RESOLUTION NO. Z 9 2 3 4 ,
RESOLUTION ORDERING VACATION OF A`PUHLIC STREET
WHEREAS, pursuant to Resolution of Intention No, 767-D,
on file herein, a public hearing was held at 10:15 a.m. on
the 5th day of June, 1979r at a regular meeting of the
Council of the City of Fresno in the Council Chambers of
the Fresno City Hall in the City of Fresno, County of Fresno,
State of California, at which time and place evidence was
heard for and: against the vacation of a portion of N. Forkner
Avenue, North of W. Shaw Avenue; and
WHEREAS, the City Traffic Engineer has reviewed the
proposed vacation action and determined that it will have
no adverse effect upon traffic circulation; and
WHEREAS, findings of Environmental ,Assessment No. 269
indicate that the proposed vacation action will have "no
possibility of significant effect on the environment"; and
WHEREAS, the Council of the City of Fresno now finds
from all the evidence submitted that such street, herein-
after particularly described is unnecessary for present and
prospective public street purposes;
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FRESNO,
pursuant to the provisions of the "Street Vacation Act of
1941", being Sections 8300_8374 of the Streets and Highways
Code of the State of California, DOES HEREBY RESOLVE AS
FOLLOWS
1.. The public interest and convenience require, and
it is hereby ordered, that as contemplated by Resolution of
Intention No. 767-D adopted by the Council of the City of
Fresno on the 15th day of May,, 1979, the hereinafter des-
cribed portion of a public street situated in the City and
County of Fresno be and the same is hereby closed, vacated
and abandoned for public street purposes
2. The portion of a public street to be vacated is des

A portion of the realignment of North Forkner Avenue 1
as it now exists as of June 30, 1977, lying in Section 7,
Township 13 South, Range 20 East, mount Diablo Base
and Meridian, as said Section is shown on the United
State Township plats and more particularly described
as follows.
For reference, BEGINNING at the Southeast corner of
said Section 7 thence North 89a-161 30" West, along
the South line of said Section 7 a distance of 1833.78
feet; thence North 000 431 30" East, a distance of
60.00 feet, thence South 89a 16' 30" East, parallel
with the South line of said Section 7, a distance of
767.41 feet to a point of cusp; thence Westerly� and
Northerly along a tangent curve, concave to the North-
east and having a radius of 30.00 feet, through an
interior angle of 900 00' 00" . an arc distance of
47.12 feet, thence North. 000 431 30 East, a distance
of 66.50 feet to the TRUE POINT OF BEGINNING. thence
continuing North. 000 43' `3011 East, a distance of 43.30
feet; thence Northerly and Northwesterly along a
curve, concave to the Southwest and having a radius
of 215.00 feet; through an interior angle of 360 421 10" r
an arc distanceof 137.73 feet; thence Northwesterly
along a -reverse curve, concave to the Northeast, and
having a radius of 592.27 feet, through: an interior
angle of 71 321 27", an arc distance of 77.95 feet;,
thence South 270 001 0011
East, a distance of 107.14
feet; thence Southeasterly and. Southerly along a
tangent curvet concave to the Southwest, and having a
radius of 305.94 feet, through an interior angle of
27° 43' 30►Tt an arc distance of 148.04 feet to the
TRUE POINT OF BEGINNING.
For further particulars as to the proposed vacation,
reference is :hereby made to the map entitled "Mafia Attached
to Resolution of intention 767-D" on file; in the Office of
the City Clerk of the City of Fresno, at the Fresno City
Hall, 2326 Fresno Street, Fresno, California 93721.
3. That the City of Fresno intends to reserve and
except from the proposed vacation the permanent easement and
right at any time, or from time to time, to construct,
maintain, operate, replace, remover and renew sanitary
sewers and storm drains and appurtenant structures and
pursuant to any existing franchises or renewals thereof,
or otherwise, to construct, maintain, operate, replace,
remove, renew and enlarge lines of pipe, conduits, cables,
wires, poles, and other convenient structures, equipment
and fixtures for the operation of gas pipe lines, telegraphic
and telephone lines, railroad lines, and for the transporta-
tion or distribution of electric energy, petroleum and its
products, ammonia., water, and incidental purposesT including
access and the right to keep the property free from flammable

materials, and wood growth, and otherwise protect the same
from all hazards in, upon, over and across the entire area.
4. That all proceedings for the vacation of such
street shall be and they are taken subject to the foregoing
reservations and exceptions,.
5. The Council finds and determines that the rights
of way or parts thereof vacated are not useful as bicycle
paths 'or'routes.
6. The City Clerk of the City of Fresno shall certify
to the passage of this resolution and shall cause a certi-
fied copy thereof attested by the Clerk under the seal 'of
the City of Fresno, to be recorded in the Office of the
County Recorder of the County of Fresno, State of California.
