RESOLUTION NO. 79-276
RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING
TO THE; FRESNO LOCAL AGENCY FORMATION COMMISSION IN THE
MATTER OF THE PROPOSED FAIRMONT-FRUIT NO. l-A DISTRICT
REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TER-
RITORY CONSISTING OF 36 OF AN ACRE FROM THE NORTH CENTRAL
FIRE PROTECTION DISTRICT AND THE ANNEXATION OF -SAID TERRI-
TORY TO THE CITY OF FRESNO
WHEREAS, this proposal is made pursuant to the District Reorganization Act
of 1965 contained in Division 1 of Title 6 (commencing with `Section '56000) of the
California Government Code; and
WHEREAS, the nature of the proposed change is a reorganization consisting of
the detachment of certain territory consisting of .36 of an acre and hereinafter
called the "subject territory" from the North Central Fire Protection District
and the annexation of the subject territory to the City of Fresno; and ,
WHEREAS, no other counties cities, or districts are affected; and
WHEREAS, the subject territory proposed to be detached from the North Central
Fire Protection District and annexed to the City of Fresno is uninhabited, is
described in Exhibit "A", and graphically depicted upon the map marked Exhibit "B",
and by these references made a part of this resolution and
WHEREAS, the owner of all of the land within said territory has requested and
consented to such annexation; ,and
WHEREAS, by ?Notice of Exemption No. 2786 said district reorganization project
was determined to be categorically exempt from the preparation of environmental
documents; and
WHEREAS, pursuant to the requirements set forth in Government Code Section.
35102, a service plan for the subject territory has been prepared and said service
plan is attached hereto as Exhibit "C", and by this reference made part of this
resolution; and
WHEREAS, no new districts are proposed to be formed by this reorganization;
and
WHEREAS, the Fresno County Assessor's roll will be used for the purpose of
levying any assessments or taxes on the subject territory; and
WHEREAS, the exemption of all the subject territory proposed to be annexed
to the City of Fresno from taxation for the payment of 'principal or interest, or
any other amounts which shall become due on account of any outstanding bonded in-
debtedness incurred by the City prior to the effective date of such annexation;
and

WHEREAS, upon completion of this reorganization proposal, the subject ter-
ritory will be included in Municipal Bond Area-"D" and will not be taxed for any
existing bonded indebtedness or contractual obligations, and
WHEREAS the reasons for this proposed reorganization are stated as follows:
1. Annexation of the subject territory to the City of Fresno will
result in improved land: use planning. All private development controls
of the City will apply following annexation.
2. The subject territory is within the City of Fresno's Sphere of
Influence.
3 The consolidation of the subject area into one detachment annexa-
tion project is _beneficial to the affected governmental processes and
the resultant City and district boundaries
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby
requests that proceedings be taken by the Fresno Local Agency Formation Commission
for the herein proposed PairmontFruit No, 1-A District Reorganization, including
the detachment of the subject territory, consisting of `36 of an acre from. the
North. Central Fire Protection District and the annexation of the same territory to
the City of Fresno
BE IT FURTHER RESOLVED that the Counc,l's application include a request for
approval and authorization from the Fresno Local Agency Formation Commission for
the Council to annex the subject territory without notice and hearing.

Consisting of a portion of Lot 48 of Bullard North Fresno
Addition.
BEGINNING at a point which is 2.50 feet South of the North line and 165.43
feet West of the East line of Lot 48 of Bullard North Fresno Addition., as
said lot is shown on the map thereof filed in the Office of the County
;Recorder April 14, 1915 and recorded in Volume 7 of plats at ,Page 72, Fresno
County Records, said point being also a point on the existing City Limits of
the City of Fresno, thence Southerly, along a line which is parallel with
and 165.43 feet Vest of the East line of said Lot 48, being also, along the
existing City Limits of said City a distance of 95.50 feet, to a point which
is 28.00 feet North of the North line of Lot 49, of said. Bullard North
Fresno Addition; thence Easterly, along a line which is parallel with and

