WHEREAS, this proposal is made pursuant to the District Reorganization Act of 1965 contained in division 1 of Title 6 (commencing with Section 56000) of j 1 the California Government Code; and Whereas, the nature of the ,proposed change is a reorganization consisting of the detachment, of certain territory consisting of 275.40 acres and herein- after called the "subject territory" from the Mid Valley Fire Protection District and the annexation of the subject` territory to'the Cite of Fresno; and WHEREAS, no other counties, cities, or districts are affected; and WHEREAS, the subject territory proposed to be detached from the Mid Valley Fire Protection District and annexed to the City of Fresno is uninhabited., is described in attached Exhibit "A" and graphically depicted upon the map marked Exhibit "B", and by these references made a part of this resolution; and WHEREAS, review and analysis of Environmental Assessment No. 2625 related to said district reorganization project has resulted in a Negative Declaration by the Director of Planning and Inspection: and WHEREAS, pursuant to the requirements set forth in Government Code Section 35102, a service plan for the :subject territory has been .prepared and .said I service plan is attached hereto as Exhibit "C" and by this reference made p� rt of this resolution; and WHEREAS, no new districts are proposed to be formed by this reorganization i and I WHEREAS,, the Fresno County Assessor's roll will be used for the purpose lof levying any assessments or taxes on the subject territory,' and WHEREAS, the subject territory proposed to be annexed to the City of Fresno will be exempted from taxation for the payment of principal or interest, or atly other amounts which shall became due on account of any outstanding bonded in.-� debtedness incurred by the City prior to the effective date of such annexati.ortr I and upon completion of this reorganization proposal, the subject territory will f be included in Municipal Bond Area "D" and will not be taxed for any existing bonded indebtedness or contractual, obligations; and j` t Pages t 4 WHEREAS, the reasons for this proposal are stated as follows 1. Annexat.on of the subject territory to the City of Fresno will. 'result in improved land use planning. All private development controls of the City will apply, following reorganization. 2. The subject territory is within the City of Fresno`s Sphere of Influence, 3.. The consolidation of the subject area into one detachment annexation project is beneficial to the affected governmental processes and the resultant City and district boundaries,. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Fresno hereby requests that proceedings be taken by the Fresno Local Agency Formation Commission for the herein proposed Alluvial. -Cedar No.1 District Reorganization, including the detachment of the subject territory, consisting of 275.40 acres from the Mid Valley Fire Protection District and the annexation of the same territory to the City of Fresno. Each major service subject is discussed based on existing conditions and adopted City plans and policies. The purpose of this document is to provide information regarding the availability of municipal services and how they will be provided to the subject territory should annexation. -to the City occur. Any required modification, expansion, or extension of existing facilities in order to serve the subject territory will be discussed based on applicable City ordinances. Where appropriate, the financing and placement of services and facilities will also be discussed,` Summary The proposed Alluvial. --Cedar No.'l District Reorganization consists of the annexa- tion of 275.40 acres to the City of Fresno and the detachment of the same 275.40 acres from the Mid Valley Fire Protection District. The area proposed for annexa- tion is partially contiguous to the City along its southerly boundary. The subject territory fallswithinthe City's Sphere of Influence Boundary and the City's adopted Urban Growth. Management Area and, therefore, will be subject to the City's Urban Growth Management process. The subject territory is generally located southwest of ,the intersection of East Nees and North Maple .Avenues. Existing land use includes twelve single family dwellings, fig orchards, pasture and vacant land.. The area is zoned Interim R-A and interim A-2. Upon annexation of the subject territory the property presently in the County's A-2 zone classification will automatically change to the City's "AE-S" zone in accordance with Section 12-203. ,1., , of the City's Muni- cipal Code. The subject territory is located within the Woodward Park, Community Plan area which designates low density residential development as appropriate land use for the area. The plan also provides for an elementary school site, a ponding basin a recreational open space reserve, and neighborhood commercial development. Sewer The existing residences are currently served by individual septic systems. however, It the 21--inch Cedar Extension sewer main located in Cedar Avenue and terminating in the vicinity of the Peoples Church will serve the p=roject area. In accordance with the City's Urban Growth Management Process, construction of sewer mains to connect the Cedar Extension, frontage connection and other appropriate charges will be the k responsibility of the developer. Reimbursement will be made as other development f occurs and connects to the sewer installed by the developer. r Water The single'fam ly_residences-are presently served by private wells located on the premises. City of I?resno water service is available from the existing 12-inch Cedar Extension which terminates in North Cedar Avenue in the vicinity of the Peoples EXHhBT,T 'tC 4c -2_ Church. All costs for the construction of water lines to extend the Cedar.Exten- sion to the Subject territory and construction of on -site facilities plus all applicable acreage, frontage, and water supply well, charges" will be the respons- bility of future developers at such time that development occurs. `ire Hydrants There are no existing fire hydrants situated within the subject territory and none are located in close proximity to the project area All future fire hydrants required as conditions of development will be installed to City of Fresno standards at the expense of the developer. Such standards: also include the requirement for sufficient water pressures for fire suppression. Fire Protection The subject territory is presently receiving fire protection services from the Mid valley Fire Protection District. First due response is from raid valley Station No. 20 Located near the intersection of North First and East Herndon Avenues. This station is located approximately one mile from the nearest point of the subject territory and. 2.3 miles from the farthest point. Upon annexation the area will receive City fire protectionservices. First due ,response will be provided by City Station No. 1.1., located, at the intersection of North Fresno and East wrenwood.Avenues This station is situated approximately three miles from the nearest point of the subject territory and 4.3 miles from the farthest point. Urban Growth Management Agreement No. 2'provides for a station -to be constructed near the intersection of Nees and Millbrook Avenues, approximately 0.5 mile from the subject` territory. The City will furnish ladder track services to provide salvage operations and can provide greater backup service and reserve cap- ability including tanker service from Station No. 4 at North First Street and Fast Iowa Avenue Paramedic Paramedic services are currently provided based on an Instant Response Agreement between the City and the Mid valley Fire Protection District. First due response comes from Fresno Fire Department Station. No. 11. This service will not be affected by annexation. Police Protection The subject territory is presently being served by the Fresno County Sheriff's Department and the California Highway Patrol. Upon annexation City police protec- tion will be provided at the same level as the service now being provided within the City's incorporated area: Street Sweeping Street sweeping services will be provided to the subject territory upon annexation ' r conditioned upon the installation of permanent paving and concrete curbs and gutters. Although currently scheduled on a, monthly basis, the future frequency of street sweeping services is subject to change. Street Lighting/Traffic 5ignalizaton No streetlights currently exist within the subject territory. As development occurs the developers will be required to install 70--watt high pressure sodium (HPS) streetlights along East Nees, East Alluvial, North Cedar and North maple Avenues, and 150-watt TIPS lights at each intersection. Interior 70- watt high pressure sodium streetlighting requirements will be determined when final development proposals are submitted. The City will assume all energy and maintenance costs for streetlighting. Where are no traffic signals within the project area and none are planned at this time. The long-term affects of Proposition 13 on the provision of these services are unknown at this time. a Traffic Engineering/Street Improvements East Nees and North Cedar Avenues are designated 1.06-foot four lane divided arter- ials. East Alluvial and North Maple'Avenues are both designated as 84-foot four lane undivided collectors. All four streets are currently two lanes where they front the subject territory. upon development these roads will require the dedi- cation of additional rights--of-way, the construction of 181 pa.tside travel lanes, and the installation of concrete curbs and gutters in order to bring -them up to their designated standards. Since the subject territory falls within the Ci.ty's Urban Growth Management Area, future developers could be required to reconstruct the two center travel lanes should it be necessary to bring any of the subject streets up to City standards_ Transit Services > No City Transit routes presently serve the subject territory. Route No..38,`which travels between the Saint Anges Hospital and Downtown Fresno via Cedar Avenue, is the closest route, approximately 0.4 of a mile south of the territory. Handy Ride services will continue to be provided to qualified residents residing within 0.25 of a mile north of East Alluvial. Avenue (East Alluvial Avenue is the Handy Ride northern boLuidary) Service will not be available to the remainder of the area upon annexation unless the present service boundaries are amended. Solid Waste Disposal The residents/property owners within the subject area are receiving private solid waste disposal set�ice. Upon annexation City ;waste disposal services will become available to the residents/ X • . -4- property owners within the subject area. State law provides that private solid waste disposal services may continue for a period of up to five years from the date an area is annexed to the City pro- viding these services meet conditions 1 through 3 below. Otherwise, services must be obtained from the City's Waste Disposal Division. In any event, conver- sion to Cite Waste Disposal. Services must occur within five years of the date of annexation. 1. The company must have been licensed by the County of Fresno for minimum of three years. This includes: Cannon Disposal Services; Browning -Ferris Industries of California; Fresno Roll -off Service; and Thrifty Best Rubbish Service. 2. A customer cannot change from one disposal company to another, only to the City's Waste Disposal Service. 3. The quality and frequency of services of the private company must meet the standards required by the City of Fresno.` An informational sheet on the "City's Waste Disposal Rates and Services" is attached. Parks and Recreation The neighborhood park and recreational needs of the service area, as defined by Parks and Recreation Standards, will -be adequately met when the Cedar/Sierra Park is developed. (estimated within the next two years). The regional park needs of the area are adequately met through use of Woodward Park facility, Flood Control There are no existing flood control facilities at the present time. Flood control facilities, when constructed, will be provided by the Fresno Metro- politan Flood Control District (FMFCD) which is responsible for all storm drain- age facilities within the Fresno -Clovis Metropolitan Area. The territory south of Alluvial Avenue falls within the "CM" drainage zone and is within the FMFCD bound- ary, while the area north of Alluvial is in the "CY" drainage zone and is outside ' of the FMFCD boundary. Animal Control There are no differences in the level of animal control services provided by the Society for the Prevention of Cruely to ,animals throughout the Fresno Metropolitan Area. Utility Tax The City's 4.6 percent utility tax will be applicable to all natural gas, electricity and telephone bills. The actual cost of such tax can be estimated by { � a j relating this tax rate to the current utility bills Property Tax With the passage of Proposition 13, City and. County property taxes are identical. Thus, annexation to the City of Fresno will cause no property tax increase to the property owner. The $3.95 monthly rate includes a weekly collection of one 30 gallon can of kitchen and table refuse, paper, glass, packing material., rags and other refuse involved in the handling or preparation of food. xn addition, rubbish of up to one cubic yard, (six 30 gallon cans) including newspapers, tree limbs, grass clippings, broken toys, bottles, etc., will also be collected each week. x SPECIAL EAULS: $29.40 per hour, with a minimum charge of $7.35 for the first quarter hour or fraction thereof. Time charged after the first quarter hour shall be on the basis of 5 minute intervals calculated to the nearest 5 minutes.
