RESOLUTION NO. 79 - 19
A RESOLUTION OF THE COUNCIL OF THE CITY
OF FRESNO F CALIFORNIA, ESTABLISHING RULES
AND REGULATIONS FOR TE14PORAR.ILY CLOSING
A PORTION OF A STREET.
WHEREAS, Vehicle Code Section. 21101 authorizes the
Council to adopt rules and regulations by ordinance or
resolution to temporarily close a portion of any street
within the City for celebrations, local special events, and
other purposes when in the opinion of the Council such
closing is necessary for the safety and protection of persons
who are to use that portion of the street during the temporary
closing;
NOW, THEREFORE, BE IT RESOLVED, by the Council of the
City of Fresno, as follows
SECTION 1 Definitions
a. "Celebration" shall mean the observance of a religious,
patriotic or social occasion., including a block party, but
shall not include a parade or street dance,
b. "Block Party" shall mean any neighborhood party :4n
a contiguous area, irrespective of the actual number of
blocks involved.
C. "Parade" shall mean a parade as defined by Fresno
Municipal Code Section 10--804.
d . "Street Dance" shall mean any Glance upon a street
subject to the regulations and procedures of Fresno Municipal
Code Section 7--306.7.
e. "Traffic Engineer," "Chief of Police," "Fire Chief,"
"Transportation Director" and "Chief Administrative Officer"
shall include their respective designated representatives
SECTION 2. Permit Required;. No person shall conduct,
manage or participate in any celebration, local special
events or other purposes requiring the temporary closure
of any portion of a street within the City without a written
permit for temporary street closure from the Traffic

Engineer of the City. This section shall not apply to any
parade or street dance.
SECTION :3. Application. Any person desiring a permit
required by Section. 2 of this Resolution sha.l.l file an
application with the Traffic Engineer. The application
shall states
- (a) The name of the. applicant
(b) The portion of the street to be closed
(c) The date and time when the streetshall be closed;
(d) The purpose for the closure of the street; and
(e) Such other information required by the Traffic
Engineer.'
SECTION 4. Issuance. The Traffic Engineer shall issue
the permit if he finds' that the closure of that portion of
the street will not substantially interrupt or interfere
with the safe and orderly movement of;
(a) Ordinary traffic by alternative routes
(b) Emergency vehicles, including fire apparatus,
police vehicles and ambulances; and
(c) Publlc transportation, including buses operated by
the Transportation Department of the City.
The Traffic Engineer shall contact the Chief of Police,
Fire Chief and Transportation Director for their.respecti e
reports and recommendations prior to the issuance of any
permit.
SECTION 5. Conditions. The Traffic Engineer may
impose such conditions upon the exercise of the permit as he
deems, necessary for the protection and safety of the publics
including but not limited to
(a) Requiring barricades to be placed with appropriate
signs at each intersection cif the, designated closure
(b) Prohibiting the placement of obstacles adjacent to
any fire hydrant,

(c) Requiring an unobstructed path: for the passage
of emergency vehicles;
(d) Requiring a responsible person be available to
remove any barricades if emergency access is necessary; and
(e) Limiting the duration of the permit.
SECTION 6. Notice The Traffic Engineer shall give
prompt written notice of his decision to the applicant` Chief
of Police, Fire Chief and Transportation Director.
SECTION 7 Appeal. Any aggrieved person may appeal the
decision of the Traffic Engineer within five stays of the
issuance of the decision to the Chief .Administrative Officer. The
Chief Administrative Officer shall notify the appellant, the
Traffic Engineer and the applicant or permitteeof the date,
time and place of the appeal hearing. The hearing shall be
informally conducted. The Chief Administrative Officer
shall affirm, reverse or modify the decision of the Traffic
Engineer and shall, give prompt notice of his decision to the
appellant, the Traffic .Engineer, the applicant or permittee.
The decision of the Chief Administrative Officer shall be
final
SECTION 8. Authority of Traffic Engineer. The Traffic
Engineer may promulgate such other rules and regulations
which are not inconsistent with this Resolution.
SECTION 9 Effective Date This Resolution shall be
effective and in full force and effect immediately upon its
adoption.
