RESOLUTION NO. 79 -1 7
A RESOLUTION OF THE COUNCIL OF THE CITE
OF FRESNOt CALIFORNIA, FIXING CHARGES
FOR SOLID WASTE :SERVICES -
WHEREAS, the City of Fresno provides solid waste disposal
services pursuant to Article 4 of Chapter 9 of the Fresno
.Municipal Code; and
WHEREAS, subsection (a) of Section 9-405 of the Fresno
Municipal Code provides, "The Council, by resolution, shall
establish and from- time to time may modify charges to be paid
by customers for solid waste disposal services rendered by the
city"; and
WHEREAS, the last establishment or modification of
charges for solid waste services was made on July 1, 1971; and
WHEREAS, the Solid Waste Management Division of the
Public Works Department is a municipally owned utility which
the Council through the Chief' Administrative Officer shall
endeavor to make financially self-sustaining pursuant to
Section 1218 of the Charter of the City of Fresno, and
WHEREAS, subsection (j) of Section 9-408 of the Fresno
Municipal Code provides, "The Council, by resolution, shall
establish and from time to time may modify fees to be paid
for private solid waste collection route permits and service
location permits"; and
WHEREAS, the.Solid Waste Management Division also incurs
costs in monitoring and regulating privately -owned solid
waste operations in the City of Fresno and is required to
recover such costs;
NOWT 'WHEREFORE, BE IT RESOLVED by the Council of the City
of Fresno, as follows;
SECTION 1. The following charges are hereby established
for solid waste disposal services rendered by the city:

(a) For purposes of this resolution onlye thirty
(30) gallons shall equal 0.15 cubic yards and three
hundred C300) gallons shall equal 1.5 cubic yards

(b) Rates for stationary compactor bins with a
capacity from one (1) cubic yard to six (6) cubic
yards, inclusive, shall be twice the rate established
herein for bins of similar capacity not used with
stationary compactors
(c) Service for stationary compactor bins
exceeding six (6) cubic yards capacity and debris boxes
shall be defined as "special hauls,." and the rates
shall be established as set forth in subsection (g) of
this section.
(d) When collection of solid waste is made from
two or more containers of different capacity, the total
charge imposed shall be the basic charge for the
largest container used plus the individual charges
based on the capacity or each container which
is to be considered as an "additional container." The
lesser charge for additional containers shall _ apply
only when all containers are placed for collection at
the same time and location, and all charges are billed
on a single bill to the same customer.
(e) When service commences or closes, applicable
charges shall be prorated upon the basis of a thirty -
day month, computed to the nearest five cents.
(,f) whenever more than one service change is
requested by the same customer at the same premises
within any sixty day period, a special service charge
of ten dollars shall be made for each change beyond the
first change in such period. Temporary suspension of
service shall be effected without the special service
charge if the stop and start dates are submitted at the
same time,
(g) The: charges for special hauls shah. be set by
the Controller and Finance Director to reimburse the
city for the direct and indirect costs of _providing
such service. The Public Works Director shall determine
- the appropriate means of providing such special service.
SECTION 2. The fees herein are established for private
solid waste collection route permits and service location
permits.
(a) If the Director determines that the Solid
Waste Management Division does not have the available
equipment and/'or manpower to provide a collection
service Which is therefore to be rendered by a private
operator, ,the private operator shall pay the following
fees annually and in advance for:
Collection Route Permit $5.00 per year or
fraction of a year
Service Location Permit . . . $1.00 per location per
year or fraction of a year.
(bj Except as provided in subsection (a) of this
section., the private operator shall pay the following
fees in -advance:
Collection Route Permit . $240.00 per year or
$ 2 0 . 0 0 per month
Service Location Permit $1.00 per service
location per month
SECTION 3. This resolution shall become effective and in
full force and effect on July 1, 1979.