SERVICE ?CLAN
APRIL 3, 1979
This Service Plan is prepared in accordance with the requirements of Government
Code Section 35102. Each major service subject is discussed based on existing
conditions: and adopted City plans and policies. The purpose of this document
is to provide information regarding the availability of City municipal services
and how they will be provided to the subject territory should annexation to the
City occur. Any required modification, expansion or extension to existing
facilities in order to serve the subject territory will be discussed based: on
applicable City ordinances. Where appropriate, the financing and placement of
such services and facilities will be discussed.
SUMMARY
The proposed Fairmont -Fruit No.1-A District Reorganization consists of the
annexation of .36 acres to the City of Fresno and the detachment of the same
.36 acres from the North Central Fire Protection District. The subject territory
is Located on the northwest corner of the intersection. of West Fairmont and North
Vagedes avenues. The subject area consists of one 'lot with a single family
residential unit on the east side of the lot. The subject area is presently
zoned R-1.
SEWER
The residence within the project area is connected to the City's 8" sewer main
located along North Vagedes Avenue. Transmission capacity is adequate for the
present use or for development to the medium -low density designation as indicated
by the Bullard Community Plan.
WATER
The subject area is located within Fresno County Waterworks District No.2
and is being served by the District's 6" water main located in North Vagedes
Avenue. No change in water service will result from this reorganization proposal.
FIRE HYDRANT
There are no fire hydrants located within the project boundaries. However, there
is one hydrant located nearby at the northeast corner of North Vagedes and West
Fairmont avenues There are three fire hydrants west of the subject territory
on Fruit Avenue where Fruit Avenue intersects with West Sierra Madre, West
Fairmont and West Alamos avenues. A fifth hydrant is located at the southwest'
corner of North Arthur and West -Sierra Madre avenues.
FIRE PROTECTION
The subject territory is presently receiving fire protection services from. the
North Central Fire Protection District. .First due response is from 'North Central
Station. No.7, located at the intersection of .West Bullard and North Channing
avenues, approximately 15 miles northwest of the project area.
Upon annexation, the area will receive City fire protection services. First due
response will be provided by City Fire Station. No.1.21 located at the intersection
of North Marks and West Acacia avenues, approximately 1..8 miles west of the
project area.
PARAMEDIC
At present there is no mutual aid agreement for paramedic services between the
City and. the North Central Fire Protection District. First due response is
from North Central Station 'No.7. Upon annexation, first due response will come
from City Fire Station No.11, located at the intersection of north Fresno and
East Wrenwood avenues, approximately 2.7 miles northeast of the project area.
POLICE PROTECTION
The subject territory is presently being served by the Fresno County Sheriff's
Department and the California Highway Patrol. Upon annexation, City police
protection will be provided at the same level now being provided within the
City's incorporated. area.

The regional park needs of the area can be met through the use of Woodward
Park facilities.
FLOOD CONTROL
The Fresno Metropolitan Flood Control. District is responsible for all, storm
drainage facilities within the Fresno -Clovis Metropolitan. Area., The subject
territory falls within the District's "DD" drainage zone. There are no
drainage facilities within the subject territory. However, there is a possi-
bility that drainage facilities can be made available within two yearsr con-
tingent upon local support. Complete drainage facilities and services for the
drainage area in which the subject territory is located are estimated to cost
in excess of 3.5 million dollars.
ANIMAL CONTROL
There are no differences in the level of animal control services provided by
the Society for the Prevention of Cruelty to Animals throughout the Fresno
Metropolitan Area.
UTILITY TAX
The Cty's 4.6 percent utility tax will be applicable to all natural gas,,
electricity, and: telephone bills The actual cost of such tax can be estimated
by applying this tax rate to the current utility hills.
PROPERTY TAX
With the passage of Proposition 13, there is no difference between City and
County property taxes. Therefore, annexation to the City will cause no property
tax increase to the property owners of the project area.
