HomeMy WebLinkAboutResolution - City Council - 79-198 - 1979-05-15Tth Foul ter Ed file} icki REsa umw NO. 79 -19 RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO APPLYING TO THE FRESNO LOCAL ,AGENCY FORMATION COMMISSION IN THE: MATTER OF THE PROPOSED ALLUVIAL-MILLBROOR NO.. 2-,AA DIS- TRICT REORGANIZATION, INCLUDING THE DETACHMENT OF CERTAIN TERRITORY CONSISTING OF 29.78 ACRES FROM THE MID VALLEY FIRE PROTECTION DISTRICT AND THE ANNEXATION OF SAID TER- RITORY TO THE CITY OF FRESNO WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in Division 1 of Title 6 (commencing with Section-56000) of the California Government Code, and WHEREAS, the .nature of the proposed change is a reorganization consisting of the detachment of certain territory consisting of 29,78 acres and: hereinafter called the "subject territory" from the MidValley Fire Protection District and the annexation of the subject territory to the City of Fresno,.and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the, subject territory proposed to be detached from: the Mid Valley Fire Protection District and annexed to the City of Fresno is uninhabited, is described in Exhibit ""A ", and graphically depicted upon the map- marked Exhibit "B", and by these references made a part of this resolution;' and; WHEREAS, review and analysis of Environmental Assessment No. 2836 related to said distract reorganization project, has resulted in a Negative Declaration by the Director of Planning and Inspection; and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the subject territory has been prepared and said service plan is attached: hereto as Exhibit "C", and by this reference made part of this resolution and WHEREAS, no new districts are proposed to be formed by this reorganization; and WHEREAS, the Fresno County Assessor's' roll will be used for the purpose of levying any assessments or taxes on the subject territory; and WHEREAS, the exemption of all the subject territory proposed to be annexed to the City of Fresno from taxation for the payment of principal or interest, or any other amounts which shall become due on account of any outstanding bonded indebtedness incurred by the City prior to the effective date of such annexation; and WHEREAS, upon completion, of this reorganization proposal, the subject territory will be included in Municipal Bond` Area "D" and will not be taxed for any existing bonded indebtedness or contractual Obligations; and Page l of 2 EFFECTIVE WHEREAS, the reasons for this proposed reorganization are Stated as follows; 1. Each major service subject is discussed based on existing conditions and adopted City plans and policies. The purpose of this document is .to provide information regarding the availability of City Municipal Services and how they will be provided to the subject territory should annexation to the City occur. Any required modification, expansion, or extension of existing facilities in order to serve the subject territory will be discussed based on applicable City ordinances. Where appropriate, the financing andplacementof services and facilities will also be discussed. Project Summary The proposed Alluvial Millbrook No. 2-AA consists of the annexation of 29.78 acres to the City of Fresno and the detachment of the same 29..78 acres from the Mid Valley Fire Protection district. The area proposed for annexation is contiguous to the City along its western and southern boundaries. The subject territory falls within the City's Sphere of Influence Boundary and the City's adopted Urban Growth Management Area and, therefore, will be subject to the Urban Growth Management Process. The subject territory is generally located southeast of the intersection of East Alluvial and North Millbrook Avenues. Existing land use consists of four single family dwellings and vacant land. The project area is zoned. Interim R-A and R-A. Sewer Service City sanitary sewer service is available through a privately financed extension from the 24-inch sewer main located in North Millbrook Avenue. As part of a proposal, an applicant would be required to construct all on -site improvements and necessary connnections to the City's transmission system in accordance with the applicable Urban Growth Management regulations and municipal code requirements. Water Service City water service is available through an extension of the main located in North Millbrook Avenue. All required water wells, connections, fees, and charges would be determined at such time as development plans are submitted under the City's Urban Growth Management process. Fire Hydrants There are no fire hydrants located within the subject territory'. Fire hydrants will be installed, to City fire flow and water pressure standards, only at the expense of a prospective customer. -2x There are six fire hydrants available in the residential development across Millbrook Avenue west of from the subject territory which can partially serve the territory. Fire Protection The subject territory .is presently receiving fire protection services from the Mid --Malley Fire Protection District Station No. 20 located near the intersection of North First Street and East Herndon Avenue. District Station No. 20 provides first due response and is located approximately 3/4-of a mile southwest of the project area. The area proposed: for annexation will.receive City fire protection services upon annexation. The first clue response will come from Station no. 11, located approximately 2.4 miles southeast of the project area. urban Growth Management Agreement No. 2 provides for a station to be constructed near the intersection of East Nees and North Millbrook Avenues, approximately 1/2 mile north of the proposed annexation The proposed station at the intersection of East Nees and North Millbrook will be City Fire Station No. 13. Proposed Station No. 13 will be constructed as soon as possible by the developer, Bombay Corporation, contingent upon the rate of development of the surrounding area. The capital for the construction, equip- ment and apparatus for Station No. 13 has been posted by the Bombay Corporation under the terms of Urban Growth Management Agreement No. 2. The City Fire Depart- ment is presently projecting a 12r-month period to the Station becoming operational. This projection is subject to change, contingent upon the rate of development at the surrounding area and consequently the need for improved fire protection. The City Fire Department currently has one tanker truck operational for the suppression of fires in the subject territory. This tanker truck is being housed at City Fire Station No. 4. in addition, the Mid -Valley Fire Protection District has tanker truck facilities which can be utilized for fire suppression in