RESOLUTION NO. 79 2 6
A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO, CALIFORNI,A, AUTHORIZING THE PURCHASE
OF FOUR TRAILERS FOR USE BY THE PUBLICWORKS
,DEPARTMENT FOR COLLECTION OF SOLID WASTE
RECYCLADLES WITHOUT ADVERTISED COMPETITIVE
BIDDING.
WHEREAS, the Council has received and considered the
report and recommendation of the Chief Administrative Officer,
and upon such report and, recommendation, the Council finds
as follows
1. In January of 1979, the City attempted
but was unable to obtain. bids for four trailers with
specifications suitable for their intended use in
the collection of solid waste recyclables .
2. midway Trailers of Bakersfield sent a
letter received by the City on January 12, 1979,
representing that it is the only supplier competent
to satisfy the City' s specifications
3. Staff of the Public Works Department has
contacted six companies believed to fabricate
suitable trailers, which companies do not have
suitable stock trailers and are not interested in
manufacturing special trailers satisfying the City's
specifications
4 Midway Trailers has offered to sell four
trailers satisfying the C ty's specifications for
approximately $20,000, approximately 15% below the
engineer's estimate.
5. Any further attempt at competitive bidding
would work an incongruity, would not affect the final
result and would produce no advantage to the City.
NOW, THEREFORE, IT IS RESOLVED by the Council of the
City of Fresno, California, that advertised competitive
bidding for the purchase of four trailers for use by the
Department of Public Works for the collection of ` solid`
waste recyclables is dispensed with and that the

Purchasing Agent is authorized to enter into and execute a
contract on behalf of the City with Midway Trailers for the
purchase of said trailers, the total cost thereof, including
tax and freight, not to exceed the budgeted amount of
$23,000.
