regional park needs for the project area,
3. No additional construction of facilities will be required
4. No special problems are anticipated in providing parks and recreation
services for the proposed annexation area,
FLOOD CONTROL
See Exhibit SP-3, letter from Fresno Metropolitan Flood Control District.
ANIMAL CONTROL,
There are no differences in the level of animal control services provided by'
the Society for the Prevention of Cruelty to Animals throughout the ,Fresno
Metropolitan Area.
UTILITY TAX
The city's 4,6 percent utility tax will be applicable to all natural gas,
electric and telephone bills
The actual cost of such tax can be'estimated by relating this tax rate to the
current utility bills.
PROPERTY TAB
Annexation to the City of Fresno will cause no property tax increase to the
property owner y

The following is in response to your mewrandUn of Februa .14, 1979 concerning the
subject proposed annexation,
1) Fresno Transit currently operates
a, Route No. 9 north and south on 'llarks Avenue between Shaw and
Ashlan Avenues, thence east on Ashlan Avenue to Hughes Avenue.

b. Route No. 41 crosstown on Shields Avenue, the west end of the
line at Ashlan and A1axks Avenues Route No. 41 operates only
eastbound between Poland and Marks Avenues, then southbound on
on Marks Axenue returning to Shields Avenue as a turn -around
loop.
Bus stop locations with improvements

South side east of, Feland - stop
1 west of Marks stop
Route No. 9 and Route No. 41. operate 14 hours per daY �bnda.y thru Saturday.,
with 30 minute headway, 12 hours per day on Sunday and holidays with
one hour headway. See attached schedules for ROUte Nos. 9 and 41,

3) The bus stop on the east side of Marks Avenue at appro,-dmtely ,Swift Avenue
will probably be moved Sher to the north to apprdmately the -entrance to

This correspondence serves as the Flood Control District's
response to information, requested in conjunction with the
service plan of each of the subject proposals. In an effort
to expedite our response, that information of a common nature
to all of the subject proposals shall he provided by genera.

The service delivery syst-em of the Fresno Metropolitan Flood
Control District is identified within the legislative respon-
sibilities of the District. These responsibilities are gen-
erally diyided into three basic types of services. First and
foremost, is flood: control protection of the .Lands within the
District. This responsibility entails the protection of
District lands from the intrusion of food waters from the
foothills region. Secondly, the District is responsible for
the provision of urban storm drainage services as certain
lands ar'e converted to urban uses. This is a totally separate
service�of`the District from that of flood control. Finally,
the District's service system entails the conservation of
flood and stormwaters

cular watershed and the availability of capital improvement
funds. Generally these facilities are constructed through
one of two funding methods, participation is effected either
at the time of development through the drainage fee ordinance
of the City or County., or through the formation of an assess-
mentdistrict. These fees are collected on all metropolitan
area development, whether inside or outside of the District
Because the drainage fees and assessments finance the urban
drainage system, said fees and assessments are determined on
the basis of land use and area. Such fees or assessments
represent a one --time contribution to the construction cost of
the urban drainage system merging the watershed in which. the
parcel being charged is located.
In addition, to the above information, all of the subject
annexation and reorganization proposals are within the bound-
aries of the Flood Control District. The fallowing information
relates to each proposal: individually.
Woodward --Chance No 3
The Woodward -Chance No. 3 Annexation is located in Drainage
Zone "ACC." .Although permanent drainage services are not
currently available, the basin facility was recently acquired
by the District and is included within the boundaries of the
annexation. After fencing of the basin site, it shall be
available for excavation and shall provide permanent.service in
conjunction with: the construction of the collection system.
Nees -Fresno No.
The.Nees-Fresno No. 2 is located can the extreme southern
portion of Drainage Zone "Cw. " The basin site serving this
area is located at Nees and Fresno Street and is undergoing
excavation in conjunction with development activity occurring
within the watershed. The adopted master plan envisions storm
water collection through 'Surfaceflow«

located on the east side of the Santa Fe railroad tract along
the Floradora allignment. The subject area is not receiving
permanent drainage service, there is no way of knowing at this
time when permanent service may be available.
Church -Elm No. 3 District Reorganization
The Church. -Elm No. 3 District Reoganization proposal is located
in Drainage Zone "TI-1 r The area is served by permanent drainage
facilities by a collector system in Grove. Avenue and Church
Avenue. Thq storm water is deposited in the II-1 basin: site '
located on the south side of Church Avenue adjacent to and east
of George Carver School.
Church -Walnut No. 3 District Reorganization
The subject proposal 1s located in Drainage Zone "°IT.11 The basin
site serving that area south of Grave Avenue is located along
Grove Avenue approximately 500 feet west of Walnut Avenue.
