HomeMy WebLinkAboutResolution - City Council - 79-138 - 1979-04-10Y Public Works t �r RESOLUTION NO. 79- 13 RESOLUTION ORDERING THE WORK CITY OF FRESNO ASSESSMENT DISTRICT NO. 8 RESOLVEDr by the Council of the City of Fresno, California, that: WHEREAS , said Council did on January 23 1979, adopt its Resolution of Intention No. 79-- 30 to order the therein described work and improvements to be done and made in said City., which Resolution of Intention was duly and legally published in the time, form and manner as required by law, as shown by the affidavit of publication of said Resolution of Intention on file in the office of the City Clerk of said City; and WHEREAS, after the adoption thereof, notices of the passage of said Resolution of Intentions headed "Notice of Improvement", were duly and legally posted in the time, form, manner, locations and number as required by law, as appears from the affidavit of posting and notices on file in the office of the City Clerk of said City; and WHEREAS, notices of the adoption of said Resolution of Intention were duly mailed by the City Clerk to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention according to the names and addresses at such owners, as the name appears on the last equalized assessment roll for City taxes prior to the day of such mailing, or as known to the City Clerk of the said. City of Fresno, which said notices were duly mailed in the timer form and manner as required by law, as appears from the affidavit of mailing on file in the office of the City Clerk of said City; and A C�: t`•. �IF� WHEREAS, the hearing on said Resolution of Intention was duly held by said Council at the time and place set forth in said Resolution of Intention and in said notices and at said hearing all evidence presented, both oral and documentary,concerning the jurisdictional facts in this proceeding and concerning the necessity for the proposed improvement and the benefits to be derived therefrom, and all written protests and objections delivered to the City Clerk at or prior to the hour set for said hearing were received and considered by said Council. NOW, THEREFORE, SAID COUNCIL HEREBY FINDS, DETERMINES, AND ORDERS AS FOLLOWS: 1. The total area owned by all owners who have filed such protests and objections and have not filed written withdrawal thereof prior to the conclusion of said hearing or any adjournment thereof does not equal more than one-half of the property to be assessed for said work and improvements and such pretests are found insufficient by this Council, and said Council has acquired jurisdiction to order the proposed work to be done 2. The public interest and convenience require the work r - and improvement herein referred to, and it is therefore hereby ordered that the work and improvement described in Resolution of Intention No. 79- 30 , and in the plans and specifications therein referred to, be done and made. i 3. The boundaries of the assessment district and the grades to which said work and improvement is to be constructed shall be those set forth and described in said Resolution of Intention No. 79- 30 and in the plans and specifications therein referred to, reference to which is hereby made for all further particulars.
