HomeMy WebLinkAboutResolution - City Council - 79-279 - 1979-07-03Ruth Poultex Ed Bieli.cki RESOLUTION NO. 79r-279 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO MAKING APPLICATION FOR APPROVAL OF PROPOSAL TO INITIATE THE ANNEXATION OF TERRITORY DESIGNATED THE BARSTOtisi'--FOURTH NO. 1 ANNEXATION WHEREAS, pursuant to the Municipal Organization Act of 3377, beginning with Section 35000 of the Government Code, the council desires to annex the hereinafter described territory to the City of Fresno in order to promote the logical formbtion and determination of City boundaries and to encourage orderly growth and development which are essential to the social, fiscal, and economic well-being of the City; and WHEREAS, the territory herein proposed to be annexed is designated the Barstow -Fourth No. l Annexation and: consists of that real ,property situated y in the County of Fresno, State of California, the boundaries of which are spe- cifically described in Exhibit "A" attached hereto and incorporated herein by this reference and more particularly depicted: upon a map marked Exhibit "B" attached hereto and incorporated herein b y this reference; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan: for the subject territory has been prepared and said ser- vice plan is attached hereto as Exhibit "C" and, by this reference,, made part of this resolution; and WHEREAS, review of the environmental assessment related to said annexation project resulted in a Categorical Exemption by the Evaluation Section of the De- partment of Planning and Inspection of the City of Fresno, and WHEREAS, an informational letter explaining the ramifications of annexation will be mailed to all property owners within the subject territory .at the time of filing with the Fresno Local Agency- Formation Commission; and WHEREAS, the Council finds that the territory contained in the proposal. a; Does not exceed 100 acres in area and such territo�,y constitutes the entire unincorporated island of territory; b. Is surrounded by the City of Fresno which is proposing the annex- ation; c. Is substantially developed; d Is not prime agricultural. .land as defined in. Section 350461 and e will benefit from such annexation and is receiving certain bene- fits from the City of Fresno. The service plan has been prepared in accordance with the requirements of Government Code gection 35102. it consists of responses from the following City departments: Funning and Inspection, Public Works, Finance, Parks and Recreation, Police and Fire Protection, from the Fresno Metropolitan Flood Control. District, and from the Mid Valley Fire Protection District...Copies of the original responsess from the above --mentioned Sources are available for in- spection with the C ty's Urban Unification Team. Requests to examine the original responses should be directed to Mr. Ed Bielick.i, 488-1567. The inj!or-- mation provides an enumeration and description of the services to be extended to the affected territory and the level and range of such services. The proposed Barstow -Fourth No. 1 Annexation consists of the annexation of 89.30 acres consisting of 285 parcels to the City of Fresno. The project area is exempt from the UGM process. The subject territory is an entirely surrounded county island and is proposed to be annexed to the City of Fresno as inhabited territory by virtue of Government Code Sections 35150(f) and 35013 The subject territory is well within the City"s Sphere of Influence and consists of an area somewhat rectangular in shape generally bound by East Bullard Avenue to the north, East Barstow Avenue to the south, North Ninth Avenue to the east, and North Bond Avenue to the west. Existing land use consists of 275 single family dwelling units. The adopted 1974 FCMA General Plan indicates the properties are appropriate: for low density residential uses. The preliminary Hoover Community Flan indicates the subject properties appropriate for medium low density residential uses, The subject territory is presently zoned R-A, Sewer Service The following maps and information were provided by the: City of Fresno Depart- ments of Public Works and Finance. The subject territory is served by the City of Fresno sewer system. No mcdifica- tions will be required to continue to provide the present level of service!. See the attached map, Exhibit A-Ifor location and size of sewer mains, There are approximately 285 parcels in this area of which we have 271 billed for sewer at the residential rate of $7.20 bi-monthly. Should this area be arnexed4, sewer rates would reduce from $7.20`bi-monthly to $4.80 bi-monthly. 1 Water Service The following information was provided by the City of Fresno Departments of Public Works and Finance. Water is served by Fresno County Waterworks District No. 14 and: is billed at the rate of $12..00 bi-monthly for residential properties of 10,000 square feet or less. No, modifications will be required to continue to provide the present level of service. See the attached map, Exhibit B--1 for location and size of water mains, r Exhibit C Page I of 5 PageS ,.-De'st .r"`.'tR'�i ` n,-z��':f'.�C:...