RESOLUTION NO. 7 9 - 2 5 T
A RESOLUTION OF THE COUNCIL OF THE CITY OF FR.ESNO
RELATING TO THE ABATEMENT OF PUBLIC NUISANCES AND
ASSESSMENTS FOR THE COST THEREOF PURSUANT TO THE
WEED ABATEMENT PROVISIONS OF THE GOVERNMENT CODE

WHEREAS, on January 30, 1979 and April 3, 1979, this

f Council., by Resolutions No. 79-37 and 79 125,.declared the
fact of public nuisances on certain properties r and. on. April
17, 1979, heard all objections to the abatement thereof, and
by Resolution No. 79-157, ordered that said nuisances be abatedp
and also empowered the Purchasing Agent cif the City of Fresno
to contract for the removal of the weeds that constitute the
nuisance on said properties; and,
WHEREAS, the Fire Marshal of the City of Fresno} has `abated
said nuisances and reported to this Council the costs thereof
as appear on Exhibit "A", attached hereto and made a part here-
of,. and duly posted said itemized report for a period of at
least three days on, or near the door of the Council Chamber,
City Hall, Fresno, California and,
WHEIREASt on unary 17, 1978, this Council by Resolution
No. 78-25 declared the fact of public nuisances on certain
properties, and can April 18, 1978, heard all objections to the
abatement thereof, and by Resolution No. 78a-159, ordered that
said nuisances be abated, and also empowered. the Purchasing
Agent of the City 4f Fresno to con tract for the removal of the
weeds that constitute the nuisance on said properties; and,
TA7HERE,AS,. Exhibit "A" includes the casts to be charged for
work done from July 1, 1978 through November 30, 1978, which
costs were not confirmed. by Council 'in Resolution No* 78-246 and,
WHEREAS, this Council has heard, all objections, if any, to
said reports
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITE
OF FRESNO

SECTION 1. That said report of the Eire Marshal is hereby
confirmed, pursuant to the authority vested in the Council under
Section 39576 of the Government Code of the State of California.
SECTION 2 That the various_ amounts appearing in Exhibit
''A;' , a ttached hereto and made a part hereof, shall. constitute
special assessments, against the respective lots and parcels of
land, and, as herein confirmed, shall constitute liens on such
property for the amounts of such assessments.
SECTION 3 . That a copy of said report as herewith con-
firmed shall be transmitted to the Fresno County Tax Collector
and the Fresno County Assessor, who .are hereby expressly author-
ized to assume and discharge the duties, of col ect ng'such
special assessments by adding the amount of the respective
assessments to the next regular bill for taxes, for munici_1p al
purp9ses levied agaInst the lots and parcels of land in Exhibit
"A", and thereafter such amount shall be collected at the same
time and in the same manner as ordinary municipal taxes are
collected and shall be subject to the same penalties and the
same procedure un:de' r foreclosure and sale in ease of delinquency
as provided for ordinary municipal taxes. On or. before July 2,
1979 a certified copy of said report shall be filed with the
Fresno County Auditor.
