City Attorney RESOLUTION PTO. 7 9 - 2 4 A RESOLUTION OF THEN COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, AUTHORIZING THE: PURCHASE OF THE BASE AUTOMATED NAME INDEX.SUBSYSTEM FOR THE POLICE DEPARTMENTS COMPUTER --AIDED DISPATCH SYSTEM. WITHOUT ADVERTISED COMPETITIVE BIDDING. WHEREAS, the Council has received and considered the report and recoimuendat ons of the Chief Administrative Officer, and: upon such report and recommendations, the Council finds as follows. 1. On February 25, 1976, the City awarded; a contract to Kustom Data Communications, Inc ("Kustom"), as the lowest responsible bidder pursuant to and in accordance with the competitive bidding procedure set forth in the Charter of the City of Fresno and the Fresno Municipal Code, to provide the Fresno Police Department with a Computer -aided Dispatch System. 2. In February, 1977, Kustom was awarded a second contract to develop and install, inter alia,, a Base Automated Name Index C"ANI") Subsystems 3. Kustom was required: to develop and install the ANI Subsystem by February, 1978. After repeated demands for per- formance, the City Attorney' s Office gave notice of termination; on. .March 9, 1979 subject to a thirty day period for Kustom to correct its default. On April 23, 1979, the City Attorneys Office advised Kustom that the default had not been cured and the contract was terminated 4. Community Technology ("Community") and its predecessor in interest, J. Dewey & Associates, were under contract with Kustom to develop the ANI Subsystem. Community has a unique knowledge of the work to be done, which work must be compatable with the Computer -aided Dispatch System, 5 Community has offered to develop and install the ANI Subsystem for $123,094.00* 6. Accepting the offer of Community would necessarily ';% r exclude all others and any attemptatcompetitive bidding would be time consuming, more costly, work an incongruity, would not affect the final result, and would produce no advantage to the City, IT IS THEREFORE RESOLVED by the Council of the City of Fresno that advertised competitive bidding for the purchase of a Base Automated Name Index System for the Police Depart- ment's Computer -aided Dispatch System is dispensed with and that the Chief of Police is authorized to execute a contract on behalf of the City with Community Technology for the purchase of said equipment, the total cost thereof, including installa- tion, not to exceed $123,094.00. IT IS FURTHER RESOLVED that the action of the City Attorney ° s office in terminating the contract with Kustont Data Communications, Inc. is hereby ratified, confirmed, and approved.