✓`r'iskL'^.fie44T ., ...s jam. • ' 4 Fire Hydrant Services --As development occurs, fire hydrants will be installed f' by the developer at a spacing not to exceed 600 feet in residential areas and 450 feet in commercial and industrialareas on those developments served by the City water system.'' No change in the number or location of fire hydrants will occur as a result of this annexation. k Fire Protection i The following information was provided by the City of Fresno Fire Department. The proposed annexation area is now being protected by Mid Valley Fire District. Upon annexation ~to the City, the area would be served by Fresno Fire Department Station No. 11 Located. at North Fresno Street and East Wrenwood Lane, which is approximately 1.1 miles from the nearest point of the proposed annexation area. and approximately 1.8 miles from the farthest point. This station is equipped with a pumper and ladder truck. All ladder trucks have paramedics as part of the crew. Backup response is provided by Fire Station No. 6 located at East Gettysburg and North Rowell, which is approximately 1.4 miles to the nearest point of the area and 2.1 miles to the farthest point. This station is equipped with a pumper. Water and Hydrant Service --The proposed annexation is presently being provided water service by Fresno county Waterworks District No. 14, The hydrants in the area would not meet requirements of the Fresno Fire Depart- ment. If additional hydrants or water supply is needed, the below recommendations are .suggested. Additional hydrants would be required approximately 600 feet apart and meeting Fresno Fire Department requirements as to fire flow for residential areas. Analysis This annexation would be advantageous to the residents due to the following reasons: The close proximity of Station No. 11 plus the complement of manpower and equip- ment that this station provides. The nearness of Station No. 6 as a backup response is also an asset to fire fighting in this area. Police Protection The following information was provided by the city of Fresno Police Department. The proposed; Barstow -Fourth No. 1 Annexation currently receives police protective services from the Fresno Sheriff's Department. Upon annexation the Fresno Police would assume full responsibility for the provision of such services. A comparison of the area with surrounding neighborhoods within the City limits suggests a potential work load of approximately 270 calls per year. This figure a represents a slight increase in the total wore load of surrounding patrol beats which is not sufficient, in and of itself, to require deployment adjustments. When considered in conjunction with the Bullard --Blackstone No. l and Barstow - Fresno No 2 annexations, however, a significant work load is created.. Since some patrol beats contain more than one of the proposed annexations, the net Page 2 of 5 Pages impact would be substantial. In order to provide a level of service equal to that received by the remainder of the City, additional personnel may be required and deployment adjustments will have to be made. Streets The following information was provided by the City of Fresno Public Works Department. In accordance with the major Streets and Highways Plan, the projected status (including street name, width, number of lanes, and type) of all ,streets within or adjacent to the project area. See attached map, Exhibit C-1, City standards provide the following with regard to street development: 1. Arterial: Street, loo' to 106 ` of right--of-way, 4-lane divided roadway; 2 Collector Street, 80' to 84' of right-of-way, 4-lane undivided roadway 3. Local Industrial Street, 64' of right-of-way, 2-Lane undivided; ` 4. Local Residential Streets,.60' of right-of-way, 2-lane undivided. All streets not shown on attached map, Exhibit C-1, are to be considered local streets. Bullard Avenue is classified as an arterial street, Barstow Avenue is classified as a collector street, and the remaining are all local streets. There are no currently planned street projects for this area. The total miles of streets to be annexed is 1.8, Any curbs, gutters, additional right-of-way, permanent pavement, sidewalks, etc., the property owners/developers would be required to install/provide (including the measurements and location for right-of-way), as well as, timetable, and the financial responsibilities for any of the above. It is the property owner's responsibility upon development of the property to install at his expense the adjacent curb, gutter, sidewalk and 1.8' of paving in addition to dedicating right-of-way necessary for widening the street from the current to the ultimate width. Street Lighting/Traffic Signali.zation City will prepare master street lighting plans for the new City areas in coopera- tion with PG&E to facilitate the scheduling of installation of temporary (wood pole mounted) lighting by the utility company. However, no lighting of this type where the new areas are served by underground electrical equipment or where the area is situated in a designation "Underground Utility District". Existing street lighting energy and maintenance costs will become the City's responsibility, including special districts for street lighting. Street Marking City will become responsible for maintenance of all existing pavement marks on public streets upon completion of the annexation. New boarder streets will be maintained in accordance with existing multi -agency agreements for these ser- vices. Street Signing City will become responsible for maintenance of all existing public street r _T Page 3 of 5 Pages signing. Street name sign replacement to conform to City standards would be programmed within a five. -year (5) program. } Traffic Signals City will become responsible for programming the installation of new traffic signal., using existing warrants, priority, and scheduling processes. All annexed traffic signals now existing will be maintained and operated by the City,in conformance with existing multi -agency agreements where equipment is shared with another agency, t Solid 'Waste Dispersal The subject territory is now being served by a private waste disposal. company. Upon annexation the City of Fresno will provide this service in accordance with Section 35005 of the Government Code, Part 2, Division 5, Chapter 2 7, Section 4272 of the Health and Safety Code. Following the annexation, notice will be sent to the private company that the area is annexed to the City and that the above -mentioned Government Code, applies. Street Sweeping There are no street sweeping services provided to the area at this time. There are 13,525 feet of existing curb miles. City of Fresno will provide future Estreet sweeping. There are no provisions to govern any transition period.. f Transit See Exhibit SP-I provided by the City of Fresno Transportation Department. Parks and Recreation The following information was provided by the City of Fresno, Parks and Recreation Department. The proposed Barstow -Fourth No. l annexation area is presently served by the following Parks and Recreation facility and services: The requested information regarding the proposed Barstow --Fourth No. 1 annexation area and the city of Fresno Parks and Recreation facilities and services are as follows; 1. The day-to-day neighborhood park and recreation needs of the project area are currently being served by the City of Fresno Parks .and recreation Department according to the Department's standards. The Department's standard would require the location of a neighborhood parkwithin a mile of each residence to serve the recreational needs of the youth, seniors and adults in the area. The nearest facility to meet future need is Robinson Park, located at Fresno Street between Browning and 'Wrenwood Avenues. Robinson Park is within one mile of the proposed annexation area. 2. Woodward Park will provide regional park needs for the project' area 3. No additional land acquisition and facility development will be required to meet current Department standards r Page 4 of 5 Pages s,1 i 4. At present no problems are anticipated in providing parks and recreation services (as per the Department's standards) for the proposed annexation area. - Flood Control See Exhibit SP-2, letter from Fresno Metropolitan Flood Control District. Animal Control There are no differences in the level of animal control services provided by the Society for the Prevention of Cruelty to Animals throughout the Fresno Metropolitan Area, Uti.litX Tax The City's 4.6 percent utility tax will be applicable to all natural gas, electric and telephone bills. The actual cost: of such tax can.be estimated by relating this tax rate to the current utility bills. Property -Tax Annexation to the City of Fresno will cause no property tax increase to the property owner. In an effort to expedite our response, that information of a common nature to all of the subject proposals shall be provided by general comment. Information relating to a single proposal shall be provided as such.. The service delivery system of the Fresno Metropolitan Flood Control District is identified, within the legislative respon- sibilities of the District. These responsibilities are gen- erally divided; .into three basic types of services. First and foremost, is flood control protection of the lands within the District. This responsibility entails the protection of District lands from the intrusion of flood waters from the foothills region.. Secondly, the District is responsible for the provision of urban storm drainage services as, certain lands are converted to urban uses. This is a totally separate service of the District from that of flood control.. Finally, the District's service system entails the conservation of flood and storm waters. Generally these facilities are constructed through one of two funding methods; participation is effected either at the time of development through the drainage fee ordinance of the City or County, or through the formation of are assess- ment district. 'these fees are collected can all metropolitan area development, whether inside or outside of the District. Because the drainage fees and assessments finance the urban drainage system,` said fees and. assessments .are determined an the basis of land use and area. Such fees or assessments represent a one-time, contribution to the construction cost of the 'urban drainage system serving the watershed in which the parcel being charged is located. in addition to the above information, all of the subject annexation and reorganization proposals are within the bound- aries of the Flood Control: District. The following information relates to each proposal individually. Woodward -Chance No'.: 3 The Woodward -Chance No. 3 Annexation is located ii Drainage Zone 'EGG." Although per`'manent drainage services are not currently available, the basin facility was ,recently acquired by the District and is included within the boundaries of the annexation. After fencing of the basin site, it shall be available for excavation and shall provide permanent service in con j unction with the construction of the collection: system. Nees --Fresno No. The Nees --Fresno No. 2 is located can the extreme southern portion of Drainage Zone 11CW." The basin site serving this area is located. at Nees and. Fresno Street and is undergoing excavation in conjunction with development activity occurring within the watershed. The adopted master plan envisions storm water collection. through 'surface flow. Holland -Marks Nc .' 3 The subject proposal is located in Drainage zone "AG" and on permanent service. Barstow -Fourth No. 2 The subject proposal is located in Drainage Zone and an permanent service. Weldon -First No . 3 The Weldon -First No. 3 Annexation is located in Drainage Zone "CC." Zone'EI-1:1 The area is served by perma.n nt drainage facilities bar a collector system in Grove Avenue and Church Avenue. The storm water is deposited in the I1--1 basin site located on, the south side of Church Avenue adjacent to and east of GeorgeCarver School Church; -Walnut No. 3 District Reorganization The subject proposal islocated in Drainage Zone 'ITT." The basin site serving that .area south of Grove Avenue is located along _ Grove .Avenue: approximately ma.tel 500 feet west of Walnut .Avenue.