incorporated City areas through a mutual agreement with the City of Fresno, should the need arise. Police Protection The subject territory is presently being served by the Fresno County Sheriff's Department and the California Highway Patrol Capon annexation: City police protec- tion will be provided at the same level as the service now being provided,within. the City's incorporated area, Paramedic Service The mid --Valley Fire Protection District has no paramedic services as District Station No. 20. Paramedic services are currently provided: by Fresno Fire Depart- ment Station No. 11 through an Instant Response Agreement between the City of Fresno and the Mid -Valley Fire Protection District. The first due paramedic -3- lip response comes from Fresno Fire Department Station No. 11 located at the inter- section of North Fresno and East Wrenwood Avenues, approximately 2_5 miles from the subject territory. This condition will not be effected by annexation. Street Sweeping Weekly street sweeping services will be provided to the subject territory upon annexation conditioned upon the installation of permanent paving and concrete curbs and gutters. Due to the passage of Proposition 13, the frequency of street sweeping services is uncertain. Street Lighting The City' will request P.G.&E. to install street lights to serve the existing development, including five 150--watt high pressure sodium (HPS) street lights - If future development occurs, an underground street lighting system will be required at the developers expense. An estimated. ten (10) 150--watt high pressure sodium (HPS) and forty-five (45) 70-watt high pressure sodium. (HPS) street lights may ultimately be required for which the City will assume responsibility for maintenance and energy costs. -- There is one street light in the subject territory located on the south side of y East Alluvial Avenue approximately 150 feet west of the intersection with North Millbrook Avenue. In addition, there are six street Lights located on the residential development across North Millbrook Avenue from the subject territory which can partially serve said territory. Traffic Signals The City anticipates the installation of traffic signals at the intersection of East Alluvial and North Millbrook Avenues within the next five years at a cost of $25,000 each. Financial, .responsibility for these facilities will be determined as part of the Urban Growth Management analysis of future development proposals. Traffic Engineering/Street lvtproyements East alluvial and North Millbrook Avenues are both designated as 84-foot collectors where they front the subject territory. This would ultimately require their development as four -lane undivided streets with concrete curbs, 'gutters, and side- walks to meet City standards. Presently East Alluvial and North Millbrook Avenues, where they front the subject territory, are developed as two --lane undivided streets - Additional dedications of rights -of -way to facilitate the construction of 18-foot outside travel lanes would be required as well as concrete improvements. Since the subject territory also falls within the City's Urban Growth Management Area, future developers could also be required to reconstruct the two center lanes should such action be required to bring the streets up to City standards. -4- Transit Services Fresno Transit Route Ho_ 38 proceeds on East Herndon between Warner Avenue and Fresno Street 1/2 mile south of the project area. The; service is regularly provided at 40-minute intervals with 15-minute, intervals wring peak: hours. The Handy Ride program now serving eligible residents of the area will continue following annexation. Solid Waste Disposal Upon annexation City waste disposal se_vices will become available to the residents/property owners within the subject area, as detailed below. - State law provides that waste disposal services may continue for a period of up to five years from the date an area is annexed to the City according to the conditions listed below. Otherwise, services must be obtained fromtheCity's Waste Disposal Division. In any event, conversion to City Waste Disposal Ser- vices must occur within five years of the date of annexation. 1. The company must nave been licensed by the County of Fresno for a minimiva of three years. This includes: Cannon Disposal Service, Browning -Farris industries of California, Inc.; Industrial Waste and Salvage Co. (ITS) Fresno Disposal, Fresno Roll --Off Service, and Thrifty Best Rubbish Service. _ 2. A customer cannot change from one disposal company to another, only to the City's Waste Disposal Service. 3. The quality and frequency of services of the private company must meet the standards required by the City of Fresno. An informational sheet on the "City's Waste Disposal Rates and Services" is enclosed. Parks and Recreation The neighborhood Bark and recreation needs of the service area, as defined by Parks and Recreation standards, will be adequately met when the Sierra. --Cedar park is developed (estimated within the next two years). The regional park. needs of the area are adequately met through use of the Woodward Park facilities. The coumunity recreational center needs will be met when provided by the City's Capital Improvement Prcgran. In addition the proposed annexation area is located within the Clovis Memorial ]district. The district has constructed a $1.2 million swimming facility at the Clovis West High School campus, approximately one mile north of the area. The facility has an olyapic size swimming pool and diving platform and will serve the needs of the area. Hood; Control There are no existing :Mood control facilities at the present time. Flood control facilities, when constructed, will be provided by the Fresno Metropolitan Flood. Control District (FMFCD) which is responsible for all story drainage facilities within the Fresno --Clovis Metropolitan Area. The subject territory falls within the Districts "CM" drainage zone which is incorporated within the FMFCD boundary. Animal. Control There are no differences in: the level of animal control services provided by the Society for the prevention of Cruelty to Animals throughout the Fresno Metropolitan Area. Utility Tax The City's 4.6 percent utility tax would be applicable to all natural gas$. electricity, and telephone bills. The actual cost of such tax could be estimated by relating this tax rate to current utility bills. Propel try Taxes With the passage of proposition 13, City and County taxes are identical. There- fore, annexation to the City will cause no property tax increase to the property owners in the project area. SPECIAL HAULS; $29 40 per hour, with a minimum charge of $7.35 for the first quarter hour or fraction thereof.
