RESOLUTION NO. 79-249
A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO, CALIFORNIA, RELATING TO
INSTALLATION OF TRAFFIC SIGNALS ON CITY
STREETS BY PRIVATE PERSONS
WHEREAS private persons may, from time to time, desire
to install traffic signals on public streets at their own
cost for business or other reasons and
WHEREAS, the determination of need, maintenance, and
operation of such traffic signals is a function of municipal
government, and the City will normally install traffic
signals when warrants are met and priorities are sufficiently
high to justify funding under the Capital Improvement Program,
and
WHEREAS,: such installation by private persons without
cost to the City may be desirable provided that it is done
in a manner and under such conditions as may be necessary or
convenient to promote the public health, safety and welfare
NOW, WHEREFORE, BE IT RESOLVED, by the Council of the
City of Fresno, as follows
SECTION 1. This section shall apply to any proposed
traffic signal to be installed by a private person at his
own cost at a location which has been approved by the City
Traffic Engineer and for which the minimum warrants for
installation have been met;- provided, however, the City has
not included the installation in the current fiscal year's
Capital Improvement Budget. The City may permit the installa-
tion of any such traffic signal provided
(a) The private person causes plans and specifications
for the traffic signal to be prepared to the satisfaction
of the City Traffic Engineer.
(b) The private party causes the installation of the
signal in complian e with the plans and specifications
under City inspection and gives the City sufficient notice
prior to the beginning of construction A "no -fee!'

and construction inspection will be provided,by the
City at no cost to the contractor.
(c) The private party dedicates the traffic
signal to the City of Fresno,
(d) The private party grants an easement or
dedicates right-of-way as necessary for traffic control
on a non-public street approach to the signal: if such
exists.
(e) Such other terms and conditions as required
by the Traffic Engineer.
SECTION.2 This section shall apply to any proposed
traffic signal to be installed by a private person at his
own cost at a location which has been approved by the City '
Traffic Engineer for which the minimum warrants for installa-
tion have-not been met but will probably be met prior to
completion of such installation. The City may permit the
installation of any such traffic signal provided:
(a) All of the terms and conditions set forth in
subsection (a,) through (e) of Section l of this Resolu-
tion have been met; and
(b) If the signal is requested by an abutting
landowner who is constructing or intending to construct
a residential or commercial development, then the
signal shall not be placed in operation until a majority
of the development is completed and occupied.
SECTION 3 This section shall apply to any proposed
traffic signal to be installed by a private person at his
own cost at a location which has been approved by the City
Traffic Engineer and for which the minimum number of warrants
have not been met and will probably not be met prior to
coi4pletion of such installation,. The City may permit the
installation of any such traffic signal provided;
(a) All of the terms and conditions set forth in
subsections (a) through (e) of Section l and subsection
(b) of Section 2 of this Resolution have been met- and
(b) The private person enters into an agreement
with the City of Fresno to pay the maintenance and
operation costs of the signal until minimum warrants
are met. Such agreement shall include provisions for
(l) A reasonable estimate of the operation
and maintenance costs of the first year;
(2) Prepayment by the private person of a
fixed sum for the maintenance and operation casts
of the first year
(3) Inclusion of the signal in the City
annual studies to determine when minimum warrants
have been met;
(4) Conducting special studies at the request
of and, at the expense of the private party to
determine when minimum warrants have been met, and
(5) A method of guaranteeing maintenance and
operation cost payments by the 'private person
after the first year and up to the point of meeting
minimum warrants
