RESOLUTION NO. 79_ 228
RESOLUTION ORDERING CHANGES AND MODIFICATIONS
TO WORK AND ORDERING CORRESPONDING CREDITS
AGAINST INDIVIDUAL ASSESSMENT'S ON PARCELS
AFFECTED By DELETION OF WORK
ASSESSMENT DISTRICT NO. 67
RESOLD, by the Council of the City of Fresno, that:
WHEREAS, the Council of the City of Fresno, State of
California, did on April. 4 t 1978, adopt its Resolution of
Intention No. 78-1.42 relating to certain proposed" work,
acquisitions and improvements to be done and made in an Assessment
District designated "City of Fresno Assessment District No. 6711
described in said Resolution of Intention, under and pursuant to
the provisions of Article 20, Chapter 15, of the Municipal. Code of
the City of Fresno, which said Resolution of Intention provided
that serial bonds would be issued in the manner provided by Bond
Plan B, Article 24, of Chapter 15 of said Municipal Code,
reference to said Resolution of intention being hereby expressly
made for all further particulars relating thereof; and
WHEREAS, an assessment and diagram were duly made and
filed with said Council and after hearing, duly noticed: and held,
said assessment as modified and: said diagram were confirmed and
approved by Resolution No. 79-143, passed and adopted by Council,
on March 13 1979 and
WHEREAS, said modified assessment and diagram were duly
recorded on March 14, 1979, in the office of the Director of
Public Works of said City and the assessment diagram and Notice of
said assessment were duly filed and recorded in the office of the
Fresno County Recorder on March 23, 1979f and

WHEREAS said assessment as modified in the total amount
of $897,833.00 was apportioned among the several subdivisions of
land in said District in proportion to the estimated benefits to
be received by such subdivisions, respectively, from said work and
improvements as shown in said assessment to which reference is
hereby expressly made for further particulars; and
WHEREASO charges for certain work and improvements as
heretofore ordered affectinghereinafter specified parcels of land
in said Assessment District were charges in excess of improvements
to be received in the sum of $15 030.12 thereby resulting in a
surplus of funds in said amount; and
WHEREAS, credit upon the individual assessment thereto-
fore imposed upon any such subdivisions of land should be granted
in the manner provided in Section 10356 and 10427.1 of the Streets
and Highways Code of the :State of California; and
WHEREAS; these changes and modifications result in
reducing individual assessments without eliminating any of the
work required to be done; and
WHEREAS, the Engineer of work has reported on all of
said changes and modifications, being proposed credits; and
WHEREAS, such changes and Modifications provided for
herein are reductions in assessments without eliminating any of
the work to be done for said subdivision or parcels of Sand and as
to said reductions the Engineer of Work has recommended that, as
to the work, if any, to be done which is the responsibility of the
City under current City policy and procedure and was erroneously
charged to said individual assessments, no increase in
contribution is required from the City as there is a sufficient
amount in the contingency fund portion of City's contribution to
meet the coast of such work.

WHEREAS, in the opinion of this Council, the public
interest, convenience and necessity requires such changes and
modifications.
NOW, THEREFORE, BE IT ORDERED AS FOLLOWS
1. That a reduction in assessment without eliminating
any of the work necessary to be done with respect to those parcels
or subdivisions of land as hereinafter referred to be made by
credit upon individual assessments as set forth in Exhibit "A"
attached hereto to the following assessments

2, The Engineer's Report shall be modified as provided
herein, and such modifications be, and they are hereby, approved.
3. That the City Treasurer is hereby directed to record
on the assessment roll the credits as hereinabcve determined to be
given to the individual assessments on each parcel as herein
specified and to apply said credits in the manner provided in
Section 10427.1 of the Streets and Highways code of the State of
California.

introduced and adopted by the City Council of the City of Fresno at
a regular meeting held on the 5th day of June , 1979, at
