RESOLUTION ORDERING VACATION OF A PUBLIC STREET
WHEREAS, pursuant to Resolution of Intention No, 762-D,
on file herein., a public hearing was held at 2a00 p.m on
the 3rd day of April, 1979, at a regular meeting of the
Council of the City of Fresno in the Council Chambers of
the Fresno City Hall in the City of Fresno, County of Fresno,'
State of California, at which time and place evidence was
heard for an against the vacation of the hereinafter des-
cribed public street situated within the City and County of
Fresno; and
HEREAS7 the City Traffic Engineer has reviewed the pro-
posed vacation action and determined that it will have no
adverse effect upon traffic circulation; and
WHEREAS, findings of Environmental Assessment No 2575
indicate that the proposed vacation action will have "no
possibility of significant effect on the environment;" and
WHEREAS, the Council of the City of Fresno now finds
from all the evidence submitted that such street, hereinafter
particularly described is unnecessary, for present and pro-
spective public streetpurposes;
NOW, THEREFORE, THE COUNCIL OF THE CITY OF FRESNO
pursuant to the provisions of the "Street Vacation Act of
1941," being Sections 8300--8374 of the Streets and Highways
Code of the State of California, DOES HEREBY RESOLVE AS ,
FOLLOWS,
1. The public interest and convenience require, and
it is hereby ordered, that as contemplated by Resolution of
Intention No. 762-i3, adopted by the Council of the City
of Fresno on the 6th day of Marc%, 1979, the hereinafter
described public street situated in the City and County of
Fresno be and the same is hereby closed, vacated and aban-
doned for public street purposes. For further particulars
as to the proposed vacation., reference is hereby made to the
PAISISE
BOO
map entitled "Exhibit A" on file in the Office of the City
Clerk of the City of Fresno, at the Fresno City Hall,
2326 Fresno Street;, Fresno, California 93721, and by this
reference, made a part hereof,
2. The public street to be vacated is _described as
follows:
All that portion of North. Eleventh. Street (formerly
Adelaide Avenue) lying adjacent to and east of
Lot 2 Arminto' Heights according to the map thereof
recorded in Book 9 of Record of Surveys at Page 71
Fresno County Records, more particularly described: as
follows
BEGINNING at the Northeast corner of said, Lot 2; thence
North 880 54' 00" East, a distance of 60.02 feet to the `
East line of said Eleventh Street; thence youth 00"
06' 30 West, along the East line of said Eleventh
Street,a distance of 40.53 feet to a point of cusp;
thence Northerly and Westerly along a curve concave to
the South and having a radius of 50.00 feet, through an
interior angle of 731 441 24", an arc: distance of 64.35
feet to a point of cusp, said point lying on the East
line of said Lot 2; thence North 000 061 30" East, along
said East line of Lot 2, a distance of 39.26 feet to
the point of BEGINNING
3. The Council finds and determines that the rights
of way or parts thereof vacated are not useful as bicycle
paths or routes.
4 The Public Works Director of the City of Fresno
is hereby authorized to execute, can behalf of the City of
Fresno, the Agreement (Related to the Vacation of a Street),
5. The City Clerk of the City of Fresno shall certify
to the passage of this resolution and shall cause a certified
copy thereof attested by the Clerk under the seal of the
City of Fresno, to be recorded in the Office of the County
Recorder of the County of Fresno, State of California.
